FULLERTON CITY COUNCIL SUCCESSOR AGENCY AGENDA - APRIL 21, 2020 303 West Commonwealth Avenue, Fullerton, California MEETINGS: The Fullerton City Council / Successor Agency meets on the first and third Tuesday of the month, convening for Closed Session at 5:00 p.m. and Regular Session at 6:30 p.m. PUBLIC COMMENT: The public may comment on Closed Session items at the beginning of the Closed Session meeting. The public may comment on matters not appearing on the agenda and Consent Calendar items during Public Comments at the Regular Session meeting. Prior to public comments, the public may request the removal of consent items for further discussion. Those wishing to speak on a regular business or a public hearing item on this agenda may do so when the Mayor calls that specific item for consideration. Each speaker addressing non-agenda and consent calendar items shall have three minutes to make their remarks. City Council will allow no more than a total of 30 minutes at the beginning of the Regular Session for non-agenda comments. Those speaking on regular business items and public hearing items shall have no more than three minutes per item to address City Council. No person shall speak more than one time to the same item. The Mayor may request that a spokesperson represent a group wishing to address City Council. The Mayor or majority of the Council may grant an extension of time for a speaker. No speaker may yield their time to another speaker. PERSONS ADDRESSING CITY COUNCIL: Please complete a speaker form and submit the form to the Assistant City Clerk in the lobby prior to approaching the podium. State your name and city of residence for the record at the beginning of your remarks. All speakers shall observe civility, decorum and good behavior. Any item submitted to the City Council during the meeting shall become public record and subject to applicable disclosure laws. The City Clerk’s Office posts the agenda packet online no later than 72 hours prior to the meeting at www.cityoffullerton.com. The City Clerk’s Office and Library have copies of the packet available for public review. In accordance with CA Government Code Section 54957.5, the public may inspect any writings or documents relating to an open session agenda item distributed less than 72 hours prior to a regular meeting at the City Clerk’s Office located at 303 West Commonwealth Avenue, Fullerton, California and the Fullerton Main Branch Library Information Counter located at 353 West Commonwealth Avenue, Fullerton, California during normal business hours. Authorize appropriation of SB 2 allocations. 6. E-RATE GRANT FUNDING OF LIBRARY TECHNOLOGY NEEDS Recommendation: 1. Authorize Library Director, or designee, to execute agreement, in a form approved by the City Attorney. 2. Authorize application for Fiscal Year 2020 Category 2 E-Rate program which requires City match of $43,390.58. 3. Should Category 2 grant be awarded, authorize acceptance of grant award and appropriation of amounts awarded and matching funds. 7. ON-CALL PROFESSIONAL AIRPORT ARCHITECTURAL / ENGINEERING / PLANNING / ENVIRONMENTAL CONSULTANT SERVICES Recommendation: Fullerton City Council | Successor Agency Agenda April 21, 2020 - Page 4  1. Authorize Public Works Director, or designee, to execute a Consultant Agreement for on-call professional airport architectural / engineering / planning / environmental consultant services with C&S Companies, Inc., in a form approved by the City Attorney. 2. Authorize Director of Administrative Services to issue purchase orders to these firms for individual projects on an as-needed basis. PUBLIC HEARINGS - None REGULAR BUSINESS (Items 8 - 12) 8. MONTHLY LEGISLATIVE UPDATE AND COVID-19 STATE AND FEDERAL LEGISLATION Summary of recent legislative updates as provided by Townsend Public Affairs. These updates include the most recent State and Federal COVID-19 related legislation. A fourth phase of federal stimulus funding for local governments under 500,000 has been introduced and Staff seeks direction on advocacy efforts. Recommendation: 1. Receive and file Monthly Legislative Report. 2. Direct Staff accordingly pending discussion on state and federal legislation and city advocacy efforts. 3. Authorize nominal staff support for California Mayor’s Coalition. 9. DIRECTION REGARDING MANDATORY FACE COVERINGS WITHIN THE CITY OF FULLERTON Upon request by Council Member Zahra, and supported by Council Member Silva, City Council direction is requested regarding mandatory face covering guidance within the City of Fullerton . Potential direction could include guidance for essential businesses, employees, customers and residents outside of their residence. Recommendation: Provide Staff direction regarding mandatory face covering guidance for essential businesses, employees and customers within these businesses. Optional direction to include all residents outside of their residence. Direction may include authorizing the issuance of a Director of Disaster Services proclamation regarding face coverings per direction of the City Council or other direction as deemed necessary and appropriate by the City Council, to be effective upon issuance of Proclamation. 10. HILLCREST PARK - DUCK POND IMPROVEMENTS Award $829,600 construction contract to Three Peaks Corp. for Hillcrest Park - Duck Pond Improvements Project. Recommendation: 1. Approve plans and specifications for Hillcrest Park - Duck Pond Improvements Project. 2. Approve $396,500 budget transfer to Project 54500 Hillcrest Park from Park Dwelling Fund Balance. Authorize Director of Public Works, or designee, to approve any future change orders for construction and professional engineering construction support services within approved project budget. 11. PFAS TREATMENT FACILITIES AND PROGRAM AGREEMENT WITH ORANGE COUNTY WATER DISTRICT FOR TREATMENT PLANTS RELATED TO PER- AND POLYFLUOROALKYL SUBSTANCES (PFAS) Execution of 30-year PFAS Treatment Facilities and Program Agreement with Orange County Water District (OCWD) will provide funding for construction of necessary Per- and Polyfluoroalkyl Substances treatment plants and a portion of ongoing operational and maintenance costs for impacted Fullerton Wells. Recommendation: Authorize City Manager, or designee, to execute attached PFAS Treatment Facilities and Program Agreement, subject to minor changes approved by City Attorney ’s Office and City Manager, and any other necessary documents, with Orange County Water District related to construction of Fullerton’s PFAS Treatment Facilities and ongoing operations and maintenance. 12. MILLS ACT PROGRAM ADOPTION AND GUIDELINES Consideration of a Mills Act Program for the City of Fullerton including program guidelines, selection criteria and approval process for the preservation, rehabilitation and maintenance of eligible historic properties. Recommendation: Adopt Resolution No. 2020-XX.
