Minutes of the Regular Meeting of the Gallup City Council, City of Gallup, New Mexico, held in the Council Chambers at Gallup City Hall, 110 W. Aztec Ave. at 6:00 p.m. on Tuesday, September 25, 2018. The meeting was called to order by Mayor Jackie McKinney. Upon roll call, the following were present: Mayor Jackie McKinney Councilors: Linda Garcia Allan Landavazo Fran Palochak Absent: Yogash Kumar, Councilor Also present: Eric Babcock, Acting City Manager Curtis Hayes, City Attorney Mayor McKinney said Councilor Kumar’s absence will be considered an excused absence. He also recognized Bill Lee, McKinley County Commissioner, who was in the audience. Presented to the Mayor and Councilors for their approval were the Minutes of the Special and Regular Meetings of September 11, 2018. Councilor Palochak made the motion to approve the aforementioned Minutes. Seconded by Councilor Garcia. Roll call: Councilors Palochak, Garcia, Landavazo and Mayor McKinney all voted yes. The Mayor and Councilors presented a Proclamation declaring the month of September 2018 in celebration of the University of New Mexico-Gallup’s 50th Anniversary. Dr. James MaIm, Dr. Daniel Primozic, Robert Griego and Merilee Petranovich were in attendance to accept the proclamation. Presented to the Mayor and Councilors for their approval were the following Discussion/Action Topics: 1. Request for Street Closures For the Hiroshi Miyamura High School Homecoming Parade to be held on Thursday, October 11, 2018 Shinae — Reid, Miyamura High School MINUTES Regular City Council Meeting — 9/25/2018 Page 2 Ms. Reid presented the request for street closures from 8th Street to 1st Street on Aztec Avenue, in accordance with the standardized parade route, for the Miyamura Homecoming Parade to be held on October 11 2018 at 7:00 P.M. Councilor Garcia made the motion to approve the request for street closures for the Miyamura High School Homecoming Parade to be held on Thursday, October II, 2018. Seconded by Councilor Landavazo. Roll call: Councilors Garcia, Landavazo, Palochak and Mayor McKinney all voted yes. 2. Design Direction for Coal Avenue Commons Construction Project — Stan Henderson, Public Works Director Mr. Henderson said of the 3 conceptual design options presented at the Regular City Council Meeting on September 11, 2018 and the creative placemaking process, option 3 was the preferred design. Mr. Henderson requested the Mayor and Councilors’ selection to commence work with the Northwest New Mexico Council of Government (NWNMCOG) on obtaining construction funding, with hopes of receiving it by this time next year. Mayor McKinney introduced George Radnovich of Sites Southwest and Howard Kaplan of Wilson & Company who was in attendance to answer questions. The Mayor and Councilors commended all involved in the designs and expressed their excitement for the future of the downtown area. Councilor Palochak made the motion to approve design option 3 for the Coal Avenue Commons Construction Project. Seconded by Councilor Garcia. Roll call: Councilors Palochak, Garcia, Landavazo and Mayor McKinney all voted yes. 3. Resolution No. R201 8-28; Transportation Alternative Program Funding Application Mr. Henderson presented the proposed Resolution for the City’s submission of an application for the Federal Highway Administration’s (FHMA) Transportation Alternative Program (TAP), as part of future funding required for the Coal Avenue Commons Construction Project. Mr. Henderson said a resolution of sponsorship and intent is required by New Mexico Department of Transportation (NMDOT) from City Council. The estimated cost of the project is $2 million to $3 million. The TAP application will be in the amount of $1 million including $854,400 from FHWA and a direct fiscal impact on the City for $145,600 in the 201 9-2020 CIP budget. MINUTES Regular City Council Meeting — 9/25/2018 Page 3 Discussion followed regarding the application process timeframe and the positive economic impact. Councilor Landavazo made the motion to approve Resolution No. R201 8-25; Transportation Alternative Program Funding Application. Seconded by Councilor Palochak. Roll call: Councilors Landavazo, Palochak, Garcia and Mayor McKinney all voted yes. 4. Resolution No. R201 8-29; State Grant Acceptance for Veterans Cemetery Access Road Construction Project Stan Henderson, Public Works Director — Mt. Henderson said the 2018 New Mexico Legislature appropriated $335,500 to offset construction costs of the Veterans Cemetery Access Road Construction Project which requires the Mayor and Councilors’ approval. The funds will be used to cover about 50% of the project’s cost of around $600,000. Mayor McKinney asked if the City’s 50% match was included in the current budget and requested the information be provided to the Council if the Resolution is approved. Councilor Palochak made the motion to approve Resolution No. R201 8-29; State Grant Acceptance for Veterans Cemetery Access Road Construction Project. Seconded by Councilor Garcia. Roll call: Councilors Palochak, Garcia, Landavazo and Mayor McKinney all voted yes. 5. Budget Transfer for Aquatic Center Pool Re-Plaster Project — Marc Lujan, Facility Maintenance Supervisor Mr. Lujan reminded the Mayor and Councilors of their approval to re-plaster the slide and activity pool earlier in the year; however, according to the Joint Powers Agreement (JPA) with Gallup McKinley County Schools (GMCS), $137,020.20 for the project will need to be moved from the Facility Maintenance account into the Aquatic Center account. Discussion followed regarding the project’s time-frame and facility closure dates. Mayor McKinney commented on the agreement with the schools and the importance of starting and finishing the project as soon as possible. Councilor Garcia made the motion to approve budget transfer for the Aquatic Center Pool Re-plaster Project. Seconded by Councilor Palochak. Resolution No. R201 8-27; Opposing Rail Transportation of Nuclear Waste through Gallup Curtis Hayes, City Attorney — Mr. Hayes presented the proposed Resolution opposing the transportation of radioactive waste through the City of Gallup. Mr. Hayes said Holtec International applied to the Nuclear Regulatory Commission for a license to store radioactive waste in a temporary underground facility in Lea County until a permanent storage location can be identified and built, which would require the waste to be transported; first, to the temporary site and then again to the permanent location. Mr. Hayes provided the names of counties in New Mexico that have adopted resolutions opposing the transport of the radioactive waste and those in support of the Holtec’s application. Mayor McKinney commented on the diverse opinions among municipalities in the state regarding the issue. Discussion followed regarding concerns for the possibility of derailment and contamination, the significance of resolutions such as this when it comes to the federal government, concerns for future citizens and the influence of the federal government and railroad organizations. Councilor Landavazo made the motion to approve Resolution No. R2018-27; Opposing Rail Transportation of Nuclear Waste through Gallup. Seconded by Councilor Palochak. Roll call: Councilors Landavazo, Palochak, Garcia and Mayor McKinney all voted yes. The following Presentation and Information Item was presented to the Mayor and Councilors: 1. Vendor Permit Ordinance — Curtis Hayes, City Attorney Mr. Hayes identified and explained five (5) issues within the current Ordinance, including 1) Current fees and Vendor Permit Classifications 2) The exemption of “authentic handcrafted Native American arts and crafts.” 3) Special events Vendor Permits. 4) Permitted hours of operation and 5) Location restrictions during special events. Discussion followed regarding each issue. Bill Lee, Gallup McKinley County Chamber of Commerce, CEO, commented on the number of calls he has received related to the issue, concerns regarding gross receipts tax and CRS-i numbers and licensed business owners being charged an additional fee to vend outside of their permanent location. Mr. Lee offered to notify all Chamber of MINUTES Regular City Council Meeting — 9/25/201 8 Page 5 Commerce members, via email, of the proposed ordinance to garner feedback from business owners. He will present the information to Mayor and Council at a later date. Two (2) downtown business owners in attendance expressed their concerns with downtown vendors. Mayor McKinney suggested Mr. Lee meet with Mr. Hayes to gather all information that has been collected thus far. Sammy Chioda of Sammy C’s, also expressed his concerns with downtown events and participating vendors. He commented on the use of, “authentic,” when referring to Native American goods. Mayor McKinney commented on the unexpected growth of the ArtsCrawl events and commended Rose Eason, GallupARTS, on the work she has done for the events. Ms. Eason presented information on the positive economic impact ArtsCrawl has had on the community and stated the importance of speaking with all business owners in the downtown area when collecting feedback. Comments by Public on Non-Agenda Items Mr. Lee, who is also the President of the Red Rock Balloon Rally Association, said balloons will launch from the Fox Run Golf Course on Friday, November 30, 2018, weather permitting. He thanked the Mayor, Councilors and Golf Course Staff for their support. Mervyn Tilden presented a letter regarding the transportation of nuclear waste and thanked Mayor and Council for passing Resolution No. R201 8-27. Comments by Mayor and City Council Councilor Palochak congratulated Councilor Garcia on her 2nd Annual North Fest event. Councilor Landavazo reminded everyone of the Gallup Community Concerts held at El Morro Theatre and encouraged everyone to support the concerts by purchasing season tickets. Councilor Garcia thanked Ms. Eason, for her help in organizing the 2 Annual North Fest. Ms. Eason provided a brief update on the event and stated she will provide a more detailed presentation to Mayor and Councilors in the future. Councilor Garcia also thanked the Gallup Police Department for honoring Lt. She also invited everyone to her Neighborhood Meeting at the Gallup Senior Center on Thursday, September 27, 2018 at 6:30 P.M. Michael Sage, Greater Gallup Economic Development Corporation, Mr. Babcock and Mr. Henderson will be in attendance to answer questions.
