ORD-0039-2014 SUPPLEMENTAL APPROPRIATION - Various Accounts This Ordinance was Adopted on the Consent Agenda. Statutory Resolutions on Second Reading: SR-0001-2014 TO DECLARE THE NECESSITY AND INTENT TO APPROPRIATE REAL ESTATE IN CONNECTION WITH THE LARRY LANE SANITARY SEWER EXTENSION; IMPROVEMENT NO. SA1013; FOR PROPERTY KNOWN AS 510 EAST JOHNSTOWN ROAD AND OWNED BY DONALD F. & DORIS ROWE; AND 522 EAST JOHNSTOWN ROAD OWNED BY DONALD E. & JUDY A. SPIRES. This Statutory Resolution was Adopted on the Consent Agenda. Motion Resolution: MR-0012-2014 Motion Resolution to authorize funds that were not encumbered prior to the calculation of Gahanna's proportionate share of the Franklin County Municipal Court cost in the amount of $19,702 from Account No. 101.131.5289, Auditor, Municipal Court. The Director of Finance has certified that funds were available then at the time of calculation and now at the time of payment, appropriated, collected or in the process of collection and free from any previous encumbrance. It is hereby requested that Council approve payment of the above then and now purchase under ORC 5705.41 (D)(1). This Motion Resolution was Approved on the Consent Agenda. MR-0013-2014 Motion Resolution to authorize funds that were not appropriated prior to the housing of prisoners at the Franklin County Sheriff's office in January 2014, and funding in the amount of $6,744.25 is due to them from Account No. 101.216.5456, Police Prisoners. PUBLIC HEARINGS: ORD-0043-2014 TO ALLOW THE SURFACE APPLICATION OF BRINE; FOR DUST CONTROL AT SUBURBAN STEEL SUPPLY. President Larick explained the Rules of Public Hearing and read the title of the Ordinance and opened the floor for comments from Administration. President Larick opened the public hearing at 7:01 p.m. and asked for proponents. Applicant, Jerry Henderson from Suburban Steel, 9500 Deffenbaugh Ct.; asked for permission to apply brine water to unpaved lots; said they have to claim dust as an emission to the EPA and this is a way to control that and maintain a better neighborhood and better environment for employees. President Larick asked for opponents and seeing none, closed the public hearing at 7:03 p.m. G. STANDING COMMITTEES: 2014-0011 March 10 Committee Minutes for Review: 1.) Committee of the Whole 2.) CORRESPONDENCE AND ACTIONS: City of Gahanna Page 5 City Council Meeting Minutes March 17, 2014 Clerk - No report. Council - No report. I. SECOND READING OF ORDINANCES: Ordinances Reported Out of Committee: ORD-0035-2014 TO ENACT CODE CHAPTER 708 SECONDHAND DEALERS, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA. President Larick read the title. A motion was made by Angelou, seconded by Renner, that this Ordinance be Adopted. Discussion: A motion was made by Kneeland to postpone this legislation until April 7th, seconded by Leeseberg. Discussion: Kneeland stated there was some additional conversation that some Council Members wanted to have about this piece of legislation; supports waiting to get some questions answered before moving forward. Schnetzer stated he was one of the Council Members that had additional questions and had since met with a local second-hand dealer and one outside of the City and was impressed with the amount of work that they already do; some of his questions were answered by the store that he visited; still has some questions that he would like to discuss with Lt. Spence at the next Committee of the Whole. A motion was made by Kneeland, seconded by Leeseberg, to postpone to a date certain: April 7, 2014 Council Meeting. City of Gahanna Page 6 City Council Meeting Minutes March 17, 2014 L. REPRESENTATIVES: Community Improvement Corporation (CIC) - Larick/Kneeland Kneeland said next CIC meeting is Tuesday, March 18th at 7:30 a.m. at City Hall. Mid-Ohio Regional Planning Commission (MORPC) - Angelou Angelou said MORPC met last Thursday and the meeting was not as lengthy as usual because the first 15 minutes was spent thanking Bob Lawler for his many years of service as “Mr. Transportation” at MORPC. There were representatives from ODOT with resolution and Mr. Lawler received recognition from Pat Tiberi and Cheryl Grossman. MORPC has been recognized for its work with Columbia Gas of Ohio’s Warm Choice Program that received the Midwest Energy Efficiency Alliance 2014 Inspiring Energy Efficiency Impact Award; expanding the regional collaboration groups to 4; northwest, northeast, southwest and southeast; these groups will help to keep lines of communication among the communities open. There is a Regional Growth Analysis Project; 8 month project that will be a collaboration with Columbus 2020 and Urban Land Uses; projection of ½ million more residents by 2050 has prompted this project; this is not a plan, but a tool to be able to plan for growth in our communities. The Housing and Community Services Workshop Group Survey needs to be sent in by this Friday. Nancy White, Mifflin Township Fiscal Officer, gave a presentation about MEC and celebrating a decade of shared services; fortunate to have that wonderful opportunity for collaboration at Creekside. MORPC has put together the database of zoning codes in the 6 counties in central Ohio; over 130 codes that have been compiled and this information will be on their website. On February 25th Nancy Reger, Director of Regional Data and Mapping, testified before the House Shared Services and Government Efficiency City of Gahanna Page 7 City Council Meeting Minutes March 17, 2014 Subcommittee in support of HB 321 - DataBoard Ohio, HB323 - Online Public Data Catalog, and HB324 - Local Government Information Exchange Grant Program. Not much is moving quickly on HB5; although there have been several meetings, there have been no hearings at this point so it does appear that slow is maybe good. The Capital Improvement Bill could be introduced as early as this week. In February, the House passed HB289 which would prohibit the formation of substantial amendment of Joint Economic Development Zones all beginning on January 1, 2015; would also prohibit the renewal of JEDZ contracts after December 31, 2014; closely regulates JEDZs that are finalized between the bill’s effective date and December 31, 2014. It was referred to the Senate Finance Committee; amended in the House and I can’t believe that if this goes through it will abolish JEDZs as of January 1, 2015. Another one that was brought to our attention by Tom Homan was HB337 which MORPC is going to be keeping an eye on is local government’s budgeting requirements to revise budgeting requirements that apply to local governments and mandate that certain actuarial standards be applied in political subdivisions that have independent retirement systems and authorize the auditor of state to impose sanctions; will be watching this to protect Home Rule. There was also an amendment to the 2014-2017 State Transportation Improvement Program; includes 3 new areas for the county; add or modify 20 projects with commitments totaling over $116 million. All documents discussed will be on file with the clerk if you would like more detail. Bd. of Education, Gahanna-Jefferson Public Schools - Jolley Jolley said they had second meeting of joint committee this past Wednesday and continued discussing a few of the topics we had begun; joint facilities and parks and recreation planning items, etc.; couple of things that we are going to be following up on in the next couple of weeks that if we are successful in getting them going should be a real benefit to the City and the schools; particularly looking at fuel costs, facilities and some communication City of Gahanna Page 8 City Council Meeting Minutes March 17, 2014 initiatives; good group and some good work is coming out of it; next month should have a pretty good update on some tangible impact. Convention & Visitors Bureau (CVB) - Jolley Jolley said regular meeting was postponed until this Thursday , but saw that had a good turnout on Friday for the Tourism Ambassador training ; so good, in fact, that we are planning on more of those events; wasn't able to attend, but heard it was a really great event; the more people that are out and about talking about Gahanna in a focused way can really drive up tourism in our City; talked earlier this year about our attendance at one of the bus tour group conventions and we have gone to another of those yielding great results; the more we can continue to talk about the great things Gahanna has to offer, the more economic impact we are going to see; hopes to be able to attend the next one and will give updates. M. OFFICIAL REPORTS: Mayor Mayor Stinchcomb said as a follow-up to the State of the City address I will be attending some meetings in the community; want to try to engage the public as often as I can. Another thing I would like to do is call out one of our police officers , Randy Ott, who last week did a very great thing; at 2:30 in the morning he was on 270 and spotted a driver going the wrong way on the freeway; he turned around and was very quickly able to stop the car and arrest the drunk driver that was coming into our jurisdiction; could have been a very horrendous accident and in the report Lt. Dan Williams said in his 18 years on the force has never seen a wrong-way driver and Randy has now stopped two in the last 12 months; City is fortunate to have such talented officers looking out for the public. City Attorney - No report. N. COUNCIL COMMENT Angelou said she is proud to be Irish today and hopes that everyone has a City of Gahanna Page 9 City Council Meeting Minutes March 17, 2014 safe rest of the evening; if partying be careful and good luck to the Buckeyes and hope they make the Final Four. Leeseberg said Happy St. Patrick’s Day. Jolley said Happy St. Patrick’s Day and in relation to the MORPC report regarding HB5 nothing is going to happen before the Primary Election, action will certainly be taken this year and in its current form it is still not good for municipalities like Gahanna; continue talking about the deleterious effects that will have on our community. Renner said he was out on the westside of Gahanna on Saturday and got to see a lot of my neighbors out in the warmer weather; a lot of the comments I received from them is that we have vehicles parked in driveways that are blocking the sidewalks; asked if we have a standard notice that we can let public know what our City code is that you need to park on the street in lieu of blocking the sidewalk so that people can walk freely about our neighborhoods. Larick said Happy St. Patrick’s Day and hopefully spring is around the corner; will be for me in a week because I will be on vacation for a week. O. Executive Session - A motion was made by Kneeland, seconded by Renner, to go into Executive Session under authority of Section 5.40(g) of the Council Rules of Procedure to consider confidential information related to the marketing plans, specific business strategy, production techniques, trade secrets, or personal financial statements of an applicant for economic development assistance, or to negotiate with other political subdivisions respecting requests for economic development assistance.
