CALL TO ORDER - Invocation, Pledge of Allegiance, Roll Call Gahanna City Council met in Regular Meeting on Tuesday, September 4, 2012, at Gahanna City Hall, in Council Chambers, 200 South Hamilton Road. President of Council Brian D. Larick called the meeting to order at 7:00 p.m. Invocation was given by Vice President of Council Renner followed by the Pledge of Allegiance led by Council Member Jolley. Agenda for this meeting was published on August 31, 2012. Present 5 - Stephen A. Renner, Karen J. Angelou, Beryl Anderson, Ryan P. Jolley, and Brandon Wright Absent 1 - David L. Samuel B. ADDITIONS OR CORRECTIONS TO THE AGENDA. C. HEARING OF VISITORS: Mayor Stinchcomb presented proclamations to Peace Lutheran Church, Pastor Kai Nilsen, and Stonybrook Methodist Church, Pastor Mike Bowie, for their work after the storm on June 29, 2012, and declared September 4, 2012 Stonybrook Methodist Church Day and Peace Lutheran Church Day; both pastors thanked the City for the proclamations; Pastor Bowie said it is the mission of their church to serve and show God's love and help those in need and assured if there is another disaster they will stand to help; Pastor Nilsen said he would reiterate everything that Pastor Bowie said and that there were a lot of people behind the scenes working also that didn't get recognized; like to thank Pat Rocca, Parish Administrator, who coordinated everything as I was on vacation; we love Gahanna and are here to serve the community. Anderson said thank you from members of Council; in a time of fear and uncertainty when people don't know what is going on they were able to hear by word of mouth, texting or other ways that the doors of both Stonybrook and Peace Lutheran were open; having all of what is available for what people need is wonderful; surely you don't do it for the piece of paper in your hands, you do it as a service to the community and love of God; partnering in community service; we are all here for the same effort; for the greater good; and for those of us who are faith based to serve God. Angelou said I would like to say thank you to both churches, and being a member of Peace Lutheran it is always with pride that I look at what our community does and what other religious communities in Gahanna do for this area and outside this area; it is part of our mission at Peace Lutheran; it is always a thrill to know that our congregation and the congregations of Gahanna are ready when needed. Thank City of Gahanna Page 1 City Council Meeting Minutes September 4, 2012 you. Anderson said, and I said what I said, as a member of Stonybrook Methodist Church. John Thomas, 391 Carpenter Rd., said I have been taking readings through Gahanna and on the west side; talked to Carpenter, Shull and Rugby residents; have come to a recommendation that would satisfy people in those areas; 60 decibels from 7:00 a.m. to 10:00 p.m., and 55 after 10:00 p.m. till 7:00 a.m.; have taken readings for the last 2 weeks at different times; I can live with 60 decibels in the A weighting; the only change is the number of decibels; spoke with Ewald and he doesn't have a problem with this, and neither do the residents I spoke with; asking Council to consider changing the decibels for the residents on Carpenter, Shull and Rugby Lane. Doug Vance, 344 Sycamore St., owner of Gatsby's; said I didn't understand how big the problem was; thought we had a good relationship with the neighbors; know a lot of the neighbors; if there is a problem call me on the phone; I gave my business cards to the neighbors, and obviously that is not working; I want to get along with my neighbors; am here for the long haul; thing I disagree with is I don't know if 60 decibels is going to be the right number; I don't know what the number is but whatever you decide I will live with; realize that when John Thomas was talking he was talking at 63 decibels in this room according to my phone; there should be a warning if we are over; if there is a set number I should be able to handle that and manage that myself; but for that rare occasion when someone screams out or there is a big party and we are over that for a two minute period I don't know that I should get a citation in the mail; if an officer comes to my door or calls me, or if Mr. Thomas calls, it should be taken care of right then; if it is not at that point write me a ticket; we should be able to take care of this like adults. Rick Stover, 93 Helmbright Dr., owner of Rick's Coaches; said I understand the feelings of those offended by music coming from certain establishments; living in a city comes with inherent noise issues such as traffic, airports, parks, ball diamonds, school playgrounds and your favorite watering hole for live music; I live right behind St. Matthews; every morning about 6:30 a.m. I have jets that wake me up; at about 8:00 a.m. the church bells start ringing; that typically would wake me up and then you have recess; sure you know how much noise 50 to 100 kids can make on a playground; my point is the city does have inherent noises that come with living in a city; I never complain about all those noises I deal with; as for the noise from bars and restaurants that entertainment brings customers to our doors; part of what we do to make our living; part of what we do to allow other people to make a living by working for us, and a lot of those people work and live in Gahanna and therefore are paying taxes in the City of Gahanna and helping this community to grow and become a sound community; I think it is really important that we look at having a stable and viable community: to do that we all need to grow together; am not against having ordinances for sound; I think at this point you have made a wonderful decision on your decibel amounts; I purchased a decibel reader and we take that before any musician plays and we have been in compliance ever since; I also took decibel readings of a Friday night football game and kids playing behind my condo and all of those were over the reading limits. Kathy Sweeney, 940 Hartney Dr., said I am here representing over 15 homeowners on Hartney and Ridenour; we met last week with a couple members of City Council and at their recommendation I am here to speak; for years we have been calling the City individually asking for help; while our own requests may have been addressed at the time we have many problems that still exist; our concerns focus on four homes in our neighborhood which include child safety issues; we have small children running the streets at all hours of the day; we have all almost seen a child get hit by a car or City of Gahanna Page 2 City Council Meeting Minutes September 4, 2012 be one of those drivers who almost hit a child; they bolt in and out of the street at all hours of the day; have a 3 or 4 year old who runs the neighborhood whose only supervision is an 8 year old sister; we have health and public safety issues; sidewalks are regularly blocked and impassable; one of the homes that is next to mine is a ticking time bomb; the garage is full from top to bottom and side to side with gas cans, tools, chemicals, boxes and combustible items; if there is a fire and the house explodes it will take other homes, and mine will be included; there are mice, squirrels and birds that come in and out of the home from all the damage that is on the outside of the home; property is also overgrown with very large trees that have fallen and resulted in other properties being damaged; also have 2 homes that have suspicious activity believed to be drug related and the police have been to those houses regularly; have general property issues; one home owner recently put graffiti on all 4 sides of his house with crosses and peace signs painted in large letters on their siding; two homes have large trailers on their property and when they want to use the trailers they just dump everything in the yard and pick it up in a couple of weeks; we have one car that sits on a property filled with junk and the car doesn't run and has been there for weeks; have multiple issues of property damage with a BB gun including homes and cars; one renter said her son received a BB gun and there was a target hanging on the fence where he had been practicing; also have animal welfare issues; one neighbor has dogs that they let run free and they nip at small children; dogs were abandoned during the time when there was no electricity and some did not survive; some of these people are renters and others are long time homeowners that have showed no willingness to take care of their property; when approached they have resorted to intimidation tactics, verbal abuse and nuisance behavior like ringing doorbells at all hours of the night; concerns from the meeting were shared with the City and Brian Reynolds did come to the neighborhood today and several warnings were issued to a couple of the homes; on the City's website it states that "the role of the Zoning division is to promote and protect the public health, safety and general welfare of the Gahanna community by enforcing the zoning regulations"; I'm here today to ask you to do just that. Jacki Mann, 221 Carpenter Rd., referenced the email she sent to Council last week; said no one is asking that any bars be shut down in this community; we are asking for some kind of consideration for the residents of the community; we are not asking that people not go out to the local bars and have a good time; think comparing a playground to a bar blaring its music at 1:00 a.m. in the morning is not a fair comparison when someone is trying to sleep in the middle of the night; just asking for consideration of the residents that live in the area. Tom Lefchik, 187 Rugby Lane, said I would like to read a letter from a resident, Kathleen Johnson, 480 Three Oaks Ct., who lives behind FM Lounge; she is in her 80s; says she was kept up until 2:30 a.m. in the morning by music from FM; it is right behind her condo; (letter available in the Council office); said it has been better since the newspaper articles about noise levels and she hopes that will be permanent. Lefchik said I would like to add a few of my own comments, just briefly; Coaches was a bank before it became a bar and the citizens that live around there were generally accustomed to a bank; it's time that we do take some action; it has been 5 years that I have been calling police and no action was taken by them; l do understand the levels are down but there are still some issues and we need to find a way to positively protect the residents that are affected by the bars. CORRESPONDENCE AND ACTIONS: Clerk Council Anderson confirmed the 9/11 walk is to gather at 8:30 a.m. and begin at 8:46 a.m.; and it is a 5K; that is what they told me this morning. Euton said yes. Wright asked if you have to register for the walk; Euton said if you register you will receive a t-shirt, but you can just show up and walk; any funds raised will go to the 9/11 memorial.org fund. Bd. of Education, Gahanna-Jefferson Public Schools - Anderson: Anderson said the school board meets the second Thursday of the month and will be at 6:30 p.m. at Clark Hall. Convention & Visitors Bureau (CVB) - Jolley Jolley said the next meeting is next Thursday the 13th, here in committee rooms at 4:00 p.m. Central Ohio Transit Authority - Samuel: No report. M. OFFICIAL REPORTS: Mayor Mayor said we had a busy weekend; had an incident with our Police Department (PD); want to comment that we talk a lot about our partnership with the schools and I think this weekend we proved that it is more than lip service; had excellent City of Gahanna Page 8 City Council Meeting Minutes September 4, 2012 communication with the superintendent and the PD and our Public InformationOfficers of the schools and City; took all precautions necessary to protect students; if any one is wondering what I am talking about it is the student who posted inappropriate YouTube videos and also sent inappropriate tweets; it was covered on most of the news; there has been some comments about whether this was overkill and did we limit freedom of speech; like to quote someone on my staff who said "I'd rather be wrong 99% of the time than right 1% and have any of the students in our high school in danger; I believe we always try to err on the side of safety; thank the schools and the PD for handling this and know that the courts will also handle this appropriately. City Attorney Ewald said first I would like to thank the PD for their action over the weekend; having children in the school system it is not a very comforting feeling getting a call or email that something of this nature is going on; again would like to thank the PD on a personal level; second I had a conversation with Mr. Thomas coming in the door and I just want to clarify; he denoted two levels that we had discussed; I have not agreed to those levels particularly; I said in comparison to other communities ours is about 5 decibels higher, and I said this in a prior committee; so 65 would probably be a better level; again that is a decision for Council; wanted to make sure I clarified that; it was not at the 55 or 60 level, it was at 65; know Council is in the process of getting information back to me so I can collect it; that deadline is tomorrow; please get it to me, and I will get data out to you. N. COUNCIL COMMENT Angelou said I want to thank all of the people who have come forward on the noise issues; tonight is the first night that I saw businesses present which is a plus; Mr. Vance said to call him and he will do something about it; that is a positive; without working together there is no solution to this; might just be a simple communication; perhaps the businesses should know the music is too loud, and perhaps the police should be there all the time; I think seeing two businesses here tonight means something is going to move in the right direction; think we need to be talking to each other to see if we can be good neighbors to each other; also the meeting with the Hartney & Ridenour residents which Brandon and I attended; what is the right direction to go to begin to solve some of these issues; issues are eating away at the fabric of the subdivision; there has to be a plan and again it may just be talking to the right people; it was interesting that many of the people who came to that meeting all said the same thing; they are genuinely concerned, not only for themselves and their property, but for the other people in the area; know that the Administration will work long and hard to get these things under control; some of the things I heard which would be to where do you start is any time children are at risk that has to be the number one priority, and I think there are children at risk from the things I heard; I actually represented Ward 2 for 7 terms,14 years and I was very surprised by the things I was hearing and the panic and fear; hope the City can help through these various issues; my favorite thing was a pony in a back yard for a month; hope that we do have language in the code and the Board of Health has language in the code that you cannot have a pony in the back yard in the City; want to thank Mrs. Sweeney for coming and putting the concerns together; I would also like to thank the PD for the wonderful job they did with the issue with the high school student; also agree we should be on the side of being too careful; thank you to PD and our PIO. Wright said I did meet with Karen and the residents on Hartney and Ridenour and was a little floored too about the fact that a pony was in a back yard for a month; we have to get that area cleaned up; they were truly concerned with the area that they City of Gahanna Page 9 City Council Meeting Minutes September 4, 2012 live in as well as the surrounding areas; also the writing on the house on Stygler is an eye sore for Gahanna; do not really have an ordinance to address that if someone does that on their own property; this is something we need to look at; have received a lot of calls on that; bad for community; know zoning is working as hard as they can but only one person doing this and the City is growing and getting larger issues going on; also want to comment on the noise ordinance; glad we do have businesses coming in to be part of the conversation; for some of the residents, they feel that things are not moving as fast as they should be; much of what I have learned being on Council is a measured approach, when going about making public policy you have to have all of the actors in place before you can go forward moving on policy that works; sometimes it is not going to work for everybody, have to be a compromise; thank Vance and Stover for coming out tonight; with the situation from the high school the more we are diligent with matters of this nature the better off we will be; also have a concern with children in the street coming from Clark Hall; was trying to make a right hand turn and kids were actually in the street because there were so many of them there on the corner; is not safe; so close to the edge of the street and some of them were in the street; need to take a look at that. Anderson said I want to underscore importance of being proactive with anything that we do as a community; is important to be collaborative; with regard to the noise ordinance this is a process; I too am glad to see the businesses as well as the residents come out; is important to flush things out; when we talk about noises that are inherent to the community there is a sliding scale or a continuum when you talk about continuous vibrations; continuous base beat; throbbing of walls and people's bodies because of noise and because of music, whatever that thing is that causes people to feel uncomfortable; that is totally different, at least in my mind, from a bell ringing, which is a limited amount of time, or school children playing at recess, and also in the day as opposed to the night and not ending at 1:00 or 2:00 a.m. in the morning; important we put everything on the table, but to compare apples to apples and look at the distinguishing factors among those things when we are talking about noise; also talking about music in particular; thank you for coming out. Renner said with the noise ordinance, we said a long time ago that it is a long process; I want everybody, especially the speakers to be very mindful that when they are attacking this problem, in helping us to go through this resolution, be evidence based; don't send us emails with accusations that have no evidence; we received an email that attacked the honor of our PD; I was actually quite shocked by that; bring me the evidence or I don't want to hear from you; on another subject, we had a major water main break on Friday right by my house; was an 8" line; great kudos to the City of Gahanna crews; they came out and were determined, they were very professional; wanted to thank Franey and her team for addressing this; because my house is near the corner it became a gathering place again; when people wanted to know the latest on the situation they came to my house; the break happened about 7:30 p.m.; it was a very tricky repair in a tight spot and went into the wee hours of the morning, 2:00 to 3:00 a.m. Saturday; I'm sending emails to Franey and she was responding back giving me the latest Intel that I could pass on; want to point out one individual, Andy Flautt was first on the scene to scope and size the problem, then came later Saturday morning to get water samples; very professional, very impressed with his knowledge; this is the stuff behind the scenes that our tax dollars are promoting; while the process can be frustrating and we lost water for a few hours; we even lost our new street sign at the corner because the ground got so soft and soupy that it fell down; but this morning crews were out there very early and put it back up. Jolley said he would like to echo Renner's sentiments about interacting with City Council; we greatly appreciate everyone who comes here and provides commentary; please do so in a respectful manner and in a way that is constructive as opposed to destructive; the folks not only on the dais, but throughout the Administration put in a City of Gahanna Page 10 City Council Meeting Minutes September 4, 2012 lot of time and effort to deal with what are complex situations; there is no one size fits all solution across communities, across neighborhoods within the same city; I said it before and I will say it many more times, I do not believe my job is to make everyone happy; in fact if I don't upset every single person in the City at some point over the four years that I sit up here I am probably not doing my job; not everyone is going to be happy with every situation; it takes compromise and balance and I want to thank our City Attorney for the tremendous amount of work he has put into the noise ordinance issue, and also to my colleagues, and I think we are striving to get to that balance that works for as many people as possible; but at the end of the day there are probably going to be some people that are not happy; would also like to give a great commendation to our high school principal Dwight Carter because he is very in touch with the student body; that connection with the students enabled him to very quickly receive messages from many students and parents about this situation over the weekend and get it addressed very quickly; also extend congratulations to Chief Murphy and the PD for how swiftly and quietly they handled the situation; also I would like for us to take a look at the way we move legislation through the committee process and the way we deal with it up here at council meetings; I have some concerns with our committee structure and the amount of legislation and the distribution between the two committees we have and dealing with these waivers and emergencies; think we need to take a look at the process; like to put this back on the front burner. Jolley continued also congratulations to our colleague Stephen Renner who was lauded in the Columbus Dispatch a week or so ago for the deft handling of all of our missing water. Angelou said I would like to say that Mr. Renner has been instrumental in potentially getting a grant for the unincorporated area of Mifflin Township that is without water and has been since they built 270; probably going to happen and probably because of Renner; when people on our border are without water we can realize how important it is to have a community like Gahanna, and Mifflin Township trustees that care about an unincorporated area. Thank you. Larick said I have a note here about the 2012 Summer Lunch Club; they served 4,562 hot lunches; over 1,700 at Goshen Lane; over 1,100 at Royal Manor; 1,400 hundred at Lincoln/First Baptist; 182 at Walnut Creek in the last two weeks, and 70 at the last day picnic at the YMCA ; 14 churches were involved this year, and 44 area businesses made cash or in kind donations; site managers were Mindy McFann, Holli Anderson and Susan Ridgeway; wonderful program for children to be able to have good lunches in the summer; thank them for all their time and effort for the lunch program.
