TOWN OF FUQUAY-VARINA BOARD OF COMMISSIONERS REGULAR MEETING OCTOBER 1, 2018 CALL TO ORDER Mayor John W. MOTION: Commissioner Wunsch SECOND: Mayor Pro-Tem Massengill MOTION RESULT: Passed Unanimously (4-0) ****************************** PRESENTATIONS Agenda Item No. 4.A: There were no presentations for the October 1, 2018 Town Board meeting ****************************** PUBLIC COMMENTS: Ms. Connie Williford of 1602 Wingers Court and Ms. Renee Holmes of 228 E. Spring Street addressed the Town Board regarding an issue with predatory towing practices that they encountered in the Varina Station parking lot (a private parking lot). Ms. Robin Morrison, owner of Pints Ice Cream & Beer (512 Broad Street), stated that she spoke with the owner of Varina Station and the parking lot and she stated that all towing will stop until they can come to some understanding and clarification on the towing fees and practices. ****************************** ITEMS TABLED FROM PREVIOUS MEETING: There were no items tabled from previous meeting for the October 1, 2018 Town Board meeting. ****************************** PUBLIC HEARINGS: Agenda Item No. 7.A: Voluntary Annexation Petition - Christ Church North Carolina - 8316 and 8320 Lake Wheeler Road - PIN 0689587142 and 0689681119 - ANX-2018-11 Purpose – To consider an annexation ordinance extending the corporate limits of the Town of Fuquay-Varina following receipt of a petition for voluntary annexation of property owned by Christ Church North Carolina located at 8316 and 8320 Lake Wheeler Road, containing a total of 7.887 acres. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the subject property with respect to the proposed annexation to include that the property is non-contiguous to the town corporate limits but does have water and sewer available to serve the property. Public Hearing – The public hearing was opened. Mr. Ed Loeffler with Curry Engineering, 205 S. Fuquay Avenue, spoke in favor of the request on behalf of Christ Church North Carolina. No one chose to speak in opposition to the annexation petition (ANX-2018-11). The public hearing was closed. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Adopt the annexation ordinance to extend the corporate limits of the Town of Fuquay-Varina to include property owned by Christ Church North Carolina (ANX-2018-11) as presented and recommended. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the subject property with respect to proposed zoning map amendment to include information pertaining to the proposed zoning of the property, proposed zoning conditions, surrounding land use, the town’s land use plan, public utility availability, transportation impacts and considerations, the required neighborhood meeting, and staff recommendation. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the subject property with respect to the proposed annexation to include that the property is non-contiguous to the town corporate limits but does have town water available to serve the property. Public Hearing – The public hearing was opened. Mr. Jim Chandler, Senior Project Manager for Timmons Group, spoke in favor of the proposed annexation petition on behalf of Stancil Vineyards, LLC. No one chose to speak in opposition to the proposed voluntary annexation petition for ANX-2018-12. The public hearing was closed. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Adopt the annexation ordinance to extend the corporate limits of the Town of Fuquay-Varina to include property owned by Stancil Vineyards, LLC (ANX-2018-12), and to approve the Declaration of Annexation Agreement as presented and recommended. MOTION: Commissioner Harris SECOND: Mayor Pro-Tem Massengill MOTION RESULTS: Passed Unanimously (4-0) Ordinance No. N-18-45 Agenda Item No. 7.D: Zoning Map Amendment - Stancil Builders, Inc. - 3315 John Adams Road - PIN 0696571227 - REZ- 2018-13 Purpose – To consider a requested zoning map amendment for a total of 42.1 acres, located at 3315 John Adams Road, from the Wake County R-30 and Highway District Zoning Districts to the Residential Agricultural Conditional Zoning District (RA-CZD). Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the subject property with respect to proposed zoning map amendment to include information pertaining to the proposed zoning of the property, proposed zoning conditions, surrounding land use, the town’s land use plan, public utility availability, transportation impacts and considerations, the required neighborhood meeting, and staff recommendation. Discussion – Town Board members discussed appreciation for the developer, Mr. Freddie Stancil, choosing to annex and zone the property into the Town and for voluntarily offering zoning conditions that address community character. Recommendation – Approve REZ-2018-13, a zoning map amendment, located at 3315 John Adams Road, from the Wake County R-30 and Highway District Zoning Districts to the Residential Agricultural Conditional Zoning District (RA- CZD). The proposed amendment is consistent with the Land Use Plan and reasonable and in the best interest of the public for the reasons identified by management and staff. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the subject property with respect to proposed zoning map amendment to include information pertaining to the proposed zoning of the property, the proposed plot plan in lieu of the required master plan, proposed plot plan conditions, surrounding land use, the town’s land use plan, public utility availability, transportation impacts and considerations, the required neighborhood meeting, and staff recommendation. Public Hearing – The public hearing was opened. Mr. Wayne Mauldin, of Mauldin-Watkins Surveying, 1301 Broad Street, spoke in favor of the zoning map amendment and plot plan on behalf of the property owner, Hancock Investments, LLC. No one chose to speak in opposition to the proposed zoning map amendment (REZ-2018-14) and plot plan. The public hearing was closed. Discussion – Mayor Pro-Tem Massengill inquired about the voluntary plot plan conditions. Town Manager Mitchell stated that they address community character and provide assurance that what is constructed on the two lots compliments existing development. Recommendation – Approve REZ-2018-14 and accompanying plot plan, a zoning map amendment at 108 and 110 Clifton Street, from the Residential Low Density (RLD) Zoning District to the Town Center Residential (TCR) Zoning District. The proposed amendment is consistent with the Land Use Plan and reasonable and in the best interest of the public for the reasons identified by management and staff. MOTION: Commissioner Gardner SECOND: Commissioner Harris MOTION RESULTS: Passed Unanimously (4-0) Agenda Item No. 7.F: Zoning Map Amendment - Sharon K Jones - 900, 904, and 908 Award Street - PINs 0656935334, 0656935213, and 0656935177 - REZ-2018-15 Purpose – To consider a requested zoning map amendment for a total of 1.023 acres, located at 900, 904, and 908 Award Street, from the General Commercial (GC) Zoning District to the Residential High Density (RHD) Zoning District. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the subject property with respect to proposed zoning map amendment to include information pertaining to the proposed zoning of the property, surrounding land use, the town’s land use plan, public utility availability, transportation impacts and considerations, the required neighborhood meeting, and staff recommendation. Town Manager Mitchell further explained that the property owner desires to construct a carport but is unable to do so without a rezoning of the property to the residential zoning district proposed. Public Hearing – The public hearing was opened. Ms. Sharon K. Jones, 908 Award Street, spoke in favor of the proposed zoning map amendment on behalf of her mother, Ms. Jean G. Jones. No one chose to speak in opposition to the proposed zoning map amendment (REZ-2018-15). The public hearing was closed. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Approve REZ-2018-15, a zoning map amendment located at 900, 904, and 908 Award Street, from the General Commercial (GC) Zoning District to the Residential High Density (RHD) Zoning District. The proposed amendment is consistent with the Land Use Plan and reasonable and in the best interest of the public for the reasons identified by management and staff. MOTION: Mayor Pro-Tem Massengill SECOND: Commissioner Harris MOTION RESULTS: Passed Unanimously (4-0) Agenda Item No. 7.G: Voluntary Annexation Petition - Arnold Heirs Property - (Landing At Arnold Park) - 202 and 206 Wagstaff Road - PIN 0656714997 and 0656728150 - ANX-2018-17 Purpose – To consider an annexation ordinance extending the corporate limits of the Town of Fuquay-Varina following the receipt of a petition for voluntary annexation of property owned by Kay Delle Arnold, Rose Marie Rollins, and Arnold Heirs, containing a total of approximately 14.186 acres. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the subject property with respect to the proposed annexation to include that the property is contiguous to the town corporate limits and has water and sewer available to serve the property. Public Hearing – The public hearing was opened. Mr. Tom Spaulding of Spaulding & Norris, PA, 972 Trinity Road, Raleigh NC, spoke in favor of voluntary annexation petition (ANX-2018-17), on behalf of the property owners. No one chose to speak in opposition to the proposed annexation petition. The public hearing was closed. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Adopt the annexation ordinance to extend the corporate limits of the Town of Fuquay-Varina to include property owned by Kay Delle Arnold, Rose Marie Rollins, and Arnold Heirs (ANX-2018-17) as presented and recommended. MOTION: Commissioner Gardner SECOND: Commissioner Harris MOTION RESULTS: Passed Unanimously (4-0) Ordinance No. N-18-46 Agenda Item No. 7.H: Voluntary Annexation Petition - Adcock Trust Agreement - 1339 Old Honeycutt Road - PIN 0676474253 - ANX-2018-15 Purpose – To consider an annexation ordinance extending the corporate limits of the Town of Fuquay-Varina following receipt of a petition for voluntary annexation of property owned by Adcock Trust Agreement - Ball and Minor CPA, containing 36.229 acres. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the subject property with respect to the proposed annexation to include that the property is contiguous to the town corporate limits and has water and sewer available to serve the property. Public Hearing – The public hearing was opened. Mr. Derric Grimes, representing Meritage Homes, 3005 Carrington Mill Blvd, Morrisville, spoke in favor of the proposed annexation petition on behalf of the property owners. No one chose to speak in opposition to the proposed voluntary annexation petition (ANX-2018-15). The public hearing was closed. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Adopt the annexation ordinance to extend the corporate limits of the Town of Fuquay-Varina to include property owned by Adcock Trust Agreement - Ball and Minor CPA (ANX-2018-15) as presented and recommended. MOTION: Commissioner Wunsch SECOND: Mayor Pro-Tem Massengill MOTION RESULTS: Passed Unanimously (4-0) Ordinance No. N-18-47 Agenda Item No. 7.I: Town Code Amendment - Jim Minor - Maximum Vehicle Bay Unit Size - CTA-2018-05 Purpose – To consider a proposed text amendment to the Town Code of Ordinances, Part 9 Land Development Ordinance, Article F Use Regulations, Section 9-1255, to revise language pertaining to a storage facility's maximum bay/unit size for vehicle storage. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the proposed town code amendment. Specifically, he advised that the petitioner was requesting to amend the town code to allow a greater maximum allowable size for indoor storage bays for vehicles and a maximum percentage of overall vehicle storage compared to the main storage facility. Public Hearing – The public hearing was opened. Mr. Wayne Mauldin of Mauldin-Watkins Surveying, 1301 Broad Street, spoke in favor of the proposed town code amendment on behalf of the property owner. No one chose to speak in opposition to the propose town code amendment (CTA-2018-05). The public hearing was closed. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Approve CTA-2018-05, an amendment to the Town Code of Ordinance, Part 9 Land Development Ordinance, Article F Use Regulations, Section 9-1255, as presented and recommended by management and staff. The text amendment improves upon the Land Development Ordinance, and it is reasonable and in the best interest of the public for the reasons identified by management and staff. MOTION: Mayor Pro-Tem Massengill SECOND: Commissioner Wunsch MOTION RESULTS: Passed Unanimously (4-0) Ordinance No. PZ-18-06 Agenda Item No. 7.J: Town Code Amendment - Town of Fuquay-Varina - Land Development Ordinance (LDO) Clean-Up Amendment #5 - CTA-2018-06 Purpose – To consider a proposed text amendment to the Town Code of Ordinances, Part 9 Land Development Ordinance, Clean-Up Amendment #5 that addresses several areas for improvement. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the proposed town code amendment. Specifically, he advised that Clean Up Amendment #5 addresses maximum allowable density for the Town Center Residential Zoning District, makes changes in language to Fees and Charges description, makes changes to the section that lists which thoroughfares are exempt from standard roadway improvements, and addresses number order for the TCR District Dimensions and Standards. Public Hearing – The public hearing was opened. Other than the Town, no one spoke in favor of the proposed text amendment. No one, also, spoke in opposition to the proposed text amendment (CTA-2018-06). The public hearing was closed. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Approve CTA-2018-06, an amendment to the Town Code of Ordinance, Part 9 Land Development Ordinance as presented and recommended by management and staff. The text amendment is consistent with the spirit of the Land Development Ordinance, as it clarifies and makes technical corrections to the language included in the ordinance and improves upon the Town’s regulations. Furthermore, the amendment is reasonable and in the best interest of the public for the reasons identified by management and staff. MOTION: Mayor Pro-Tem Massengill SECOND: Commissioner Gardner MOTION RESULTS: Passed Unanimously (4-0) Ordinance No. PZ-18-07 Agenda Item No. 7.K: Zoning Map Amendment - Gala Construction - 500 W Academy Street - PIN 0656772831 - REZ-2018- 08 Purpose – To continue and hold the public hearing and consider a requested zoning map amendment for a total of 0.41 acres, located at 500 W Academy Street, from the Corridor Commercial (CC) Zoning District to the Town Center Residential (TCR) Zoning District. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the subject property with respect to proposed zoning map amendment to include information pertaining to the proposed zoning of the property, the proposed plot plan in lieu of the required master plan, proposed plot plan conditions, surrounding land use, the town’s land use plan, public utility availability, transportation impacts and considerations, the required neighborhood meeting, and staff recommendation. Discussion – Mayor Pro-Tem Massengill stated that he anticipated more restrictive guidelines for these homes because of their location being at the gateway of the Town. He stated that he expected that the siding would be hardy plank instead of vinyl siding, and he recommended that the front entry doors include partial glass and transoms as an added condition. Public Hearing – The public hearing was continued from a previous meeting. Mr. Jason Galarneau of Gala Construction, LLC, spoke in favor of the proposed zoning map amendment and he stated that he is willing to upgrade the front entry doors, and that all three homes will be constructed with rear loading 2- car garages. He further stated that he did not wish to agree to no vinyl siding for the portions of the new homes that he does not already plan to brick or stone. Mr. Galarneau stated that it would be difficult for him to make his price point goal for each of the homes if he is unable to use vinyl siding. He also pointed out that many other homes in the general vicinity also had vinyl siding. Recommendation – Approve REZ-2018-08 and accompanying plot plan, a zoning map amendment at 500 W Academy Street, from the Corridor Commercial (CC) Zoning District to the Town Center Residential (TCR) Zoning District, with an added condition to install front doors to include partial glass and transom. The proposed amendment is consistent with the Land Use Plan and reasonable and in the best interest of the public for the reasons identified by management and staff. Agenda Item No. 8.A: Utility Allocation - The Landing at Arnold Park - 202 and 206 Wagstaff Road Purpose – To consider a utility allocation request for 27,600 gpd sewer and 33,120 gpd water for The Landing at Arnold Park development. Recommendation – Approve the recommended utility allocation request for The Landing at Arnold Park as presented and recommended, subject to approval of The Landing at Arnold Park Phase 1 and 2, and The Landing at Arnold Park Phase 3 Preliminary Plats. Agenda Item No. 8B: Resolution - Amended NC Governor's Highway Safety Program Traffic Safety Grant Year Two - Police Department Purpose – To consider adoption of an amended Resolution of a NC Governor's Highway Safety Program Traffic Safety Grant (Year Two), which provides partial funding for personnel costs for a Traffic Safety/Police Officer within the Fuquay-Varina Police Department. Recommendation – Adopt an Amended Resolution between the NCGHSP and the Town of Fuquay-Varina as recommended and authorize the Mayor and Town Clerk to execute the required documentation and certifications. Resolution No. 18-1564 Agenda Item No. 8C: 2019 Town Board Meeting Schedule Purpose – To consider setting the Town Board's regular meeting schedule for the calendar year 2019. Recommendation – Adopt the 2019 Town Board Regular Meeting Schedule as presented and recommended. Agenda Item No. 8D: Approve a Temporary Street Closure for the Fire Department Open House scheduled for October 13, 2018 as presented and recommended. Purpose – To consider a temporary street closure for the Fire Department Open House scheduled for Saturday October 13, 2018. Recommendation – Approve a temporary street closure request by the Fuquay- Varina Fire Department for the Fire Department Open House scheduled for Saturday October 13, 2018 as presented and recommended. Agenda Item No. 8E: Temporary Street Closure (Reschedule) - BBQ, Blues and Brews Festival - Fuquay-Varina Downtown Association - November 17, 2018 Purpose – To consider a temporary street closure for the 2018 BBQ, Blues and Brews festival scheduled for Saturday November 17, 2018. Recommendation – Approve a temporary street closure request by the Fuquay- Varina Downtown Association, Inc. for the BBQ, Blues and Brews festival scheduled for Saturday November 17, 2018 as presented and recommended. A motion was made to approve all items (A-E) on the Consent Agenda as recommended. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided details on the preliminary subdivision plat for Adam Vineyards to include the previously approved conditions on the property, information about the proposed subdivision, transportation improvements, utility extensions, and that the preliminary subdivision plat for this project also includes the submittal of a site specific development plan required in order to provide vesting of a previously submitted development plan to Wake County. Board Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Approve the Adams Vineyards preliminary subdivision plat, SUB-PR-2018-11, located at 3315 John Adams Road as presented and recommended, including the site specific development plan. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided details on the preliminary subdivision plat for The Landing at Arnold Park Phases 1 and 2 to include previously approved conditions on the property, information about the proposed subdivision, transportation improvements, utility extensions, and staff recommendation. He further advised that Phases 1 and 2 consist of townhome development. Board Discussion – There was no discussion by members of the Town Board regarding this matter. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided details on the preliminary subdivision plat for The Landing at Arnold Park, Phase 3 to include previously approved conditions on the property, information about the proposed subdivision, transportation improvements, utility extensions, and staff recommendation. He further advised that Phase 3 consists of single family home development. Board Discussion – There was no discussion from members of the Town Board regarding this matter. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided details on the preliminary subdivision plat for Purfoy South, Phases 13-22 to include previously approved conditions on the property, information about the proposed subdivision, transportation improvements, utility extensions, and staff recommendation. Commissioner Adcock was absent due to illness. Commissioner Harris stated that he enjoyed the “Out of the Darkness”- Suicide Prevention Walk this past Sunday. He also thanked Town Manager Mitchell for providing information updates during the Hurricane Florence storm event. Commissioner Wunsch stated that he also enjoyed the Suicide Prevention Walk and didn’t realize the event had been going on for 6 years. He also thanked the Town for the quick clean-up from the Hurricane Florence. Commissioner Gardner stated that she also enjoyed the Suicide Prevention Walk this past Sunday. Becky Medlin Realty had sponsored a team and they had over 20 walkers. She also appreciates the Town’s support in this event. Mayor Byrne shared information about past and future meetings and events he has or will be attending.
