Sherwood, MMC, Clerk of Council City Council - Special Meeting Minutes November 25, 2013 A. CALL MEETING TO ORDER - Roll Call. Gahanna City Council met in Special Session on Monday, November 25, 2013, in Council Committee Rooms of City Hall, 200 South Hamilton Road, Gahanna, Ohio. President of Council Stephen A. Renner called the meeting to order at 8:00 p.m. The meeting was called to hold second reading on ORD-0151-2013. Agenda for this meeting was published on November 21, 2013. Present 7 - Stephen A. Renner, Ryan P. Jolley, Karen J. Angelou, Beryl D. Anderson, Brian D. Larick, Brandon Wright, and Thomas R. Kneeland B. SECOND READING OF ORDINANCES: ORD-0151-2013 TO AMEND CHAPTER 105, WARDS AND BOUNDARIES, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY. Motion by Wright, seconded by Jolley, to adopt ORD-0151-2013. Larick stated he may tend to over simplify things but Charter is clear; requirement of Charter is to equalize size of wards; this has been out there for some time; this simply follows requirements of charter from my perspective. Angelou questioned the words "at the request" in the 4th whereas continuing to say "of the Franklin County Board of Elections"; did not think they requested this; feel those words should be taken out; would then read" to take effect for the next election cycle of the Franklin County Board of Elections". Renner requested clarification from City Attorney; was under impression it was at their request as they needed it before January. Angelou stated only if we wanted to move forward. Ewald stated he had forwarded e-mail to Council President; did discuss with Matt Rushay with Board of Elections; requested it be done this week in order to do back office work necessary before the Board of Elections meeting in early December if this were to go forward and pass before January 1; so that is correct. Angelou stated he is requesting it only if we feel we want to move forward; does not need to be done; only if we want to; this language makes it appear they requested it. Larick stated there is no material change with this change in language; is that correct. Ewald stated there is not. Renner reiterated the request reading new language for Section 4. Jolley questioned if it made sense after removing the words "at the City of Gahanna Page 1 City Council - Special Meeting Minutes November 25, 2013 request". Angelou read section as amended; the only reason they need this is because they have a meeting; it is their election cycle. Jolley stated he did not see a need for this change. A motion was made by Angelou, seconded by Anderson, that this Ordinance be Amended. The motion carried by the following vote: Yes: 5- Renner, Angelou, Anderson, Larick and Kneeland No: 2- Jolley and Wright Kneeland stated he wished to voice opinion at this time; only seen this for a little over a week; think everybody saw my angst last week; still not sure this is the right timing without looking further into the changes placed into the hands of the Board of Elections; especially with new folks coming on board; and some of the comments made tonight; do need to abide by the Charter; unfortunately I was not here at the time you had the opportunity to look at this and any of the rationale as to why it was not passed earlier in the spring; can't comment on that; feel a bit behind on the information cycle for this issue other than Charter does it make clear on what we need to do. Renner stated he wished to make a second amendment; was pointed out to me right before the Committee of the Whole meeting that in Section 105.01 it ends with the words "...municipal election in 2013"; needs to be amended to add "and every four (4) years thereafter". Kneeland stated he brought that to committee tonight because as I was reading it felt the ending date left everything hanging as if there was nothing after 2013; clerk made some recommendations on language; that's where we are now. ORD-0151-2013 TO AMEND CHAPTER 105, WARDS AND BOUNDARIES, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY. A motion was made by Renner, seconded by Jolley, that this Ordinance be Amended. The motion carried by the following vote: Yes: 7- Renner, Jolley, Angelou, Anderson, Larick, Wright and Kneeland Anderson stated many points have been brought out; several grey areas; have new Council people who have not been sworn in yet and those who are sitting here; think as we look at this it is important to think about the immediacy but also the long term and new minds coming on Council. ORD-0151-2013 TO AMEND CHAPTER 105, WARDS AND BOUNDARIES, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; AND TO City of Gahanna Page 2 City Council - Special Meeting Minutes November 25, 2013 DECLARE AN EMERGENCY. A motion was made by Wright, seconded by Jolley, that this Ordinance be Adopted as Amended. The motion carried by the following vote: Yes: 4- Renner, Jolley, Larick and Wright No: 3- Angelou, Anderson and Kneeland Clerk noted that ordinance passed but emergency failed. C.
