Jolley PENDING LEGISLATION ORD-0137-2015 TO AUTHORIZE THE MAYOR TO ENTER INTO A REAL ESTATE PURCHASE AGREEMENT FOR THE VETERANS OF FOREIGN WARS OF THE UNITED STATES, TRI-COMMUNITY POST NO. 4719 FOR PROPERTY LOCATED AT 75 WEST JOHNSTOWN ROAD, GAHANNA OHIO 43230; AND TO ENTER INTO LEASE AGREEMENT WITH THE VETERANS OF FOREIGN WARS OF THE UNITED STATES, TRI-COMMUNITY POST NO. 4719; AND TO SUPPLEMENTALLY APPROPRIATE $250,000. Euton said we were discussing the VFW acquisition; we are working on a new proposal; would like to bring the legislation at a later date once all the details are worked out; Euton said he is requesting a postponement; Kneeland asked if he wanted to postpone indefinitely or postpone to a certain date; Larick said everything is changing; asked the Clerk what is easier; Banning said recommends postponing indefinitely and bring back with new legislation. RECOMMENDATION: Consent Agenda ORD-0144-2015 TO AMEND SECTION 331.34, FAILURE TO CONTROL; WEAVING; FULL TIME AND ATTENTION, OF CHAPTER 331, OPERATION GENERALLY, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA. Ewald said we had input from Mayor's Court, the magistrate, City of Gahanna Page 1 Committee of the Whole Meeting Minutes December 14, 2015 prosecutors and the Police Department; said not the attention section but the full time control section; there are two differences; one is unintentional and one is intentional; for the intentional section, means you are distracting yourself while you are doing something you shouldn't while driving; we are leaving the penalties for that where it is at currently; for unintentional we are reducing the penalty for that; this was a request internally from the magistrate based on some of the cases they have seen come in; seems we are penalizing people at the same level whether intentional or not; Jolley clarified we are not making any changes to the method in which we enforce distracted driving; said we are just clarifying the unintended consequence of prior language; said the debate of texting while driving is essentially not part of this debate; this is a clerical edit to fix a problem; Ewald said penalties for distracted driving, like texting and even could include your car radio and will be the same after this legislation; Jolley confirmed the only thing changing is one subsection, not actual driving while distracted. RECOMMENDATION: Consent Agenda ORD-0152-2015 SUPPLEMENTAL APPROPRIATION - to post reimbursement of legal fee payments to Special Counsel. Ewald said this is a reimbursement; have a fiber project they are working on with two other cities, Bexley and Whitehall; they have been reimbursing two-thirds of that back to us and goes into the general fund; needs Council authorization to transfer these funds; asking it go into Special Counsel; Teal confirmed mechanically it is a supplemental. RECOMMENDATION: Consent Agenda ITEM FROM THE DIRECTOR OF HUMAN RESOURCES 1. Contract Extension for the FOP Wadley said they are currently negotiating the bargaining unit agreement that expires on December 31, 2015; hope to have a tentative agreement by the end of the year; will require ratification by the members as well as Council; asking for authorization for the Mayor to sign the agreement to do an extension to carry over to next year; same terms will apply; asking for this on a month to month basis; asking for emergency and waiver due to the time; Angelou asked when negotiations started; Wadley said around October. RECOMMENDATION: Consent Agenda with emergency and waiver. 2015-0388 Human Resources Supporting Documents City of Gahanna Page 2 Committee of the Whole Meeting Minutes December 14, 2015 ITEM FROM THE CITY ATTORNEY 1. Magistrate Contract Ewald said asking to renew the magistrate contract; confirmed with Mayor Stinchcomb that the magistrate has done a fine job; Mayor Stinchcomb agreed; Ewald believes it is a one year contract; same compensation will exist. RECOMMENDATION: Consent Agenda ITEM FROM THE CLERK OF COUNCIL 1. Records Update Banning said we are updating the records retention schedules; had a Records Commission meeting last week; had a few changes on Service's retention schedule; it is very large; will be making those changes before approving that retention schedule; approved the Police Department's retention schedule; moving forward with the digital footprint; spoke with Mayor-elect Tom Kneeland on which departments will move forward with their digitial process; said this is just an update for Council. 2. Committee Room Renovation - Capital Needs Assessment Update Banning said will discuss in Finance. 3. Organizational Meetings Banning said need a Motion Resolution to set these organizational meeting dates; asked if there are any changes; we will not hold the meeting on January 4 as January 2 will be the first Council meeting date of the year in 2016.
