Mitchell, Town Manager Mark D. Matthews, Assistant Town Manager 134 N Main Street, Fuquay-Varina, NC. James (Jim) E. Seymour, Assistant Town Manager Rose H. Rich, Town Clerk James S. Adcock, III, Town Attorney In attendance were Mayor Blake Massengill, Mayor Pro-Tem Larry Smith, and Commissioners Marilyn Gardner, and Bryan Haynes. Also in attendance were Town Manager Adam Mitchell, Assistant Town Manager Jim Seymour, Assistant Town Manager Mark Matthews, Town Clerk Rose Rich, IT Director Scott Clark, and various other department directors. Commissioner William Harris and Town Attorney James Adcock were absent. CALL TO ORDER Mayor Massengill called the meeting to order at 7:02 pm. INVOCATION AND PLEDGE Mayor Pro-Tem Larry Smith provided the invocation and Fire Chief Jim Jones led the Pledge of Allegiance. VIRTUAL MEETING PROTOCOL Town Manager Mitchell reviewed the meeting protocol noting that the meeting was both in-person and live streamed on the Town’s YouTube Channel and Facebook. APPROVAL OF MINUTES 3A The September 19, 2023, Town Board of Commissioners Regular Scheduled meeting. MOTION: Mayor Pro-Tem Smith SECOND: Commissioner Haynes MOTION RESULTS: Passed Unanimously (3-0) PRESENTATIONS 4A More information about this agenda item was presented by Mayor Massengill. Mayor Massengill asked special guest, NC State House Representative Erin Paré to join him for a presentation. He stated that Representative Paré has done incredible things throughout her district and especially for Fuquay-Varina. Earlier today, Representative Paré presented a check in the amount of $856,000 to the Fuquay-Varina Fire Department to assist in purchasing a new fire truck. She also visited the Fuquay-Varina Police Department and presented them with a check in the amount of $315,000 for assistance in funding school resource officers. Mayor Massengill stated that Representative Paré was at the meeting to present a check to the Town in the amount of $28.6 million for the water conveyance line – water expansion project with Sanford. He stated that these are record funds coming from the NC General Assembly and he thanked Representative Paré for working hard on the Town’s behalf. Representative Paré stated that the reason why she ran for State Representative is because she wanted to see some of the taxpayer dollars returned for projects in southern Wake County and that the Town of Fuquay-Varina is well deserving of funding as it continues to grow. 4B Proclamation – Fire Prevention Day – Saturday, October 28, 2023 Mayor Massengill read the Fire Prevention Day Proclamation that highlights fire safety and fire prevention education. He proclaimed October 28th as Fire Prevention Day in Fuquay-Varina and called on the citizens of Fuquay-Varina to attend the Fuquay-Varina Fire Department’s Open House at Fire Station #1 from 10:00 a.m. until 2:00 p.m., on October 28th, to learn more about fire prevention and safety. 4C Presentation – Completion of NC Justice Academy Criminal Investigation Certificate Program – Sergeant Brett Kain Police Chief Brandon Medina stated that Sergeant Brett Kain is being recognized for recently completing the North Carolina Justice Academy Criminal Investigations Certificate Program. The program recognizes law enforcement personnel who have completed at least 400 hours of investigative training to better prepare themselves for the rigors and challenges of criminal investigations. Police Chief Medina commended Sergeant Kain for his relentless determination leading to his successful completion of the North Carolina Justice Academy Criminal Investigations Certificate Program and he presented Sergeant Kain with the plaque certificate. Mayor Massengill and members of the Town Board also commended Sergeant Kain for his accomplishments. PUBLIC COMMENTS 5 No one chose to speak during public comments. Ø Mayor Massengill recognized former NC House Representative John Adcock, former Commissioner Charlie Adcock and former Commissioner Jason Wunch who attended the meeting. ITEMS PREVIOUSLY TABLED 6A There were no items previously tabled for the October 17, 2023, Town Board meeting. PUBLIC HEARINGS 7A Voluntary Annexation Petition – Paul Tildon Vinci, Karen Vinci and Betty Jo Vinci – 6524 Burt Road – ANX-2023-02 Purpose – The purpose of this agenda item was to consider an annexation ordinance extending the corporate limits of the Town of Fuquay-Varina following receipt of a petition for voluntary annexation of property located at 6524 Burt Road owned by Paul Tildon Vinci, Karen Vinci, and Betty Jo Vinci, PIN 0646087028, containing approximately 65.738 acres and to approve the related Declaration Annexation Agreement. Staff Comments – Planning Director Davison entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. She then provided general information about the agenda item and made the following remarks. The property is non-contiguous to the Town’s corporate limits, containing 65.738 acres. Town water is available, but sewer is not available to the property. The subject property will be served with Town sanitation and recycling services. At the September 19, 2023, meeting, the Town Board instructed the Town Clerk to investigate the sufficiency of the applicant’s petition for voluntary annexation. The Town Clerk certified at that time that the petition was sufficient and met the requirements prescribed by the North Carolina General Statutes. The Town Board also adopted a resolution setting a public hearing for the October 17, 2023, Town Board meeting. The present total value of the property is $1,151,115.00. Public Hearing – The public hearing was opened. Brendie Vega representing WithersRavenel spoke in favor of the proposed annexation on behalf of the property owners. No one chose to speak in opposition to the proposed annexation for ANX-2023-02. The public hearing was closed. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Adopt the annexation ordinance to extend the corporate limits of the Town of Fuquay-Varina to include property owned by Paul Tildon Vinci, Karen Vinci, and Betty Jo Vinci (ANX-2023-02) and to approve the Declaration of Annexation Agreement as presented and recommended. MOTION: Mayor Pro-Tem Smith SECOND: Commissioner Gardner MOTION RESULTS: Passed Unanimously (3-0) Ordinance No. N-23-32 7B Zoning Map Amendment – Jeremy Medlin, Greenhawk – 6524 Burt Road – REZ-2023-02 Purpose – To consider a requested zoning map amendment for a total of 65.738 acres, located at 6524 Burt Road, from the Wake County R-30 Zoning District to the Residential Agricultural Conditional Zoning District (RA-CZD). Staff Comments – Planning Director Davison entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. She then provided general information about the agenda item and made the following remarks. The subject property totals 65.738 acres and is in the Town's Urban Service Area (USA) and is the subject of ANX-2023-02. The property is generally cleared for agricultural uses or wooded with a utility easement that runs east to west across the middle of the property. The property is currently zoned R-30 Zoning District (Wake County). The zoning map amendment petition requests approval of the Residential Agricultural Conditional Zoning District (RA-CZD). This zoning district is intended to permit proposed and existing large zoning lot single-family detached dwellings in established neighborhoods and to provide for lower density, rural residential zoning lot (stick-built or modular unit) development and agricultural farming operations, forestry management, farmsteads, public or private parks, and greenways. The petitioner has requested that only the following uses be permitted at the subject property: 1) Single Family Residential 2) Open/Civic Space 3) Public Utility Buildings/Use Additionally, the petitioner has requested the following site-specific conditions be made applicable to the subject property: 1) Development shall be limited to a maximum density of one dwelling unit per acre. 2) Vinyl siding shall not be permitted: however, vinyl windows and other decorative elements and trim are permitted. 3) No unit shall be constructed with an exterior elevation or color palette that is identical to the unit on either side or directly across the street. 4) Any side or rear building façade facing a public right of way shall have a covered or enclosed deck. 5) All homes shall include architectural shingles or decorative metal roof in a color that compliments the development’s approved palette. 6) All garage doors shall be raised panel with a minimum of one-quarter window area and carriage door hardware. 7) All homes shall include a covered porch with decorative posts, to include a minimum of 24’’ massing at the base constructed of masonry material. Masonry will be present around the full perimeter of the home; however, the minimum measurement is applicable to the front elevation where grade changes occur from front to back. 8) All residence front doors shall have a minimum of 25% glazing with sidelights or transoms. If there is no space for sidelights or transoms, door shall have a minimum of 75% glazing. 9) All rooflines shall be designed so that no one roofline is a single mass element. Roofs shall also be broken up and punctuated with reverse gables and shed roofs. 10) Façade treatment, a minimum of three included per dwelling unit: a) Changes in exterior materials of the front façade such as brick, masonry, board, and batten, horizontal, or shake siding (min of 20% of the front façade). b) Addition of front dormers, shed roofs or gables. c) Addition of decorative trim, shake, cornice, horizontal trim, brackets, or air vents/windows on gables. d) Addition of shutters, window trim, or window grids. e) Addition of a trellis or shed roof over garage door. 11) A minimum amount of 10% of the site will remain as natural open space. 12) There shall be no mass grading. Surrounding properties are primarily wooded or agricultural in nature apart from some single family residential. More specifically, The Duncan Ridge subdivision, located in the Town of Holly Springs' USA Jurisdiction is to the north and the McLaurin Farms subdivision (currently under construction) is to the south of the subject property. The 2040 Community Vision Land Use Plan (LUP) calls for the Rural Residential (RR) classification at the subject property. Land designated as Rural Residential is characterized by large lots and a high degree of separation between buildings. The following LUP policies support the proposed rezoning: 1) Policy 7.2: Encourage Transitional Uses and Intensities in and Around Project Boundaries. The zoning petition change to RA-CZD supports the growth of similar uses in the surrounding area. The requested zoning district is consistent with the 2040 LUP classification and the proposed conceptual plan and provided conditions meets the goals on the Rural Residential (RR) classification. Public water and sewer are currently not available to serve the subject property, however water is currently being extended to the property by McLaurin Farms subdivision. A Town booster pump station is intended to be constructed in the northwest corner of the property to support the Sanford Water Project. At the September 18, 2023, regular meeting, the Planning Board voted unanimously to recommend approval. There were no additional comments or questions. Public Hearing – The public hearing was opened. No one chose to speak in favor of, or in opposition to, the proposed zoning map amendment for REZ-2023-02. The public hearing was closed. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Management and staff recommend approval of the proposed zoning map amendment as it is reasonable and in the best interest of the public for the following reasons: 1) The requested zoning map amendment is consistent with the 2040 Community Vision Land Use Plan for the designation of Rural Residential (RR). 2) The requested zoning district supports the Land Use Plan Policy 7.2: Encourage Transitional Uses and Intensities in and Around Project Boundaries. The zoning petition change to RA-CZD supports the growth of similar uses in the surrounding area. 3) The conceptual plan included with the request demonstrates compliance with many of the zoning conditions offered and rural residential development's goals as described in the 2040 Land Use Plan. Recommendation – To approve the special event application and amplified sound permit request for the Guardian Angel Candlelight Vigil scheduled for November 15, 2023, as presented and recommended. 8B. Special Event Application, Amplified Sound Permit, and Temporary Road Closure – Curated Craft Market on Depot Street – November 4, 2023 Purpose – To consider approval of the Special Event Application, Amplified Sound Permit, and Temporary Road Closure Request for the Curated Craft Market on Depot Street for the event scheduled for November 4, 2023. Special Event Application, Amplified Sound Permit, and Temporary Street Closure Request - BBQ Blues & Brews - Saturday, Nov 11, 2023 - 12:00 pm to 4:00 pm - 405 East Broad Street Purpose – To consider the Special Event Application, Amplified Sound Permit, and Temporary Street Closure Request for the BBQ Blues & Brews Festival scheduled for Saturday, Nov 11, 2023. Recommendation – Approve a Special Event Application, Amplified Sound Permit, and Temporary Street Closure Request for the BBQ Blues & Brews Festival scheduled for Saturday, Nov 11, 2023, as presented and recommended. 8D. Special Event Application and Amplified Sound Permit Request - Outdoor Movie at Mason Jar Lager Co. Purpose – To consider approval of a Special Event Application and Amplified Sound Permit for the Outdoor Movie event at the Mason Jar Lager Co. scheduled for October 28, 2023. Recommendation – Approve the Special Event Application and Amplified Sound Permit for the Outdoor Movie event at the Mason Jar Lager Co scheduled for October 28, 2023, as presented and recommended. 8E. Special Event Application, Amplified Sound Permit, and Temporary Street Closure Request – Fuquay-Varina Chamber of Commerce - 2023 Christmas Parade – December 3, 2023 Purpose – To consider a special event application, amplified sound permit, and temporary street closures for the Fuquay-Varina Chamber of Commerce Christmas Parade scheduled for Sunday, December 3, 2023. Recommendation – To approve a special event application, amplified sound permit, and temporary street closures for the Fuquay-Varina Chamber of Commerce Christmas Parade scheduled for Sunday, December 3, 2023.as presented and recommended. 8F. Special Event Application and Amplified Sound Permit Request - Oaklyn Springs Brewery - Trunk or Treat at OSB - 10-27-2023 Purpose – To consider approval of a special event application and amplified sound permit for Oaklyn Springs Brewery's Trunk or Treat at OSB event, scheduled for October 27, 2023. Recommendation – Approve a special event application and amplified sound permit for Oaklyn Springs Brewery's Trunk or Treat at OSB event, scheduled for October 27, 2023. 8G. Budget Amendment - Culver's - Youth Athletic Scholarship Fund Donation - Parks, Recreation and Cultural Resources - $600.00 - BA-24-14 Purpose – To consider approval of budget amendment BA-24-14 recognizing funds in the amount of $600 from Culver’s for non-resident scholarships within the Parks, Recreation and Cultural Resources Department. Recommendation – Approve budget amendment BA-24-14 as presented and recommended. 8H. Budget Amendment - Transfer of Asset Forfeiture Funds - $4,800 - BA-24-13 Purpose – To consider budget amendment BA-24-13 to appropriate seizure funds in the amount of $4,800 for the purpose of the 1st installment accreditation fee for Commission on Accreditation for Law Enforcement Agencies (CALEA). Recommendation – Approve BA-24-13 as presented and recommended. 8I. Budget Amendment - Transfer of Funds from Various Police GL Accounts to the Vehicle and Repair GL Account - $77,530- BA-24-15 Purpose – To consider a budget amendment to transfer funds in the amount of $77,530 to fund increased costs associated with vehicle maintenance and repairs. Recommendation – Approve BA-24-15 regarding transfer of funds in the amount of $77,530 as presented and recommended. 8J. 2024 Town Board Meeting Schedule Purpose – To consider setting the Town Board's regular meeting schedule for the 2024 calendar year. Recommendation – Adopt the 2024 Town Board Regular Meeting Schedule as presented and recommended. 8K. Town Code Amendment - Part 8 - Offenses - Chapter 6 - Planting and Protection of Trees - Tree City USA Purpose – To consider adopting a Town Code Amendment, Part 8, Offenses, Chapter 6, Planting & Protection of Trees. Recommendation – Approve a Town Code Amendment adopting Part 8 Offenses, Chapter 6, Planting & Protection of Trees, as presented and recommended. Ordinance No. M-23-06 8L. Recreation Unit Fee-In-Lieu - Vinci Subdivision - SUB-PR-2023-03 Purpose – To consider approval of a Recreation Unit Fee-In-Lieu for the Vinci Subdivision – SUB- PR-2023-03. Recommendation – Approve the Recreation Unit Fee-In-Lieu request for Vinci subdivision in the amount of $40,279.44 as presented and recommended. 8M. Utility Agreement Allocation Request - Vinci Property - 46 Lots Purpose – To consider a Utility Agreement Allocation Request for the Vinci Subdivision Property. Recommendation – Approve the recommended Utility Agreement Allocation Request for the Vinci Subdivision 46 lots, as presented and recommended. 8N. Façade Grant Funding Request - Joyce and Family Restaurant - 129 N. Main Street Purpose – To consider approval of a façade grant funding request and application submitted by Joyce and Family Restaurant located at 129 N. Main Street, in an amount up to $1,141.15. ADMINISTRATIVE REPORTS 10A Preliminary Subdivision Plat – Vinci Subdivision - SUB-PR-2023-03 Purpose – The purpose of this agenda item is to consider a preliminary subdivision plat submitted by WithersRavenel for the Vinci Subdivision located at 6524 Burt Road. Staff Comments Planning Director Pam Davison entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. She provided information about the agenda item by making the following remarks. Contingent on the approval of REZ-2023-02 & ANX-2023-02, the submitted preliminary plat, Vinci Subdivision is located at 6524 Burt Road on 63.76 acres in the Residential Agricultural Conditional Zoning District (RA-CZD). The following conditions are site-specific standards for the subject property: 1) Development shall be limited to a maximum density of one dwelling unit per acre. 2) Vinyl siding shall not be permitted. The minimum lot size permitted is 20,000 square feet. The minimum lot size provided is 29,556 square feet, with an average lot size of 40,468 square feet. Zoning conditions require ten percent (or 6.38 acres) of open space. 16.25 acres of open space is provided for this subdivision. Vehicular access to the project area will be provided by extensions of Meadow Walk Drive and Dublin Creek Drive through the McLaurin Farm subdivision, whose infrastructure is currently under construction. In addition, Tiger Paw Lane will be stubbed at the northern property line for a future road connection. Since Meadow Walk Drive and Dublin Creek Drive (50-foot right-of- way, 2-lane streets, with sidewalks on one side) are local residential collector streets still under construction, traffic counts are unavailable. The McLaurin Farm subdivision is currently extending public water to serve the property. The proposed preliminary subdivision plat meets all Town requirements, and management and staff recommend approval. At the September 18, 2023, regular meeting, the Planning Board voted unanimously to recommend approval. Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Approve the Vinci Preliminary Subdivision plat SUB-PR-2023-03, as presented and recommended. MOTION: Commissioner Haynes SECOND: Commissioner Gardner MOTION RESULTS: Passed Unanimously (3-0) OTHER BUSINESS 11A Manager’s Report Town Manager Adam Mitchell gave the following updates: o Public Utilities Department – New hires – Jason Faircloth, Pump Maintenance Mechanic and Randy Zepeda and Nicholas Munch, Utility Maintenance Mechanics. Other new hires were Chase Matthys, Wastewater Treatment Plant Operator Apprentice and Dwight Parrish, a Pump Maintenance Mechanic. o Planning Department – The Community Transportation Plan (CTP) update is now available at “Let’s Talk F-V” portal for public input. The Town will host a public workshop regarding the CTP on Thursday, October 26, 2023, at 5:30 pm – at Town Hall. o Engineering Department – The US 401 Corridor Study and the future US 401 Bypass is continuing to advance. On Monday, October 23, 2023, from 5:00 pm to 7:00 pm, at Town Hall, there will be a drop-in style public meeting to provide the public an opportunity to learn about the study’s progress and give feedback on the proposed recommendations. o Public Works Department – Loose Leaf season has begun. James Jordan, Jerry Burch, and Angel Velasques attended the APWA Streets and Fleets Conference last week to learn about how they can further enhance service to the community as it relates to Public Works. o IT Department - The IT Department completed the storage server infrastructure upgrades. GIS is working to integrate data for Capital Predictor which is almost complete. Capital Predictor is a program that will be used by the Town to predict, plan and budget for capital improvements in the coming years. Mobile device management solutions have been implemented to better secure networks to iPhones and iPads. Upgrades for Downtown Fuquay cameras have been implemented to improve connectivity and increase WIFI speed. o Arts Center – Katie Crush is a new hire as a Rental and Special Events Coordinator for the Arts Center. The new inclusive Theater Program will have its first performance on Wednesday, at 7:00 pm. The Arts Center will host the Fuquay-Varina Chamber of Commerce Candidate Forum on October 24, 2023. o Human Resources Department – HR Director Wendy Moody and Karin Wanner recently participated in the Career Fair at Shaw University. They will participate at a job fair tomorrow at Meridith College and at Campbell University on October 25, 2023. The department continues to work on the Neo Gov onboarding project, and they had a successful vaccination clinic. There has been good utilization of the new Paid Parental Leave and Elder Care benefits that the Town Board recently adopted. HR Director Moody recently attended that HR Director’s Conference which was fruitful to her professional development. The Town staff is in the process of completing performance appraisals for all Town employees. o Police Department – The Police Department hosted the second free Mental Awareness event this past Saturday at the Wake County Southern Regional Center. Town Manager Mitchell recognized Police Officer Brian Williscroft for coordinating such a great event. 11B Project Status Report – October 2023 11C Quarterly Report – 1st Quarter FY 2024 11.D Town of Fuquay-Varina – 2023 Christmas Ornament Presentation – Communications Director Susan Weis presented the 3rd Annual Town Christmas Ornament depicting a 1945 Mack Fire Truck in celebration of the anticipated opening of Fire Station #4. The ornament can be purchased for $15 through the Online Store on the Town’s website. Commissioner Harris was absent. Commissioner Haynes thanked the volunteers for their support in coming out to Pine Acres Community Center to give away food, and the Center will be collecting non-perishable food items in preparation for the Thanksgiving holiday food drive to give food to at least 300 families. He reported that he attended the Wake County School’s Community Round Table along with Mayor Massengill. He also stated that he recently attended his 20-year High School Class Reunion. He reported that there will be a Southern Regional Resource event on October 26, 2023, from 5:00 pm to 7:00 pm at Lincoln Heights Elementary School. He also reported that he recently attended the 163rd Homecoming service at New Providence Baptist Church. Mayor Pro-Tem Smith reported that he along with Commissioner Gardner attended ribbon cutting ceremonies for Edward Jones and Sarah Nicole Virtual Services, a home-based business. He thanked staff for quickly getting involved with citizens to address everyday issues and resolve them promptly. Mayor Massengill reported that he recently attended a Hindu community festival here in Town and received a warm welcome. He reported that he received good feedback from the recent Celebrate Fuquay-Varina Festival that was well attended, and he thanked Town staff for working the event. He then reported that the BBQ Blues and Brews event will be held on November 11, 2023, and the American Legion Post #116 will have a BBQ contest this coming Saturday.
