FULLERTON CITY COUNCIL SUCCESSOR AGENCY AGENDA - JUNE 18, 2024 303 West Commonwealth Avenue, Fullerton, California MEETINGS: The Fullerton City Council / Successor Agency meets on the first and third Tuesday of the month, convening for Closed Session at 5:00 p.m. and Regular Session at 6:30 p.m. PUBLIC COMMENT: The public may comment on Closed Session items at the beginning of the Closed Session meeting. The public may comment on matters not appearing on the agenda and Consent Calendar items during Public Comments at the Regular Session meeting. Prior to public comments, the public may request the removal of consent items for further discussion. Those wishing to speak on a regular business or a public hearing item on this agenda may do so when the Mayor calls that specific item for consideration. Each speaker addressing non-agenda and consent calendar items shall have three minutes to make their remarks. City Council will allow no more than a total of 30 minutes at the beginning of the Regular Session for non-agenda comments. Those speaking on regular business items and public hearing items shall have no more than three minutes per item to address City Council. No person shall speak more than one time to the same item. The Mayor may request that a spokesperson represent a group wishing to address City Council. The Mayor or majority of the Council may grant an extension of time for a speaker. No speaker may yield their time to another speaker. PERSONS ADDRESSING CITY COUNCIL: Please complete a speaker form and submit the form to the Assistant City Clerk in the lobby prior to approaching the podium. State your name and city of residence for the record at the beginning of your remarks. All speakers shall observe civility, decorum and good behavior. Any item submitted to the City Council during the meeting shall become public record and subject to applicable disclosure laws. AGENDA ITEMS: This agenda contains a brief summary of each item the Council / Agency will consider. The City Clerk’s Office posts the agenda packet online no later than 72 hours prior to the meeting at www.cityoffullerton.com. The City Clerk’s Office and Library have copies of the packet available for public review. In accordance with CA Government Code Section 54957.5, the public may inspect any writings or documents relating to an open session agenda item distributed less than 72 hours prior to a regular meeting at the City Clerk’s Office located at 303 West Commonwealth Avenue, Fullerton, California and the Fullerton Main Branch Library Information Counter located at 353 West Commonwealth Avenue, Fullerton, California during normal business hours. The City will post such writings and documents received in sufficient time on the City’s website at www.cityoffullerton.com. HOUSING ELEMENT UPDATE Staff has nearly completed the final draft 2021-2029 City Housing Element for Regional Housing Needs Assessment Cycle 6. Staff plans to release this document for public review and then submit the revised draft Housing Element to HCD for a mandated second check to ensure substantial compliance with state law no later than July 1, 2024. Proposed Motion: Direct staff to present draft Housing Element document to the Planning Commission. Ratify selection of Allied Paving Company to provide materials and services for West Valley View Drive water main break emergency repairs, waiving formal bidding procedures. 2. Authorize Administrative Services Director, or designee, to issue $90,100 purchase order to Allied Paving Company for materials and services related to West Valley View Drive water main break emergency repairs. 10. LAGUNA AND LAS PALMAS WATER BOOSTER PUMP STATIONS EMERGENCY GENERATORS Proposed Motion: 1. Approve $338,139.50 purchase of two emergency standby generators from Quinn Power through Sourcewell cooperative. 2. Authorize Administrative Services Director, or designee, to issue a $338,139.50 purchase order to Quinn Power to purchase two new emergency generators. 3. Authorize Public Works Director, or designee, to approve future change orders within the approved project budget. 11. PROFESSIONAL SERVICES AGREEMENTS WITH ONLINE INFORMATION SERVICES, INC. AND RSI ENTERPRISES, INC. FOR ON-CALL DEBT COLLECTION SERVICES Proposed Motion: 1. Approve and authorize City Manager, or designee, to execute and administer Professional Services Agreements with the following firms to perform On-Call Debt Collection Services, in a form approved by the City Attorney: · Online Information Services, Inc. Approve and authorize City Manager, or designee, to execute Professional Services Agreements for On-Call List for Temporary Staffing Services, in a form approved by the City Attorney, with the following firms: · AppleOne Inc. · CathyJon Enterprises / HB Staffing · Robert Half Inc. · Emploi Group, Inc. / AtWork Personnel Services. 2. Authorize City Manager, or designee, to execute and administer related documents and change orders, including renewal term options, in a form approved by the City Attorney. 13. PROFESSIONAL SERVICES AGREEMENT WITH SP PLUS FOR PARKING ENFORCEMENT SERVICES Proposed Motion: 1. Authorize City Manager, or designee, to execute and administer a Professional Services Agreement with SP Plus for parking enforcement services, in a form approved by the City Attorney. 2. Authorize City Manager, or designee, to execute and administer related documents, including optional renewals, in a form approved by the City Attorney. 14. COOPERATIVE AGREEMENT WITH ORANGE COUNTY TRANSPORTATION AUTHORITY FOR HARBOR BOULEVARD INNOVATIVE CORRIDOR PROJECTS Proposed Motion: Authorize City Manager, or designee, to execute Cooperative Agreement No. C-3-3023 with the Orange County Transportation Authority for the Harbor Boulevard Innovative Corridor Projects. 15. CONTRACT WITH KINGMEN CONSTRUCTION, INC FOR WATER WELL 7A EQUIPPING Proposed Motion: 1. Approve plans and specifications for the Well 7A Equipping Project. 2. Approve $1,900,008 Water Funds (Fund 44) budget appropriation from Fund Balance to Project 53005 Water Well Replacement Program within the Water Fund (Fund 44). Award $2,826,000 construction contract for Well 7A Equipping Project to Kingmen Construction, Inc. and authorize City Manager, or designee, to execute and administer contract, in a form approved by the City Attorney. 4. Authorize Public Works Director, or designee, to approve any change orders for construction and professional engineering construction support services within the approved project budget. PUBLIC HEARINGS - None REGULAR BUSINESS (Items 16 - 17) 16. YOUTH COMMITTEE STRUCTURE REVISIONS City Council adopted Resolution No. 2020-97 to establish a Youth Commission on November 2, 2020. City Council directed staff to meet with the Fullerton Collaborative in April 2024 and report back in June 2024. Staff requests City Council provide direction for revision to the Youth Committee structure. Proposed Motion: Staff recommends City Council form a Youth Committee with revisions developed with Fullerton Collaborative input and direct staff to prepare a resolution to revise Resolution No. 2020-97 in July 2024. 17. CALIFORNIA STATE UNIVERSITY FULLERTON / FULLERTON GROUND LEASE AND FULLERTON / SKY HARBOR FULLERTON, LLC SUBLEASE AMENDMENTS City Council consideration of Amendment to Ground Lease between The Board of Trustees of the California State University and The City of Fullerton, California and the Amended and Restated Sublease between The City of Fullerton, California and Sky Harbor Fullerton, LLC for the Marriott hotel. Proposed Motion: 1. Approve in substantially the form attached and authorize City Manager, or designee, to finalize, execute and administer Amendment to the Ground Lease by and between The Board of Trustees of the California State University and The City of Fullerton, California, in a form approved by the City Attorney. 2.
