MINUTES PLANNING COMMISSION MEETING FRUIT HEIGHTS CITY 910 South Mountain Road September 28, 2021 WELCOME: Chairman Curtis Tanner called the meeting to order at 7:01 PM. PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was led by Commissioner Sam Brady, and the meeting was opened with Council Member Diane Anderson offering a word of prayer. PLANNING COMMISSION MEMBERS PRESENT: Planning Commissioners Brian Bare, Sam Brady, Carrie Carroll, Kevin Paulsen and Curtis Tanner (Chairman) were present. City Council Member Diane Anderson was present as well. CITY STAFF PRESENT: City Manager Brandon Green, City Planner Jeff Oyler and City Recording Secretary Amy Gardiner were present. VISITORS: George Ray, Eileen Moss and Laura Hubrich were present. REVIEW AND APPROVAL OF MINUTES FROM PREVIOUS MEETING: Planning Commission Meeting May 25, 2021 Planning Commission members discussed the draft minutes that previously had been provided to them for the May 25, 2021 Planning Commission Meeting and no corrections were suggested. After brief discussion, Commissioner Carrie Carroll made a motion to approve the minutes for the May 25, 2021 Planning Commission meeting. The motion was seconded by Commissioner Sam Brady and it was approved unanimously. Planning Commission Meeting August 24, 2021 Planning Commission members discussed the draft minutes that previously had been provided to them for the August 24, 2021 Planning Commission Meeting and a few corrections were made. After brief discussion, Commissioner Sam Brady made a motion to approve the minutes for the August 24, 2021 Planning Commission meeting as corrected. The motion was seconded by Commissioner Kevin Paulsen and it was approved unanimously. CITY BUSINESS: Review/Discuss Accessory Dwelling Unit (ADU) Ordinance Amendments A copy of a draft of the Fruit Heights City ADU Ordinance Amendments was provided to the Commissioners prior to the meeting. City Planner Jeff Oyler explained that he had met with the City Attorney and reviewed the draft ordinance as well as suggestions given by City Council Member Eileen Moss. City Planner Jeff Oyler then led a lengthy discussion with the Planning Commission and City Manager Brandon Green about the ADU Ordinance. Concerns they discussed included: • Minimum square footage • Maximum square footage • Purpose of ADUs • No street parking • Onsite parking • Impact on neighbors • Owner occupied home • Concerns about renters who won’t pay rent • Short term rentals (less than 30 days) vs. Long term rentals • Application process for ADUs • Additional tax revenue for short term rentals • External v. internal ADUs • What other cities are doing • Allowing for complaints about ADUs • Size of driveways where parking is required • Issues with Airbnb-type rentals • Paying a fee and being licensed in order to rent an ADU • Need for a public hearing Commissioner Sam Brady provided conceptual drawings for possible space in a home with a two-bedroom ADU and it was discussed as well. City Manager Brandon Green concluded the discussion by recommending the Planning Commission members get their comments on the draft ordinance together and give them to Chairman Curtis Tanner by next Tuesday. City Manager Brandon Green would then review the comments with the City’s Attorney. SUBDIVISION REVIEW: Review/Discuss Rock Loft Ridge Estates Development Agreement City Manager Brandon Green briefly confirmed the Planning Commission members had the ability to review the proposed Rock Loft Ridge Estates Development Agreement that had been provided to them prior to the meeting. He encouraged them to review it before their next work meeting on October 12, 2021. He said by the time the agreement is approved it will be a substantial document along with the CC&Rs. The Planning Commission raised questions and concerns about the agreement that City Planner Jeff Oyler and City Manager Brandon Green answered including: • Qualified engineers certifying each house as it is built • Cost of qualified help in the building process of each house • Process by which engineers certify everything • Water and soil issue • The proposed homeowner's association for the development OTHER COMMENTS: Laura Hubrich asked about the possibility of a public hearing on October 26 for the proposed ADU Ordinance. City Manager Brandon Green, City Planner Jeff Oyler and the Planning Commission discussed the possibility of having public hearings on the ordinance but most agreed that they may not be ready by October 26 to present it to the public. It was agreed that the city needs to feel good about the ordinance before they push it out to the residents. They discussed the possibility of a November public hearing. Commissioner Kevin Paulsen made a motion to adjourn the Planning Commission meeting, and it was seconded by Commissioner Carrie Carroll. The meeting was adjourned at 8:37 pm.
