RECOMMENDATION:
On October 24, 2022, the Gallatin Municipal Planning Commission recommended approval of

WHEREAS, the owner of the property submitted a complete application to rezone two

BE IT FURTHER ORDAINED, the rezoning with preliminary master development plan
conforms to the general plan of the area including the established General Urban Community
Character Area and that the public necessity, convenience, and general welfare will be served by
approving the proposed amendment; and
WHEREAS, the property proposed for rezoning with preliminary master development plan
has adequate public utilities, infrastructure and private or municipal services necessary to serve the
existing and proposed development and population permitted by the requested zoning or such
necessary services and facilities will be provided upon development of the property; and
WHEREAS, the rezoning with preliminary master development plan will be compatible with
the surrounding environment and will protect the public health, safety and welfare and will not be
injurious to other property or improvements in the area in which the property is located; and
WHBREAS, the Gallatin Municipal Planning Commission reviewed and recommended
approval of GMPC Resolution No. 2022-152 for the proposed rezoning with Preliminary Master
Development Plan;and
WHEREAS' a public hearing was held following public notice as prescribed by the Gallatin
ZoningOrdinance and Tenn. Code Ann. $ 13-7-203;and

Section 1. The City Council of the City of Gallatin does hereby rezone two parcels totaling
10.10 +/- acres from the A-Agricultural Residential District to the MU-Mixed Use District as
described in Exhibit "A" with a Preliminary Master Development Plan for Harris Lane Condos, as
described in Exhibit 'B'.
Section 2. The City Council of the City of Gallatin does hereby approve, authorize and
direct the revision of the City's Official ZoningAtlas to show the classification for the area as hereby
rezoned.
Section 3. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed to the extent of such conflict.
Section 4. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid, the invalidity shall not affect other provisions or applications of this
ordinance which can be given without the invalid provision or application, and to this end the
provisions of this ordinance are declared severable.
Section 5. This ordinance shall become effective immediately upon passage, the public
welfare requiring such.

Casr BIcTGROUND:
Property History and Description
The properties, currently zoned A-Agricultural Residential, were annexed into the city in 2008 with
many other adjacent properties along Greenlea Boulevard and Long Hollow Pike (Ord. No. 00802-
l4). These were the only two properties along this portion of Harris Lane to remain agriculturally-
zoned while their neighbors adopted MU-Mixed Use and PBP-Planned Business Park zoning
districts in 2010.
DrscussroN:
Proposed Development
The owner and applicant request to rezone two parcels totaling 10.10 +/- acres from the A-
Agricultural Residential District to the MU-Mixed Use District with a Preliminary Master
Development Plan for the Harris Lane Condos, a 134 unit condominium development, located north
of Harris Lane and east of Greenlea Boulevard. Multi-family (condominiums) is a permitted use in
the MU-Mixed Use District. These two parcels are remaining properties not zoned MU-Mixed use or

PBP-Planned Business Park along Harris Lane north of the railroad tracks and east of Greenlea
Boulevard.
The 134 two-story condominium units in 24 buildings will be established within a Horizontal
Proper-ty Regime (HPR) with amenities such as a mail kiosk, dog park, and a playground.
The plan does not incorporate "mixed-use" elements, but many of the other properties along Harris
Lane, a collector roadway, do not either.
A 100'wide Cumberland Electric utility easement runs at an angle along the northern portion of
both properties. Landscaping is highly regulated in this corridor and no structures are proposed
within the easement.
Natural Features
Parcel 050.00 currently includes a single-family residence but is otherwise vacant and clear of trees.
Parcel 051.00 is vacant and contains several large trees along the northeast corner in the area ofthe
floodplain/stream buffer/Liberty Creek. The highest elevation of 513' is located in the southwest
corner of Parcel 050.00, and the lowest elevation of 458' is located in the northeast corner of Parcel
051 .00 in the stream buffer.
Based on FEMA FIRM Map 47165C0313G, dated April 17, 2012, a portion of northeast comer of
the subject property is located in a floodplain.
Adjacent or Area Uses
To the north and east is a large homestead that operates as a farm, zoned MU-Mixed use and PBP-
Planned Business Park. To the south is the Chandler Park Apaftments, zoned MU-Mixed Use. To the
west is Patriot Angels, a commercial development, zoned MU-Mixed Use.
PlanGallatin!
The PlanGallatin! designates this area as part of the General Urban Community Character Area
(Attachment 4). The Plan describes the form of the General Urban Community Character Area as
having building heights ranging from 2-4 stories and positioned closer to the street to focus on the
pedestrian environment and allow for easier access to transit. The recommended density is 5-15 units
per acre.
The 10.10 acre, 134-unit PMDP consists of a density of 13.4 units per acre (excluding50Yo of the
floodplain area of 10,761 square feet). MU zoning, which already partially surrounds the property
and dominates the adjacent properties along Harris Lane, allows upto 14.52 units per acre. The plan
meets the characteristics and adheres to all of the development strategies of the General Urban
Community Character Areas and the overall intent of PlanGallatin! This plan promotes Goal 3 of
the plan including Objectives 3.1, and 3.2; Goal l, Objective 1.3; and Goal 2, Objective 2.2, Action
15.
Site Layout
The condominium development consist of 24 buildings containing between 4 and 6 units per
building served by private driveways. Each unit will have a garage and a driveway.

The proposed development will be constructed as a Horizontal Property Regime (HPR). The owners
will only have title to the unit and not the land is sits on or the surrounding open space areas. Other
than the condominium units, all other property will be retained as common open space owned and
maintained by the homeowners association. This includes larger contiguous/preserved open space
along Liberty Creek and a small private playground/park on the east side of the property and the
driveways and parking areas.
The property will need to be platted after approval of the FMDP, and HPR documents will need to
be reviewed by the City Attorney's Office.
Access und Easements
The development will be accessed by two private driveways from Harris Lane. Driveway locations
for future developments along Harris Lane will be based on the driveways shown on this plan. All of
the condos will be accessed by private streets/access easements with sidewalks throughout the
development. Curb and gutter and a 5' wide sidewalk will be added along Harris Lane. A connection
to a future possible greenway is proposed to the adjacent property to the east. This is a more suitable
location to provide access to the future greenway corridor. Multiple parking areas will be provided
adjacent other private streets for visitor parking.
The 134-unit development will generate approximately 752 daily trips with approximately 70 of the
trips occurring in the PM peak hour. All trips will be initially assigned to Harris Lane. No traffic
count stations are located on this segment of Harris Lane, but the roadway has a capacity of about
10,000 vehicles per day (Attachment 5).
Stormwater Detention
The PMDP shows conceptual stormwater detention and water quality areas in the rear of the
property along the floodplain and stream buffer. All stormwater conveyance, detention, and
treatment shall meet the current stormwater ordinance requirements. The final drainage and
stormwater system along with the construction plans and drainage calculations shall be submitted
and reviewed with the FMDP.
Bufferyard und Landscaping Plan
Bufferyards are provided with this PMDP. These are intended to minimize the potential impacts of
the proposed development on the adjacent properties as outlined in Article l3 of the Gallatin Zoning
Ordinance.

The final landscaping plans will be submitted and reviewed with the FMDP. The plan also preserves
the Liberty Creek buffer area consistent with Goal2, Objective 2.2 and2.4.
Architectural Designs
The PMDP includes architectural elevations of the proposed townhomes (Attachment 2).

The PMDP includes 134 two-story, townhome style buildings. The condos will have a typical
pitched roof and be predominately constructed of brick as required in the MU-Mixed Use district.
The elevations meet the 70%o masonry requirement as described in the Gallatin Zoning Ordinance.
The units will include small front porches and back patios. There will be a single-car garage and a
one-car tandem driveway parking space included for each condo within this development.
A 6' tall vinyl fence will provide some privacy between the rears of adjacent interior units.
The final architectural elevations will be submitted and reviewed as part of the FMDP
Parking
Required parking is based on the use of the property. Multi-family developments are required to
provide a minimum of two (2) spaces per unit. Parking for the condos will be accommodated
through the use of garages and driveways. All driveways will be at least 20' long to accommodate a
full vehicle length without obstructing sidewalks. 56 other private surface parking spaces dispersed
throughout the site are also proposed.
The PMDP complies with the minimum and maximum number of parking spaces required by
G.Z.O., Section 11.02, Schedule of Off-Street Parking Requirements and Section 11.07,
Handicapped Parking for residential uses.
Signage Plan
Monument signs are proposed at each entrance of the development. A final sign package must be
submitted to the Planning Department for review and approval prior to the installation of any
signage on site. All signage installed on the site must comply with Section 13.07, Sign Regulation, of
the Gallatin Zoning Ordinance.
Planning Department Comments
The Planning Department reviewed and commented on the rezoning request with the PMDP. The
owner and applicant satisfactorily addressed most of the Planning Department comments, except
those included as conditions of approval in the GMPC Resolution No.2022-152.
While not an innovative design, the use, activities, and architecture comply with the general advisory
character area as this area transitions from a rural/agriculture area to a general urban area within the
western more intensive corridor designated for properties between SR 386 and Nashville Pike.
The applicant's initial architecture plan was changed at the request of the Planning Commission.
A concerned citizen email is included as an attachment (Attachment 6).
E ngineering Division Comments
The Engineering Division reviewed and commented on the rezoning request with the PMDP. The
owner and applicant satisfactorily addressed all of the Engineering Division comments.

a The development is subject to the Gallatin Department of Electricity's (GDE) Underground
Policy. All of GDE's existing facilities that are required to be relocated will be at developer's
expense.
a Submit detailed water and sanitary sewer plans and specifications to the Public Utilities and
Industrial Pre-Treatment Departments for review and approval. The water and sanitary sewer
infrastructure shall be completed and accepted, or an approved utility surety shall be in place
in order for the plat to be signed.

A RESOLUTION OF THE CITY OF GALLATIN MUNICIPAL PLANNING COMMISSION
RECOMMENDING APPROVAL TO GALLATIN CITY COUNCIL OF A REQUEST TO
REZONE TWO PARCELS TOTALING IO.1O +/- ACRES FROM THE A-AGRICULTURAL
RESIDENTIAL DISTRICT TO THE MU-MIXED USE DISTRICT WITH A PRELIMINARY
MASTER DEVELOPMENT PLAN FOR THE HARRIS LANE CONDOS, LOCATED NORTH
oF HARRTS LANE AND EAST OF',GREENLEA BOULEVARD. (ZONE-2022-0075)
WHEREAS, the applicant submitted an application for a rezoning with a Preliminary
Master Development Plan consistent with Section 15.07.030 of the City of Gallatin Zoning Ordinance;
and
WHEREAS, THE CITY OF GALLATIN MUNICIPAL PLANNING
COMMISSION considered the rezoning with a Preliminary Master Development Plan submitted by the
applicant, Eagle Homes LLC, at its regular meeting on October 24,2022; and
WHERBAS, THE CITY OF GALLATIN MUNICIPAL PLANNING
COMMISSION reviewed the rezoning with a Preliminary Master Development Plan application,
materials and supporting documentation submitted by the applicant, the analysis, findings and
recommendations presented by City Staff in the Planning Commission Staff Report and the evidence
and testimony presented during the meeting, and
NOW, THEREFORE, BE IT RESOLVED BY THE GALLATIN MUNICIPAL
PLANNING COMMISSION as follows:
Section L The Gallatin Municipal Planning Commission in its deliberations makes
the following findings pursuant to Tenn. Code Annotated $13-4-310, $13-
7-201 and 513-7-202 and Section 15.07.030 of the City of GallatinZoning
Ordinance:
The owner and applicant submitted a completed application with required
attachments to the City requesting approval of the zoning change with a Preliminary
Master Development Plan as required by Section 15.07.030 of the Gallatin Zoning
Ordinance and the request complies with the general concept plan standards required
ofthe code.
2. The rezoning and Preliminary Master Development Plan is in agreement and
consistent with the intent and land use recommendations of PlanGallatin! including
the General Urban Community Character Area.
3. The Preliminary Master Development Plan is consistent with the puryose and intent
of the MU-Mixed Use zone district and complies with the use restrictions, site
development regulations including the bulk and area and yard regulations established
in said zone district except where exceptions have been granted.
4. The property proposed for rezoning with Preliminary Master Development Plan has
adequate public utilities, infrastructure and municipal services necessary to serve the
proposed development and population permitted by the requested zoning and

proposed master plan or such necessary services and facilities will be provided upon
development of the property.
5. The rezoning with Preliminary Master Development Plan will not adversely affect
adjoining property owners or any such adverse effect can be mitigated by applying
design and performance standards or is justified by the public good or welfare.
6. The Gallatin Municipal Planning Commission received public comment and reviewed
the application and recommended to the City Council action on the proposed rezoning
with Master Development Plan request.
7. The Preliminary Master Development Plan complies with the Design and
Performance Standards of the Gallatin Zoning Ordinance as described in Section
13.02.
8. The rezoning with Preliminary Master Development Plan will be compatible with the
surrounding environment and will protect the public health, safety and welfare and
will not be injurious to other property or improvements in the area in which the
property is located.
9. The legal purposes for which zoning regulations exist have not been contravened.
l0.No one property owner or small group of property owners will benefit materially
from the approval to the detriment of the general public.
Section 2. Action - The Gallatin Municipal Planning Commission hereby recommends
approval to City Council to rezone two parcels totaling 10.10 +/- acres from
the A-Agricultural Residential District to the MU-Mixed Use District and
approval of a Preliminary Master Development Plan, consisting of a six (6)
sheet plan, prepared by Klober Engineering of Springfield, TN, with job
number C01122, dated August 15,2022, with a resubmittal date of September
15, 2022, and signed and sealed on October 13, 2022, and six (6) sheets of
architectural elevations for Harris Lane Townhomes, prepared by Netterfield
Designs with project No A01922, dated October 3,2022, with the following
conditions:
L Provide all HPR documentation to meet all of the legal requirements to establish a HPR
pursuant to Tenn. Code Ann.
2. Correct the purpose note to only include 134 units as shown on the PMDP.
3. Submit PDF and AutoCAD (dwg.) drawings of the revised PMDP to the Planning
Department addressing all condition of approval.

MUNICIPAL PLANNING COMMISSION that this resolution shall take effect from and after its

At your Monday, September 26 meeting, please answer these questions regarding the proposed zoning change and
proposed condominium development at 0 and 258 Harris Lane, Gallatin:
What were the reasons the two 5 acre properties were kept as agricultural zoning when other Harris Lane properties
were rezoned mixed use, PBP and commercial?
Building on and paving over the majority of l0 acres will result in greatly increased stormwater runoff towards
Harris Lane, neighboring properties and Liberty Creek. How will the stormwater be managed?
Increased car traffic on Harris Ln will be backed up when the nearby train crossing barriers are down many times
daily, how will local residents be able to access or exit their driveways when there is stopped traffic? How will
emergency vehicles travel on Harris Ln with long lines of backed up vehicles?
Future commercial and residential developments at the corner on Harris Ln and Green Lea will be accessed from
Harris Lane. This will significantly increase traffic at the train crossing as well as the intersection of Green Lea and
Harris Ln.
Harris Lane is a narrow two-lane road with no shoulder, already built up with Chandler apartments and single family
homes. How will increased traffic flow safely with the new proposed developments?

RESOLUTION NO. RU2211.81
RESOLUTION APPROVING MURAL AT 600 SMALL STREET
WHEREAS, Chapter 5, Article XV of the Gallatin Municipal Code regulates
murals in Gallatin; and
WHEREAS, a request has been submitted to the Mayor's Office to review and
approve a mural at 600 Small Street, and the Gallatin Arts Council has reviewed and
approved the mural, (attached as Collective Exhibit 1), as required by Sec.5-302(c)(2) of
the Municipal Code.
NOW THEREFORE BE IT RESOLVED BY THE CITY OF GALLATIN,
TENNESSEE, pursuantto Chapter 5, Article XV, Section5-302 of the Gallatin Municipal
Code, the proposed mural at 600 Small Street is hereby approved.
BE IT FURTHER RESOLVED BY THE CITY OF GALLATIN,
TENNESSEE, that this Resolution shall take effect from and after its final passage, the
public welfare requiring such.
