CALL TO ORDER Mayor Massengill called the meeting to order at 7:00 pm. INVOCATION AND PLEDGE Mayor Pro-Tem Larry Smith provided the invocation and Commissioner Marilyn Gardner led the Pledge of Allegiance. VIRTUAL MEETING PROTOCOL Town Manager Adam Mitchell reviewed the meeting protocol noting that the meeting was both in- person and live streamed on the Town’s YouTube Channel and Facebook. APPROVAL OF MINUTES 3A The October 18, 2022, minutes of the Town Board of Commissioners regularly scheduled meeting. MOTION: Mayor Pro-Tem Smith SECOND: Commissioner Harris MOTION RESULTS: Passed Unanimously (5-0) PRESENTATIONS 4A Recognition - Detective Brett Kain - Certified Financial Crimes Investigator Purpose – To recognize Detective Brett Kain for recently completing the Certified Financial Crimes Investigator course (CFCI) through the International Association of Financial Crimes Investigators (IAFCI) program. Staff Comments – Police Chief Brandon Medina entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided information about the agenda item by making the following remarks. Detective Brett Kain is being recognized for recently completing the Certified Financial Crimes Investigator course (CFCI) through the International Association of Financial Crimes Investigator (IAFCI) program. In a fast-paced world of fraud, financial, and cybercrimes investigations, the Fuquay-Varina Police Department will continue to ensure investigators receive up-to-date information, attend new training, and collaborate with other organizations to investigate and resolve complex criminal investigations. Obtaining a certification as a Certified Financial Crimes Investigator (CFCI) will guarantee a thorough investigation pertaining to the areas of financial crimes, cybercrimes and/or digital forensics. Chief Medina presented the framed certificate to Detective Kain. Mayor Massengill and the Town Board expressed their gratitude and congratulated Detective Kain for his accomplishment. 4B Hilltop Needmore Town Park and Preserve Master Plan (CLH Design) Assistant Town Manager Matthews led with the following remarks. The Town of Fuquay-Varina Parks, Recreation and Cultural Resources Department, in partnership with CLH Design, prioritized community input as the main driver for data in the development of the Hilltop Needmore Town Park and Preserve Master Plan. The community was able to participate in the public input process at a series of in-person meetings as well as through “Let’s Talk FV”. Four in-person public input sessions were held where attendees were able to pose questions, get a better understanding of the park planning process, and state their visions for what amenities they desired to be included in park enhancements. CLH Design led the public input meetings Thursday, May 12, at the FM2FV Concert; Saturday, May 21, from 10 am-2 pm at Fleming Loop Recreation Park during youth sports activities; Wednesday, May 25, from 6 pm- 8 pm at the Fuquay-Varina Community Center during youth sports activities; and Monday, June 13, 4 pm – 6:30 pm at Hilltop Needmore Town Park and Preserve. In addition, the Town released a survey through Let’s Talk FV. The survey provided an opportunity for members of the community that were unable or chose not to attend public input meetings with a chance to have their opinions heard. Also, the survey collected relevant demographic and residency data. The survey was promoted through the Town website, newsletter, social media, constant contact email lists, and strategically placed posters in high traffic areas. The survey was active for 30 days and received 818 responses. At this time, funding has not been identified for any specific phase of the projector the entire Master Plan (a place holder was included for initial master plan investment in the Five Year Plan), but will be further evaluated and prioritized during the Comprehensive Systemwide Parks, Recreation and Cultural Resources Master Plan and budget development scheduled to be conducted in early 2023. It is important to note that this is a long-range master plan, and given the scope of the master plan, scale of the park, and that the Town does not have an unlimited budget, it is likely that this master plan will be completed in phases over the next 20 years as internal and external sources of funding are identified. At the close of the Let’s Talk FV feedback window, CLH Design, management and the Town of Fuquay-Varina Parks, Recreation and Cultural Resources Department, along with the Parks and Recreation Advisory Board will review the responses and recommend a final recommended HNTPP Master Plan to be presented to the Town Board of Commissioners for consideration and adoption. Matt Pierce, Landscape Architect with CLH Design presented a detailed overview of the existing conditions and current structures of the park. He stated that the major concerns from the community input meetings were protection of water quality, preservation of site natural areas, lighting and noise. The values commonly heard were nature preservation, health and wellness, a sense of community and connectivity. The priorities were paved trail improvements (redesign/rerouting existing paths) hiking trails, playground, pickleball, disc golf, exercise stations, dog park, wildlife observation and preservation, picnic areas and obstacle or challenge course. Holly Waterman, Landscape Designer with CLH Design presented a detailed overview of the concept plan with proposed details that placed the above-mentioned priorities in specific areas throughout the park. Mayor Massengill commended CLH Design for adding the new vegetation and trees areas around the ponds and he thanked them for taking the feedback from the citizens and incorporating them into the plan. The CLH Design and the Town will receive feedback until November 11th and the Town Board will consider approval of the Master Plan at their December 5th meeting. Commissioner Harris asked about the priorities expressed by the citizens and he asked if there was one top priority that will be considered first. Matt Pierce stated that the top priority was the improvements to the continuous trail around the property. He also stated that the existing walking paths will be widened to the Town’s greenway standard paths which is a 10 foot wide asphalt trail. Commissioner Gardner stated that she is glad that the Town is going to preserve the beauty of this site and there will be a lot of people that will be happy about the pickle ball courts. Mayor Pro-Tem Smith stated that he was excited about the pollinator or open meadow area and the boardwalk trail. He asked about the reforesting plan between the multi-purpose fields and the homes. Matt Pierce stated that there will be a 700-foot buffer consisting of hardwoods and pines for long-term vegetation to reduce maintenance with a thicker wooded edge.  Commissioner Cook asked about the number of parking spaces in the two parking lots near the residential areas. Matt Pierce stated that the actual parking spaces have not been determined, but there will be approximately 20-25 spaces in the parking lot south of the elementary school and approximately 40-50 spaces in the parking lot near the ballfields. He stated that they will work with public safety to determine the level of lighting needed for the parking lots. Commissioner Haynes asked if the educational piers at the ponds will also be used for fishing. Assistant Town Manager Matthews stated that fishing on the piers would not be conducive to regulations provided by the NC Wildlife Commission, that would be programmed in future plans. Commissioner Haynes recommends that in the future the Town incorporate infrastructure that would allow those who are wheelchair bound to have access to fishing. Mayor Massengill agreed. PUBLIC COMMENTS 5A Thelma L. Mann, 1329 Bass Lake Road, Holly Springs, Susan Oliver, 721 Valleywater Street, Fuquay-Varina, Martha Smith, 501 Raleigh Street, Fuquay-Varina, Lucille Vuncannon, 101 Parker Drive, Fuquay-Varina, Virginia Johnson, 7120 Deer Brook Street, Willow Spring, and Susan Hutchinson, 5716 Maggie Run Lane, Fuquay-Varina, spoke in opposition to the proposed Social Districts that were presented by staff at the November 7, 2022 Town Board meeting. They voiced their concerns about exactly where the Social Districts would be allowed, the possible participating of serving those who are under age, degrading the Town’s image, a need to develop an innovative plan to enhance foot traffic in the downtown areas that does not focus on the sale of alcohol, and lack of community input on Social Districts from the citizens. Marcus Bartow, 4701 Linaria Lane, Fuquay-Varina, Ashley Manstedt, 5608 Brushy Meadows Drive, Fuquay-Varina, Shirley Rodgers, 5440 Greensflag Lane, Fuquay-Varina, Mark Bertrand, 5421 Greensflag Lane, Fuquay-Varina, Mark Cohen, 4720 Linaria Lane, Fuquay-Varina, Michael Biddle, 5821 Brushy Meadows Drive, Fuquay-Varina, and Suzanne Iocca, 4701 Shady Greens Drive, Fuquay-Varina spoke in opposition to the proposed Hilltop Needmore Park and Preserve Master Plan that was presented earlier at the meeting. They expressed concerns regarding not enough distance between the ball fields and the adjacent homes, the proper maintenance of trees for reforesting, concerns about lighting and noise from the baseball fields, the elimination  of the two proposed parking lots, removal of the baseball fields from the plan, dangerous curve at the entrances of the park and traffic congestion on Hilltop Needmore Road, parking on the streets inside the residential areas, the provision of an environmental impact statement, and illegal fishing that currently takes place at the ponds. Mayor Massengill addressed some of the concerns that were expressed during public comments. He stated that there are many ways to provide feedback to the Town Board, which can be accomplished by direct contact with Town Board members, and comments can be made through an online platform, Let’s Talk FV. He reminded everyone that the proposed master plan for the park is a concept and a vision. He then stated that in regard to the Social Districts proposal, private citizens and business owners voiced their approval of the proposed plan at the November 7, 2022, Town Board meeting. He urged citizens to continue to have dialogue with members of the Town Board regarding these matters. ITEMS PREVIOUSLY TABLED 6A There were no items previously tabled for the November 7, 2022, Town Board meeting. PUBLIC HEARINGS 7A Town Code Amendment - Town of Fuquay-Varina - Land Development Ordinance (LDO) Amendment #21 - CTA-2022-07 Purpose – To consider a proposed text amendment to the Town Code of Ordinances, Part 9 Land Development Ordinance that addresses several areas for improvement. Staff Comments – Planning Director Davison entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. She then provided information about the agenda item by making the following remarks. Town staff and the community have gained significant experience using the Land Development Ordinance (LDO) since its adoption in December 2016 and a better understanding of its intent and proper function. As a result, this amendment seeks to harness that experience in the form of  clarifications and technical corrections to the LDO's language. Planning Director Pam Davison reviewed in detail the proposed changes. Management and staff recommend approval of the proposed town code amendment. It is reasonable and, in the public’s, best interest, as it improves upon the Land Development Ordinance's intent to modernize, provide sustainability, and allows for ease of use and enforcement, specifically concerning the Town's current standards. At the October 17, 2022, regular meeting, the Planning Board unanimously voted to recommend approval. Public Hearing – The public hearing was opened. No one chose to speak in favor of, or in opposition to the Town Code Amendment. The public hearing was closed. Discussion – Mayor Massengill asked if there were significant changes to the Land Development Ordinance. Planning Director Davison stated that there were no significant changes, but the proposed changes aimed to simplify the ordinance and to make corrections where needed. Recommendation – Approve CTA-2022-07 Amendment #21, an amendment to the Town Code of Ordinances, Part 9 Land Development Ordinance, as presented and recommended by Town staff. The text amendment improves upon the Land Development Ordinance and is reasonable and in the best interest of the public for the reasons identified by management and staff. MOTION: Commissioner Gardner SECOND: Commissioner Cook MOTION RESULTS: Passed Unanimously (5-0) Ordinance No. PZ-22-04 7B Voluntary Annexation Petition - New Providence Baptist Church - 4813 & 4807 Hilltop Needmore Road - PINs 0678545736 & 0678549709 - ANX-2022-10 Purpose – To consider an annexation ordinance extending the corporate limits of the Town of Fuquay-Varina following receipt of a petition for voluntary annexation of property owned by New Providence Baptist Church, located at 4813 & 4807 Hilltop Needmore Road, PINs 0687545736 and 0687549709, containing approximately 19.733 acres, and to approve the Declaration of Annexation Agreement signed by the property owner. Staff Comments – Planning Director Pam Davison entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. She then provided information about the agenda item by making the following remarks. The property is non-contiguous to the Town's corporate limits, containing 19.733 acres. Town water is available, but sewer is not available to the property. A fire flow test was conducted, resulting in an adequate fire flow of 1,280 gallons per minute. The subject property will not be served with Town garbage and recycling services as it is a religious institution. The petitioner has signed an annexation agreement as it relates to the provision of Town services. At the October 18, 2022, meeting, the Town Board instructed the Town Clerk to investigate the sufficiency of the applicant's petition for voluntary annexation. The Town Clerk certified at that time that the petition was sufficient and meets the requirements prescribed by the North Carolina General Statutes. The Town Board also adopted a resolution setting the public hearing for the November 7, 2022, Town Board meeting. The present total value of the property is $1,982,093. Public Hearing – The public hearing was opened. Wayne Mauldin of Mauldin-Watkins Surveying, 139 N. Main Street, spoke in favor of the annexation petition on behalf of the petitioner. No one chose to speak in opposition to the proposed voluntary annexation petition (ANX-2022-10). The public hearing was closed. Discussion – Commissioner Haynes stated that the church has been working on this annexation for over a year now and he is happy to see it come to fruition given that there has been significant church growth and having to use a well that is insufficient. Recommendation – Adopt the annexation ordinance to extend the corporate limits of the Town of Fuquay-Varina to include property owned by New Providence Baptist Church (ANX-2022-10) and to approve the Declaration of Annexation Agreement as presented and recommended.  MOTION: Commissioner Haynes SECOND: Mayor Pro-Tem Smith MOTION RESULTS: Passed Unanimously (5-0) Ordinance No. N-22-31 7C Voluntary Annexation Petition - 6910 & 0 Kennebec Road - PINs 0687028436 & 0687120232 - ANX-2022-11 Purpose – To consider an annexation ordinance extending the corporate limits of the Town of Fuquay-Varina following receipt of a petition for voluntary annexation of property owned by Christine Cutter, located at 6910 & 0 Kennebec Road, Willow Spring, PINs 0687120232 and 0687028436, containing approximately 4.127 acres, and to approve the Declaration of Annexation Agreement. Staff Comments – Planning Director Pam Davison entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. She then provided information about the agenda item by making the following remarks. The property is non-contiguous to the Town's corporate limits, containing 4.127 acres. Town water is available, but sewer is not available to the property. A fire flow test was conducted, resulting in an adequate fire flow of 1,358 gallons per minute. The subject property will be served with Town garbage and recycling services. The petitioner has signed an annexation agreement as it relates to the provision of Town services. At the October 18, 2022, meeting, the Town Board instructed the Town Clerk to investigate the sufficiency of the applicant's petition for voluntary annexation. Special Event and Amplified Sound Permit Request - Willow Spring High School Cross Country Team - WSHS Turkey Trot - November 24, 2022 Purpose – To consider a special event permit and amplified sound permit request for the Willow Springs High School Cross Country Team's Turkey Trot 5K event scheduled for Thursday, November 24, 2022. Recommendation – Approve a special event and amplified sound permit request for the Willow Springs High School Cross Country Team's Turkey Trot 5K event scheduled for Thursday, November 24, 2022, as presented and recommended. 8B. Budget Amendment - Computer Upgrades and Bank Fees - BA-23-22 Purpose – To consider a budget amendment appropriating restricted revenues for eligible costs in the Inspections and Finance Departments in the amount of $318,833.  Recommendation – Approve budget amendment BA-23-22 as presented and recommended. 8C Budget Amendment - Recognize Insurance Proceeds - Police Department - Vehicle Repairs to Police Investigative Unit #225 ($2,333) and Police Patrol Unit # 150 ($2,317) - BA-23-23 - $4,650 Purpose – To consider a budget amendment that recognizes insurance proceeds/restitution for additional repairs to the Fuquay-Varina Police Department Police Investigative Unit #225 ($2,333) and Police Patrol Unit # 150 ($2,317) - BA-23-23 - $4,650. Recommendation – Approve Budget Amendment BA-23-23 as presented and recommended. 8D Budget Amendment - Recognize Proceeds - Fuquay-Varina Economic Development Commission - BA-23-24 - $2,000 Purpose – To consider a budget amendment in the amount of $2,000 that recognizes event sponsorship funds from the Fuquay-Varina Economic Development Commission to the Town's Economic Development Department for hosting the Fuquay-Varina Small Business Connect event on October 27, 2022. Recommendation – Approve Budget Amendment BA-23-24 as presented and recommended. 8E Resolution and Agreement - North Carolina Water and Wastewater Agency Response Network Purpose – To consider approving a resolution to join the North Carolina Water/Wastewater Agency Response (WARN) network as a public utility member and approve an agreement for the Mutual Aid and Assistance Agreement for Water and Wastewater Utilities. Recommendation – Approve a resolution to join the North Carolina Water and Wastewater Agency Response Network and authorize the Town Manager to enter into the Mutual Aid and Assistance Agreement for Water and Wastewater Utilities designating the Town Manager as the  Primary Representative, Assistant Town Manager as the First Alternative Representative, and Public Utilities Director as the Second Alternative Representative. Resolution No. 22-1782 A motion was made to approve all Consent Agenda items 8A-8E as presented and recommended. ADMINISTRATIVE REPORTS 10A Fee In-Lieu - Wake Med Medical Office Building - FV Parkway Purpose – To consider approval of a Fee in Lieu for the Fuquay-Varina Parkway roadway improvements related to the WakeMed Medical Office Building project in the amount of $655,200. Staff Comments – Planning Director Davison entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. She then provided information about the agenda item by making the following remarks. The WakeMed Medical Office Building project is located at 2400 N Main Street (US 401). The site development requires paying a fee-in-lieu for intended thoroughfare improvements for the future Fuquay-Varina Parkway construction. The proposed improvements include widening US 401 between Meadow Drive and Dwight Rowland Road and partially constructing the Fuquay- Varina Parkway. In addition, the fee-in-lieu will pay for future improvements for the remainder of the Fuquay-Varina Parkway section adjacent to the development site. These improvements will include the installation of the roadway pavement and all associated grading, curb and gutter, median improvements, widening of the adjacent sidewalk to a 10-foot side path, storm drainage improvements, and street lighting. The fee-in-lieu will also cover all associated environmental and regulatory permitting costs. The Town requires these improvements in accordance with the Land Development Ordinance (LDO). Section 9-1466 of the LDO allows for a fee-in-lieu for improvements that cannot be feasibly completed at the time of development. Management and staff consider the proposed improvements, which will be completed sufficient for the interim function of the affected public facilities and appropriate considering the limitations. The developer will complete the proposed improvements and agrees to pay the fee-in-lieu of $655,200. The design of the fee-in-lieu improvements and the corresponding cost estimate was completed in compliance with the LDO by the developer's Engineer and included the required 25% contingency for fee-in-lieu payments. This cost estimate has been certified by the developer's Engineer and reviewed by the Town Engineering Director to ensure completeness and appropriate costs. A copy of the referenced cost estimate is attached. Based upon the provided details and certifications by the Town's Engineering Department, Management and staff recommend accepting the project's fee-in-lieu for $655,200. A Fee-In-Lieu in the amount of $655,200 represents the Engineer's cost estimate for roadway improvements associated with the WakeMed Medical Office Building project. This estimate includes a 25% contingency, which is consistent with the Town's Fee-in-Lieu Roadway policy. The $655,200 fee-in-lieu will be placed into the Town’s Northeast Roadway Fee-In-Lieu District account. Discussion – Mayor Massengill asked about the projected opening date for the facility. Planning Director Davison stated that she is not sure when the WakeMed facility will open but they have already obtained approval for their site plan, and they are in the beginning phase of construction. Recommendation – Approve a total of $655,200 as a fee in lieu for the Fuquay-Varina Parkway roadway improvements associated with the WakeMed Medical Office Building project as presented and recommended.  MOTION: Commissioner Harris SECOND: Commissioner Cook MOTION RESULTS: Passed (5-0) OTHER BUSINESS 11A Manager’s Report Town Manager Adam Mitchell gave the following updates: Police Department – The Police Department has conducted its last conditional offer filling all vacancies. Additionally, the department has made significant strides during the NC League of Municipalities Risk Assessment Review, and more information will be presented at an upcoming meeting regarding this effort. Human Resources Department – All departments have completed their performance appraisals and PTRC is currently conducting an annual study analyzing compensation benefits against the market. This information will be a topic at the upcoming Town Board Retreat. Fire Department – The Fire Department will be conducting a training exercise of a simulated small engine plane crash on this Wednesday at Fleming Loop Park, from 8:00 am until noon. Additionally, there has been career ladder moves in the Fire Department with Bradley Hatcher moving from a Firefighter II to a Senior Firefighter and Jeremy Packard moved from a Firefighter I to a Firefighter II. IT Department – There were two new hires in the IT Department, Maxwell Bartorf, an IT Technician and Max Kirshling, GIS Technician. Finance Department – The Finance Department was recently awarded the distinguished Budget Presentation Award from the Government Finance Officers Association (GFOA). Public Works – William Burnette began employment with the Town today in the department responsible for debris collections.  Arts Center Department – The Arts Center recently hired Sophia Diez and Kerry Pastfield as part- time theatre technical crew members. The Sugar Skull Musical Adventure that was held on November 4th had a great audience and was a successful event. Also this past Friday, the Massengill Design Build Gallery held a reception for the Burritt Benson’s “Be The Light” exhibit that will be featured through December 31st. Auditions will run through December 5th for the Community Theatres production of Baskerville, A Sherlock Holms Mystery. Economic Development Department – The Economic Development Department successfully held the “Small Business Connect” on October 27th. Town Manager Mitchell reported that he personally participated in the NC League of Municipalities’ Legislative Policy Committee with a number of different managers and elected officials from around the state to help the League develop recommended policies to be discussed at the next NC Legislative session. He reported that he, along with Mayor Massengill recently met with the Town’s financial auditors to discuss the audit process. Main Street - Tuesday December 6, 2022 - 9:00 am - 10:30 am BOARD MEMBER COMMENTS Commissioner Gardner stated that she enjoyed the Trick or Treat event, and she participated as Mini- Mouse. Commissioner Harris stated that last Wednesday he had the opportunity to meet with the Fuquay-Varina Leadership Academy, along the Police Chief Medina, and he presented the findings from the NC League of Municipalities’ Task Force on Racial Equity and Local Elected Officials. He reported that next week, November 17 – 19, 2022, he along with Commissioner Haynes will attend the National Cities Summit in Kansas City, Missouri. Commissioner Haynes reported that the Southern Regional Center hosted a resources event at Lincoln Heights Elementary School that offered such resources as dental and health exams for children. He stated that the event was well attended and well received by the community. He stated that he will be participating in the upcoming BBQ Blues and Brews event along with Police Chief Medina. He stated that he attended the Small Business Expo that he felt was very successful and allowed people to gain information on what is needed to start a small business. He reported that the Pine Acres Community Center is collecting food donations and hoping to provide food for a Thanksgiving food give away on November 19th for at least 300 families. He also reported that the Fuquay-Varina High School will be having their first HBCU College and Career Expo on November 19th from 10:00 am to 2:00 pm. Commissioner Cook stated that she also attended the Small Business Expo, and as a small business owner, she learned things that she wished she would have known before starting her business. She also attended the Coffee With A Cop at Bojangles last week that was well attended. She then reported that there will be a shred event at the Chamber of Commerce, Saturday, November 12th. Documents will be shredded at no cost, but they are asking for non-perishable food items that will go to Pine Acres for their food give away event. Mayor Pro-Tem Smith stated that he, along with Police Chief Medina and former Commissioner Charlie Adcock, participated as judges for a BBQ event held at the American Legion Post #116. He also attended a ribbon cutting for Staples Grand Re-opening and he recently attended the Hometown Hero event at John Hiester Chevrolet. He then commended the Police Department for having a full staff as the competition for new police officers is strong. Mayor Massengill reported that the American Legion also recently had a Chili Cook-off and he, along with Police Chief Medina participated as judges. He also reported that he had the opportunity to talk to and have lunch with elementary students about government and elected officials. He then thanked the Town’s Debris Collections department for assisting him in making a video and allowing him to ride along and work with them on their routes. He reported that he met with residents of the Carolina Gardens community to share with them information about the Town. Finally, he reported that officials from the Republic of Moldova met as a sister government with Mayors and Managers from Fuquay-Varina, Holly Springs and Apex and representatives from the NC Secretary of State’s Office to talk about the successful growth in this region and how they can form strategies for growth in Moldova and opportunities to partner with their businesses.
