MOTION: Mayor Pro-Tem Massengill SECOND: Commissioner Gardner MOTION RESULT: Passed Unanimously (5-0) ****************************** PRESENTATIONS Agenda Item No. 4.A: Recognition - SWAC State Tournament Champions - Fall 2018 8U, 10U and 14U Soccer All Stars The purpose of this agenda item was to recognize the Town of Fuquay-Varina 8U, 10U and 14U Parks and Recreation Soccer All Star teams for winning the State-Wide Athletic Committee (SWAC) State Champion Tournament. Agenda Item No. 4.B: Recognition - Inspections Department - HBA of Raleigh-Wake County Local Government Staff of the Year Mayor Pro-Tem Blake Massengill (President of the Home Builders Association of Raleigh-Wake County) presented an award from the HBA of Raleigh-Wake County to the Fuquay-Varina Inspections Department for the 2018 Local Government Staff of the Year. Building Inspections Director Chris Hinnant commended his staff for their dedication to excellent customer service. Members of the Inspections Department staff were in attendance as follows: David Ivey, Louanne Moore, Sheila Austin, Judi Neff, Forrest Vankeuren, Robert Clinebelle, Robbie Church, Tim Johnson, Gary Kennedy, Michael Alexander, Kevin Michie and Thomas Keating. The Town Board congratulated members of the Inspections staff and Building Inspections Director Chris Hinnant for bringing this honor to the Town of Fuquay-Varina. Added Comments: Golden Leaf Foundation Grant - $338,400 At this time, Mayor Byrne then recognized NC Representative John Adcock who assisted the Town with pursuing grant funds through the Golden Leaf Foundation whereby the Town was recently awarded $338,400. Town Manager Mitchell stated these funds will be used for stream bank restoration at the Fuquay Mineral Spring Park, and he thanked Representative Adcock as well as Engineering Director Tracy Stephenson for their work to obtain funding for the project. Mayor Byrne and NC Representative Adcock also thanked NC Senator Tamera Barringer (in her absence) for her work in pursuing the grant funds. ****************************** ADDED AGENDA ITEM Closed Session – Pursuant to N.C.G.S. 143.318.11(a)(3) Attorney-Client Privilege At 7:36 pm, Mayor Byrne asked the Town Board to consider conducting a closed session meeting to discuss an attorney-client privilege matter. MOTION: Mayor Pro-Tem Massengill SECOND: Commissioner Wunsch MOTION RESULTS: Passed Unanimously (5-0) After a unanimous vote for a motion to go into closed session, the Town Board exited the Town Board room to hold their closed session meeting in the Town Hall conference room. Report from Closed Session Meeting Members of the Town Board returned to the Town Hall Board room to report out findings from the closed session meeting and to reconvene the regular meeting. Following the return to open session, a motion was made and duly seconded to accept the letter of resignation from Charlie Adcock as Commissioner, effective immediately. MOTION: Mayor Pro-Tem Massengill SECOND: Commissioner Wunsch MOTION RESULTS: Passed Unanimously (4-0) Mayor Byrne and members of the Town Board thanked former Commissioner Charlie Adcock for his combined 17 years of distinguished service to the Town, having served on both the Planning Board and the Town Board. ****************************** PUBLIC COMMENTS: Christopher Raughley of Pulte Homes – stated that he was here tonight to announce that the next Dell Webb Homes community will be constructed in Fuquay-Varina. Carolina Gardens (a Dell Webb community) will open for sale in Fuquay-Varina in the summer of 2020. He then gave a short video presentation and stated that Carolina Gardens will be a $100 million investment in Fuquay-Varina. Mayor Byrne reflected on childhood memories of the owner of Del Webb Homes (Mr. Delbert Eugene Webb) who was also principal owner of the New York Yankees, and he thanked Chris Raughley, Bob Anderson, Randy King, Teresa Lawson, Jamie Davis, Glen Futrell, John Adcock and Jim Chandler for bringing this senior living community to Fuquay-Varina. Jessica Chmielewski, 2623 Brighton Bluff Drive, Monica Nawojczyk ,5700 Creekfall Lane, and Greg Horner 2647 Bloomsberry Ridge asked for the Town Board’s continued support for the South Wake Park Project. They urged the Mayor to attend the January 7, 2019 Wake County Board of Commissioners meeting to speak in favor of the park on behalf of the Town. Mayor Byrne stated that the Town Board has not changed its position and still supports the idea of a regional park in the area that was once occupied by the Crooked Creek Golf Course.  ****************************** ITEMS TABLED FROM PREVIOUS MEETING: There were no items tabled from previous meeting for the December 18, 2018 Town Board meeting. ****************************** PUBLIC HEARINGS: Agenda Item No. 7.A: Voluntary Annexation Petition - Brighton Ridge - 9933 Lake Wheeler Road, 0 Hilltop Needmore Road, 0 Hilltop Needmore Road and portions of 3924 Hilltop Needmore Road and 10005 Lake Wheeler Road - PINs 0688153391, 0688241532, 0688142560 and portions of 0688124995 and 0688037793 - ANX-2018-20 Purpose –To consider an annexation ordinance extending the corporate limits of the Town of Fuquay-Varina following receipt of a petition for voluntary annexation of property owned by Joseph W. Wrenn, Kelly D. Wrenn, Suzanne G. Wrenn, David L. Wrenn, William L. Wrenn, III and Pleasant Grove Baptist Church, located at 9933 Lake Wheeler Road, 0 Hilltop Needmore Road, 0 Hilltop Needmore Road and portions of 3924 Hilltop Needmore Road and 10005 Lake Wheeler Road, containing a total of 106.75 acres. Staff Comments – Town Manager Mitchell entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided general information about the voluntary annexation petition to include that the property is contiguous to the corporate limits and water and sewer is available to serve the property. Public Hearing – The public hearing was opened. John Adcock spoke in favor of the proposed annexation on behalf of the property owners. No one chose to speak in opposition to the proposed voluntary annexation petition. The public hearing was closed. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Adopt the annexation ordinance to extend the corporate limits of the Town of Fuquay-Varina to include property owned by Joseph W. Wrenn, Kelly D. Wrenn, Suzanne G. Wrenn, David L. Wrenn, William L. Wrenn, III and Pleasant Grove Baptist Church (ANX-2018-20) as presented and recommended. Ordinance No. N-18-70 MOTION: Mayor Pro-Tem Massengill SECOND: Commissioner Wunsch MOTION RESULTS: Passed Unanimously (4-0) ****************************** CONSENT AGENDA Town Manager Mitchell entered the agenda abstracts and supporting documents for Consent Agenda Items 8A-8C into the official record of the Town. Agenda Item No. 8.A: Project Ordinance Amendment - Timber Sale Proceeds - Fuquay-Varina Business Park - $58,287.00 Purpose –The purpose of this agenda item is to consider approval of a Project Ordinance Amendment that reallocates funds in the amount of $58,287.00 towards the Fuquay-Varina Business Park Project. Recommendation – Approve a Project Ordinance Amendment for the Fuquay- Varina Business Park Project as presented and recommended. Ordinance No. N-18-71 Mayor Pro-Tem Massengill asked if these funds covered the cost to clearing the stumps that were left behind after the timber was removed. Town Manager Mitchell stated that the proceeds were only from the sale of the timber and the stump removal was not included in that price; therefore, a portion of these proceeds will be used to clear the stumps at the Business Park. Agenda Item No. 8B: Budget Amendment - Police Department - Walmart Grant - Police Explorers - BA-2019-09 - $3,000.00 Purpose – To consider a budget amendment that recognizes funds from a grant awarded by Walmart for the Police Department's Police Explorer's Post. The grant proceeds will be used for Police Explorer activities such as the Winterfest Competition that will be held in Gatlinburg, Tennessee in February 2019. Recommendation – Approve Budget Amendment BA-2019-09 as presented and recommended. Agenda Item No. 8C: Budget Amendment - Recognize Funds - Insurance Proceeds - Parks & Recreation - $3,259 - BA-2019- 10 Purpose – To consider recognizing funds from insurance proceeds due to damage sustained by a town vehicle accident. Insurance proceeds will be used to cover the cost to repair a Parks and Recreation vehicle that was damaged by a collision with a deer that caused significant damage. Recommendation – Approve Budget Amendment BA-2019-10 as presented and recommended. A motion was made to approve all items (A-C) on the Consent Agenda as recommended. MOTION: Mayor Pro-Tem Massengill SECOND: Commissioner Harris MOTION RESULT: Passed Unanimously (4-0) ****************************** ADMINISTRATIVE REPORTS There were no Administrative Reports agenda items for the December 18, 2018 Town Board meeting. ****************************** OTHER BUSINESS A. Manager’s Report • Reported that the Town has received a grant from the Golden Leaf Foundation for stream restoration at the Fuquay Mineral Spring Park in the amount of $338,400. • Reported that the Police Department hosted Shop with a Cop today at Walmart and it was a great success. • Reported that the Public Works department has had two new recent hires • Reported that the Parks and Recreation Director, Jonathan Cox, has completed the Local Government Credit Union Fellowship Program • Reported that the recent winter storm event posed no challenges.  • Reported that transportation bonds have been sold. • Reported that Samantha, Laura, Mark and he attended a good meeting with the Southern Wake Academy to discuss transportation issues and will have another meeting the first of the year. • Reported that the Administration Office was on the Women’s Club Home Tour and was well attended. Executive Assistant Teresa Wilder did a great job hosting the event at the Administrative Office. B. Alternate Appointment to CAMPO Executive Board – (Byrne/Mitchell) Mayor Byrne and Town Manager Mitchell advised that the alternate member to the CAMPO Executive Board is vacant. Mayor Byrne asked that if any Town Board member would like to serve as the alternate member to please let him know. C. Zoning Map Amendment - The Curry Engineering Group, PLLC - 7700, 7712, 7720 Barefoot Road - PINs 0646411919, 0646411614, and 0646411239 - REZ-2018-23 - (FIRST READING) ****************************** TOWN BOARD MEMBER COMMENTS Mayor Pro-Tem Massengill stated that he received a nice picture/Christmas card from Ms. Joanie Bowden, and he wished everyone a very Merry Christmas. Commissioner Harris wished everyone a Merry Christmas. Commissioner Wunsch stated that he enjoyed the spectacular home tour in downtown, and his home was on display. He also announced that on February 5, 2019 he and his wife will become owners of a business in Fuquay-Varina (The Healthy Spot). He then gave accolades to former Commissioner Charlie Adcock for coming to his rescue when he and his family were stranded in Florida after a bad car accident. He thanked former Commissioner Adcock for being such a great role model and for being compassionate during his time of need. Commissioner Gardner congratulated Commissioner Wunsch on his plans to purchase a business in Fuquay-Varina. She also stated that there were 13 homes (9 of which were in the historic district) that participated in the home tour in downtown and several members of the Town Board had their homes on display for the tour. She added that this holiday season’s beauty has been unparalleled. Mayor Byrne reported that the Fuquay-Varina Women’s Club sold over 200 tickets for the home tour. He reported that he attended the Wake County Mayor’s Association Christmas dinner in Wake Forest and had a wonderful time. He also stated that the Town of Angier has a new Town Manager.
