Ordinance #O2505-30 – Public Hearing Councilman Alexander presented this ordinance of the City of Gallatin, Sumner County, Tennessee, zoning 17.18 (+/-) acres “not zoned” to the R-8 PRD – Medium Density Residential Planned Residential District and rezone 4.08 (+/-) acres from the R-40 Low Density Residential District to R-8 PRD – Medium Density Residential Planned Residential Development District with a Preliminary Master Development Plan for Kirkpatrick Gallatin on 154.83 (+/-) acres, located south of Nichols Lane and west of Woods Ferry Road; authorizing the revision to be indicated on the official zoning atlas; repealing conflicting ordinances; providing for severability, and providing for an effective date (Zone- 2025- 0114). Resolution #R2505-28 Councilman Jouvence presented this resolution authorizing the mayor to sign a “Software as a Service Agreement” between the City of Gallatin and Tyler Technologies for the purpose of moving Municipal Justice Software from an on- premises environment to a Tyler Technologies hosted Cloud Environment. R25Ø6-34 RESOLUTION APPROVING PRIVATE CHAPTER NO. 17 OF THE 114TH GENERAL ASSEMBLY AMENDING CITY OF GALLATIN CHARTER ARTICLE VI, SECTION 2A WHEREAS, the City Council for the City of Gallatin approved Ordinance No. O241Ø-55 requesting that the Tennessee General Assembly allow amendment of the City of Gallatin’s Charter to eliminate conflict among provisions of the City Charter and Municipal Code with respect to outside employment outside of business hours for department heads and specifically to delete the requirement that appointed officers must devote all of their time to their respective offices; and WHEREAS, the 114th General Assembly of Tennessee enacted Private Chapter No. 17, and Governor Lee signed the legislation on May 21, 2025, allowing the City of Gallatin’s Charter to be amended as follows: Chapter 67 of the Private Acts of 1953, as amended by Chapter 53 of the Private Acts of 2016, and any acts amendatory thereto, is amended by deleting from Article VI, Section 2a of the language “All officers of the city, except the city attorney, shall devote all of their time to their respective offices…” WHEREAS, the 114th Tennessee General Assembly determined that Private Chapter No. 17 shall have no effect unless it is approved by a two-thirds (2/3) vote of this governing body. NOW THEREFORE BE IT RESOLVED BY THE CITY OF GALLATIN, TENNESSEE, that Private Chapter No. 17 of the 114th General Assembly of the State of Tennessee is hereby approved and Article VI, Section 2a shall be amended by deleting the language “All officers of the city, except the city attorney, shall devote all of their time to their respective offices…” from the Charter. SUMMARY: City Council approved Ordinance No. O241Ø -55 requesting that the Tennessee General Assembly allow amendment of the City of Gallatin’s Charter to eliminate conflict among provisions of the City Charter and Municipal Code with respect to outside employment outside of business hours for department heads and specifically to delete the requirement that appointed officers must devote all of their time to their respective offices. The 114th General Assembly approved the charter amendment. Council must now pass this Resolution for the Private Chapter to be effective. RECOMMENDATION: Approve the resolution.
