PLANNING COMMISSION MEETING
FRUIT HEIGHTS CITY
910 South Mountain Road
November 16, 2021
WELCOME: Chairman Curtis Tanner called the meeting to order at 7:23 PM.
PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was led by Chairman Curtis
Tanner, and the meeting was opened with Council Member Diane Anderson offering a word of
prayer.
PLANNING COMMISSION MEMBERS PRESENT: Planning Commissioners Brian Bare, Carrie
Carroll, Kevin Paulsen and Curtis Tanner (Chairman) were present. City Council Member Diane
Anderson was present as well. Commissioner Sam Brady was absent.
CITY STAFF PRESENT: City Manager Brandon Green, City Planner Jeff Oyler and City
Recording Secretary Amy Gardiner were present.
VISITORS: Sue Webster, Todd Webster, Blaine Spendlove, Matt Lowe, Scott Justensen,
Jeanne Groberg, John Pohlman, George Ray, Eileen Moss, AJ Singleton, Brock Hassan, Dee
Snuts, Josephie Hernandez, Stephen Morrell, Will Langeland and Caden Burton.
REVIEW AND APPROVAL OF MINUTES FROM PREVIOUS MEETING:
Planning Commission Meeting October 26, 2021
Planning Commission members discussed the draft minutes that previously had been provided
to them for the October 26, 2021 Planning Commission Meeting. No corrections were made.
After brief discussion, Commissioner Brian Bare made a motion to approve the minutes for the
October 26, 2021 Planning Commission meeting. The motion was seconded by Commissioner
Kevin Paulsen and it was approved unanimously.
SUBDIVISION REVIEW:
Review/Discuss/Approve/Deny Rock Loft Ridge Estates Development Agreement
Chairman Curtis Tanner reported on the work that had gone into creating the Rock Loft Ridge
Estates Development Agreement and turned the time over to City Planner Jeff Oyer to discuss
and answer questions about the agreement with the Planning Commission. He said that he felt
good about the agreement. Issues that were discussed with the Planning Commission included:
• Commissioner Brian Bare asked about what security the developer will provide and felt
that the security should be defined in the agreement. City Planner Jeff Oyler explained
that it is the funds the City requires from developers to hold in escrow. The amount of
security was discussed as well. City Planner Jeff Oyler also explained the warranty
period.
• City Manager Brandon Green explained that they had been working with the City
Attorney and that he was comfortable with where the agreement was at.
• Commissioner Kevin Paulsen had a discussion with City Manager Brandon Green and
Matt Lowe (representing the developer) about the restrictive covenant found in Section F
of the agreement.
• Matt Lowe agreed to have the developer indemnification provision removed from the
agreement. He also agreed to have the bond move from $1 million to $2 million dollars.
• The landscaping requirements in the development.
After the discussion, Chairman Curtis Tanner explained that it was the Planning Commission’s
responsibility to recommend or deny the agreement moving on to the City Council.
Commissioner Kevin Paulsen made a motion to recommend the Rock Loft Ridge Estates
Development Agreement be approved by the City Council subject to the conditions that were
discussed. The motion was seconded by Commissioner Carrie Carroll and it was approved
unanimously.
OTHER BUSINESS:
Review/Discuss Accessory Dwelling Unit Ordinance (ADU)
City Manager Brandon Green explained that a public hearing on the Accessory Dwelling Unit
Ordinance (ADU) will be delayed until the first of the year. He pointed out that ADUs will be
allowed and permitted. He said that it will be important to finalize the ordinance for the first of
the year.
City Planner Jeff Oyler took some time to explain what is happening in other counties and states
that allow ADUs. Chairman Curtis Tanner encouraged the Planning Commission to review the
ordinance and make sure they are happy so it can move forward at the first of the year.
City’s General Plan Update
City Manager Brandon Green explained that he has been working on the City’s General Plan
update. He mentioned there would be an open house to receive feedback from the residents.
He also explained that the City received a grant so there is no cost to the City for the work on
the General Plan. He said that information could be found at fruitheightsforward.org.
CALENDAR:
• November 23 -- No Meeting
• November 30 -- City Council with Public Hearing on Rock Loft Ridge Estates
Development Agreement
• December 7 -- City Christmas Party
Commissioner Brian Bare made a motion to adjourn the Planning Commission meeting, and it
was seconded by Commissioner Kevin Paulsen. The meeting was adjourned at 8:10 pm.
