MINUTES PLANNING COMMISSION MEETING FRUIT HEIGHTS CITY 910 South Mountain Road October 26, 2021 WELCOME: Chairman Curtis Tanner called the meeting to order at 7:05 PM. PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was led by Commissioner Carrie Carrol, and the meeting was opened with Commissioner Brian Bare offering a word of prayer. PLANNING COMMISSION MEMBERS PRESENT: Planning Commissioners Brian Bare, Carrie Carroll, Kevin Paulsen and Curtis Tanner (Chairman) were present. City Council Member Diane Anderson was present as well. Commissioner Sam Brady was excused and arrived a little before 8 PM for the remainder of the meeting. CITY STAFF PRESENT: City Manager Brandon Green, City Planner Jeff Oyler, City Engineer Brandon Jones and City Recording Secretary Amy Gardiner were present. VISITORS: Darren Hess, Steve Droste, Scott Justensen, Eileen Moss, Blake Spendlove, Kenzy Hogan, Eddy Hogan, George Ray and Laura Hubrich were present. REVIEW AND APPROVAL OF MINUTES FROM PREVIOUS MEETING: Planning Commission Meeting September 28, 2021 Planning Commission members discussed the draft minutes that previously had been provided to them for the September 28, 2021 Planning Commission Meeting and a few corrections were made. After brief discussion, Commissioner Carrie Carroll made a motion to approve the minutes for the September 28, 2021 Planning Commission meeting as corrected. The motion was seconded by Commissioner Brian Bare and it was approved unanimously. PUBLIC HEARING: None. SUBDIVISION REVIEW: Review/Discuss/Approve/Deny Hogan Subdivision City Manager Brandon Green showed a copy of the proposed plat for the Hogan Subdivision. He reported: • The Geotech study was complete and the engineers say it is suitable for construction. • The house will be built in the north east corner of the lot. • UDOT will allow them to bring a road (driveway) out to Mountain Road as long as it is no wider than 15 feet. • There are concerns that the driveway will be too close to the northbound ramp to HWY- 89. • All utilities are available on Mountain Road and secondary water is available on the upper side of the lot. City Manager Brandon Green answered questions from the Commissioners and stated that the staff recommendation is that they approve the Hogan Subdivision. Commissioner Kevin Paulsen made a motion to approve the Hogan Subdivision. The motion was seconded by Commissioner Carrie Carroll and it was approved unanimously. Review/Discuss/Approve/Deny Green Farm Estates Phase 3 City Manager Brandon Green showed a copy of the proposed plat for the Green Farm Estates Phase 3. He reported that they will not be adding any more homes, but they will be amending the properties and renaming them lot 21 and lot 22. City Manager Brandon Green also reported that he confirmed with the County it is comfortable with how the plat is presented. He said that the staff recommends approval of Green Farm Estates Phase 3 plat. Commissioner Carrie Carroll made a motion to approve the Green Farm Estates Phase 3 Subdivision. The motion was seconded by Commissioner Kevin Paulsen and it was approved unanimously. Review/Discuss Rock Loft Ridge Estates Development Agreement City Manager Brandon Green reported that the City staff met with the City Attorney to review the proposed Rock Loft Ridge Estates Development Agreement and he felt like they were getting close to a final review and then it will be presented to the Planning Commission and City Council at the next work meeting. City Planner Jeff Oyler pointed out that lot 62 will need to be treated as a PRUD since it is a 3 acre flag lot. He reviewed the requirements for the piece of property to be developed as a PRUD. He also mentioned that there will be requirements and limits when it comes to planting trees because of the aqueduct and the power lines. Darren Hess from Weber Basin took time to educate the Planning Commission about the aqueduct including: • Class ratings for how deep the pipe is in the ground: Class A - shallow, Class B - 10 ft, and Class C - 50 ft. • No deep rooted trees allowed. • Pipe is 70 years old and 78 inches wide - Concrete pipe with rubber gaskets. • Property owners will need to call blue stakes before they dig. • Bridges will be built during construction over the Class A and some Class B pipes to protect them while construction is going on. • There will be a revised plat to make sure the easement and pipe line up. • Requirements to replace or repair the aqueduct. City Planner Brandon Green then led a discussion with Darren Hess from Weber Basin about the use of culinary water for watering landscaping. Darren Hess pointed out the advantage of using culinary water that it is metered and people pay for what they use. Developer Scott Justensen pointed out that there are other subdivisions that are already built on and around the aquaduct. He pointed out the importance of the homeowner's association and landscape architects and approvals that will be required for property owners. He said he was anxious to work with Weber Basin and make it a flagship project reducing turf and conserving water. City Manager Brandon Green discussed remaining questions with the Planning Commission and Darren Hess. He also encouraged the Planning Commission to be ready for the work meeting that will be held on November 9, 2021. Review/Discuss Rock Loft Ridge Annexation Petition City Planner Jeff Oyler reported he is working on the annexation petition for Rock Loft Ridge Estates. The City has received the petition and it is moving forward. The property is 13 acres. OTHER BUSINESS: Review/Discuss Indoor Accessory Dwelling Unit Ordinance (IADU) Chairman Curtis Tanner reported that he had updated comments from members of the Planning Commission on the draft ordinance and passed them on to City Manager Brandon Green. City Planner Jeff Oyler reported that he had met with the City Attorney and discussed the draft ordinance. He said that the City Attorney highly recommended not varying too far from the current draft ordinance. The draft ordinance is defensible and not likely to be challenged. City Manager Brandon Green reported that he had also talked to the City Attorney with City Council Member Eileen Moss. They worked with the City Attorney to incorporate comments that had been made. The draft before the Planning Commision includes some of those comments. City Planner Jeff Oyler then led a lengthy discussion with the Planning Commission and City Manager Brandon Green about the draft ordinance. Concerns they discussed included: • Short-term rentals (less than 30 days) vs. long term rentals and distinguishing between them--should the ordinance cover short-term rentals? • Possible minimum or maximum square footage limitations. • Definitions to clarify items in the draft ordinance. • City Planner Jeff Oyler concluded the discussion by saying that they should expect more discussion and changes to the proposed ordinance that will happen at a legislative level. Additionally, Chairman Curtis Tanner confirmed that he was sending the comments on the draft ordinance from the Planning Commision to City Planner Jeff Oyler and City Manager Brandon Green. CALENDAR: City Manager Brandon Green led a lengthy discussion about the November City Meetings for both the City Council and the Planning Commission including some possible Public Hearings. The following schedule is what was decided: • November 2 -- Elections • November 4 -- City Council Meeting • November 9 -- Work Meeting - Development Agreement (also comments on IADU due to City Manager Brandon Green) • November 16 -- City Council Meeting - Canvas Election  • November 16 -- Planning Commission Meeting - recommendation on Rock Loft Ridge Estates Development Agreement • November 23 -- No Meeting • November 30 -- City Council with Public Hearing on Rock Loft Ridge Estates Development Agreement • December 7 -- City Christmas Party Commissioner Carrie Carroll made a motion to adjourn the Planning Commission meeting, and it was seconded by Commissioner Brian Bare.
