Other Approved 0 Rejected 0 Deferred 0 Notes: CITY OF GALLATIN COUNCIL COMMITTEE AGENDA March 14, 2023 DEPARTMENT: Engineering AGENDA# 2 SUBJECT: Ordinance to Vacate a portion of Right-of-Way on Randolph Circle (southerly portion) SUMMARY: The attached Ordinance proposes the abandonment of a portion of the public right-of-way on Randolph Circle. Planning Commission Resolution. No. 2020-024 recommended right-of-way abandonment and was passed on January 271h , 2020. The applicant failed to provide legal descriptions for deeds to be drawn up in 2020. The property owner for the northerly portion provided provided legal descriptions for the portion of right-of-way that will be conveyed to him in August of 2022. Council approved 02208-42 on September 6, 2022 abandoning the northerly portion. The original applicant was contacted at that time and chose not provide a legal description for the southerly portion of the right-of-way but has now submitted them and would like to move forward with the abandonment. There are times when the IDB has items for action, but cannot vote because a vacancy has occurred and no replacement seated. Thus, the board is not meeting the minimum requirement of seven seated Directors. Expanding the IDB to nine Directors would allow the Board to conduct those certain business items as long as there are seven seated Directors. With nine Directors, there could be one or two vacancies and business still continue.
