PLANNING COMMISSION MEETING
FRUIT HEIGHTS CITY

August 27, 2024
WELCOME: Co-Chairman Justin Wright called the meeting to order at 7:02 pm.
PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was led by Commissioner Justin Wright with
Commissioner Clark Moss offering a word of prayer.
PLANNING COMMISSION MEMBERS PRESENT: Commissioners Justin Wright, Clark Moss, Heidi Murdock
and Shelley Bodily. Council Member Gary Anderson.
CITY STAFF PRESENT: City Manager Darren Frandsen, City Planner Jeff Oyler, Public Works Director
Layne Leonard, and Deputy Recorder Hailee Ballingham.
VISITORS: Tyler White.
PRESENTATION:
Hailee Ballingham City Deputy Recorder swore in Shelley Bodily as a member of the Planning
Commission for Fruit Heights City.
REVIEW AND APPROVAL OF MINUTES FROM PREVIOUS MEETINGS:
July 30, 2024, Planning Commission Meeting Minutes
Commissioner Heidi Murdock made a motion to approve the July 30, 2024, Minutes. Commissioner Clark
Moss seconded the motion. The motion was unanimously approved by the Planning Commission (0:07).
PLANNING COMMISSION BUSINESS:
5.1 Pool Ordinances
At the last Planning Meeting a resident was requesting a 3-feet setback for his pool. City Planner Oyler
and City Manager Frandsen have looked at other city’s setbacks. They vary from 5 to 10 feet. Research
shows a national average of a 5-foot setback for pools, with no clear reason behind the standard.
The Commissioner’s discussed changing the interior property line setback from 8 feet to 5 feet or even 3
feet. They were split 50/50 on the number. It was suggested that the Commission seek direction from the
City Council regarding this change before moving through the process of a public hearing.
Commissioner Heidi Murdock made a motion to have staff talk with the Council to see if they would
entertain a change to the pool ordinance with a setback of 3 or 5 Feet. Commissioner Clark Moss
seconded the motion. The motion was unanimously approved by the Commission. (0:33)
5.2 Chicken Ordinance
The Planning Commission would like a clean copy of the last draft of the Chicken Ordinance to look over
one more time. They would like to make a recommendation for the city council at their next meeting.
5.3 Areas for R-1-6
Commission discussion supports having an R-1-6 zone in the city general plan. The Commission
described the areas they feel the R-1-6 zone would best work in the city.
Commissioner Bodily pointed out the importance of open space in a city. He feels some of the proposed
areas would be better used as open space rather than filling it in with new homes.
City Manager Frandsen took notes and will mark all the areas on a map and send them back out to the
planning commission. The city will then present their findings with an open house for the residents to
come and ask questions and give their concerns.

Commissioner Heidi Murdock made a motion to Adjourn. Commissioner Clark Moss Seconded the
motion. The meeting ended at 8:56 p.m.
