The regular meeting of the Planning and Zoning Commission was called to order at 6:00 p.m. by
Chairwoman Keegan Mackenzie-Chavez.

Presented to the Chairman and Commissioners for their approval were the minutes of the March 8th,
2017 regular meeting.
Commissioner Pawlowski motioned for approval of minutes as presented. Seconded by
Commissioner Kozeliski, A.V.A. Motion Carried.
Chairwoman Mackenzie-Chavez administered the oath required by state law for public forum.
ITEM ONE: CASE # 17-00800002: Request by Ahmad Ayesh, on behalf of Gallup Islamic
Center, property owner, for a Variance of Three (3) Feet, Four (4) inches from the required Five (5)
foot set back requirement in a Commercial (C-3B) Zoning District - per Section 10-4B-2D of our City
Code. The property is located at 3100 East Historic Highway 66; more particularly described as Tract
G, Indian Hills Subdivision Unit One.
CB explained that on December 2016, the Gallup Islamic Center had submitted an application for a
foundation only permit. CB used the overhead projector to display the site plan that was submitted
with that application. The site plan was prepared by the architectural firm, AFTA Construction and
Design. He pointed out that the property boundary drawn on the site plan was placed near Highway
66, which exceeded the required five foot (5’) setback. We assumed this was the correct location of
the property boundary, as the architectural firm should have researched the property prior to
submitting the site plan.
After departmental review, the City issued the permit, the foundation was dug and poured in place.
The plumbing was also installed underground. It just so happened that our Planning Development
Review Coordinator was working on a project for the property to the west when he discovered that
the property boundary was closer to the structures than the property boundary on the Gallup Islamic

Center property. When he researched the property in question, he realized that the Gallup Islamic
Center property boundaries that were indicated on the submitted site plan were incorrect. The City
had based their approval of the foundation only permit on the incorrect site plan that had been
submitted.
There were a couple of additional errors; a sewer line was drawn in an incorrect location and a public
utility easement that runs twenty-five feet (25’) from the property line and up against the building
were not noted. The good news is that the sewer line is no longer in service and was abandoned.
Therefore the easement was no longer necessary and at last night’s City Council meeting, the
Council approved vacating this easement.
The issue we are facing now is that the new construction is one foot 8 inches (1’8”) away from the
property line. There is an encroachment of three feet four inches (3’4”). This was not an error on the
contractor’s part – the contractor was going by the drawing submitted by the licensed engineer.
CB then explained the hardship to the property owner in this case; it is a narrow lot and that limits
the buildable area on site. He then noted reasons staff supports the request: 1) Highway 66 is two-
hundred feet (200’) wide instead of the standard local street width of sixty feet (60’) and 2), The
distance from the property boundary line on the subject property to the sidewalk fronting Highway
66 is approximately sixty feet (60’) which leaves more than adequate distance, or buffer, from the
building to the street or back of curb. The intent of setbacks to get the separation between street
traffic and the building, in this case there is adequate separation.
CB also stated that had the foundation not already been poured and the plumbing not already been
installed, the City would have asked the developer to re-dig – but in this case – these steps have
already been completed. Again reminding the Commission that the plans that were submitted to the
City were designed and stamped by a licensed engineer and the City assumed the site had been
researched and the information submitted was correct.
Each of the Commissioners expressed their disappointment that this error had occurred and asked if
there was any recourse to the licensed engineer that designed the site plan. They also asked if staff
has put into place any mechanism to assure that an error such as this one will not happen again.
Commissioner Matt Long did note that an engineering or architectural firm that is licensed and has
stamped their design – is the party responsible and liable for assuring that the information submitted
has been thoroughly researched and is accurate. These companies have the professional liability and
professional duty to their clients to make sure they are providing the service they are being paid for.
Commissioner Long also reminded the applicant that now that it has been determined that his
property boundary is closer to his building than previously noted – they will need to be careful when
applying with the State for a right-of-way permit. It could be that the State will not allow for all the
off-street parking that will be required for the use of this structure. CB informed the Commission
that the owner of the vacant lot to the east of this project has subdivided the lot and will allow a
portion of that vacant lot to be used for additional off-street parking spaces.

Mr. Ahmah Ayesh, contractor for the applicant, expressed that they had many meetings with the City
and the Planning Department does an excellent job. He agreed this was a huge oversight and is
hoping that we will be able to correct the issue at tonight’s meeting. Commissioner Kozeliski asked if
he would be allowed to use the parking lot to the east for parking spaces. Mr. Ayesh informed the
Commission that the lot to the east is being subdivided and the owner is donating a portion of the lot
to the Gallup Islamic Center for additional parking spaces.
Mr. Ayesh explained that they have already applied for a right-of-way permit from the state and hope
to receive a permit as soon as possible.
Mr. Pete Gonzalez, property owner of 201 Turquoise Lane, expressed his concern that as the Gallup
Islamic Center building is expanding, will the additional vehicles be parking on the street in front of
his property. CB did inform Mr. Gonzalez that the adequate number of off street parking spaces
must be provided for by the property owner. He also reminded Mr. Gonzalez that anyone from the
public is allowed to park on the street, so he could ultimately have members of the public parked on
the street near his residence. But the building permit process will require the adequate number of
parking spaces for the occupant load of this particular building and use.
Motion was made by Commissioner Kozeliski for approval of this item per staff’s recommendations.
Seconded by Commissioner Pawlowski. A.V.A., Motion Carried.

BACKGROUND
M. Magda L. Garcia, representative for Sisters of Our Lady of Guadalupe & St. Joseph Inc.,
property owners, has petitioned the Gallup Planning and Zoning Commission for a variance
from Section 10-4C-1D “Off Street Parking Requirements” of the City of Gallup Land
Development Standards. Applicant is requesting a variance of fourteen (14) standard off
street parking spaces from the required thirty four (34) standard off street parking spaces for
a proposed convent use. The property is located at 711 South Puerco Drive and more
particularly described as Lots 1 through 4, Block 1, Highland Park Addition.
DISCUSSION
Said property, according to McKinley County property records, shows 1935 as the actual year
built and 1965 as the effective year built. The building was owned by the Roman Catholic
Church and was primarily used as offices with an accessory chapel. The Sisters of Our Lady of
Guadalupe & St. Joseph Inc. recently purchased the property and obtained Conditional Use
Permit approval by the Planning and Zoning Commission on October 12, 2016 to allow for the
remodel of the structure from offices to a convent and leaving the chapel as is. When the
building was originally built or at some point after a parking lot was constructed at the rear
of the property which provided twenty (20) standard and one (1) handicap accessible off
street parking spaces laid out in a forty five degree (45°) configuration. The entire site is built
out with the main structure and the parking lot with no additional room for expansion of any
kind.
Because a “convent” is not specifically listed within the uses tables for calculating the
required number of off street parking the next closest use must be looked at. A convent is
considered to be similar to a boarding or lodging house which is listed in Section 10-4C-1D3
of the City of Gallup Land Development Standards Off Street Parking Requirements section.
A minimum of two (2) off street parking spaces in addition to one (1) space per sleeping room
is required for this particular use. There are ten (10) sleeping rooms within the proposed
convent which would require twelve (12) spaces. The chapel requires one (1) space per four
(4) seats in the primary assembly room. There are ninety six (96) seats within the primary
assembly room which would require twenty four (24) spaces for the chapel. When combined
both the sleeping area and chapel would require an overall total of thirty five (35) off street

parking spaces consisting of thirty four (34) standard spaces and two (2) handicap accessible
spaces.
As mentioned above when said site was developed there was a parking lot constructed on
site providing twenty (20) standard and one (1) handicap accessible off street parking spaces
laid out in a forty five degree (45°) configuration. The entire site is developed with the main
structure and the parking lot leaving no additional room for expansion of any kind. This
creates a hardship peculiar to the land in that there is no additional space left on site for
expansion of the parking area. For this reason the request for a variance of fourteen (14)
standard off street parking spaces meets the criteria as listed in the Limitations and Grounds
for Variance. The existing parking lot currently does comply with the City’s dimensional
requirements for forty five degree (45°) parking spaces with a thirteen foot (13’) driving aisle.
The handicap van accessible space will need to be restriped and signage installed per code.
A copy of Section 10-4L-3A “Limitations and Grounds for Variance” are included in your
agenda packet and marked as “Exhibit A”
FINDINGS
It is the findings of staff that for the reasons listed above the request meets the Limitations
and Grounds for Variance as defined in Section 10-4L-3A of the LDS as follows.
1. When said site was developed in 1935 and further improved in 1965 there was a
parking lot constructed on site providing twenty (20) standard and one (1) handicap
accessible off street parking spaces laid out in a forty five degree (45°) configuration.
The entire site is developed with the main structure and the parking lot leaving no
additional room for expansion of any kind. Existing development on said property
creates special conditions and circumstances which are peculiar to the land and which
are not generally applicable to other lands in the same zoning district.
2. Because of the special circumstances related to the land listed above literal
interpretation of the provisions of this title would deprive the applicant of rights
commonly enjoyed by other properties in the same zoning district under the terms of
this title and would work an unnecessary and undue hardship upon the applicant.
3. The extent of the variance requested is reasonably related to what is needed to
overcome the alleged hardship.

WHEREAS, a minimum of two (2) spaces plus one (1) space for each sleeping room in the
convent area and a minimum of one (1) space per four (4) seats in the main assembly area
for the accessory chapel area is required per Sections 10-4C-1D3 and 10-4C-1D7 of the
City of dallup Land Development Standards (LDS); and
WHEREAS, the total number of required off street parking spaces for the proposed
convent with accessory chapel based on ten (10) sleeping rooms in the convent area and
ninety six (96) seats in the chapel area is thirty four (34) standard off street parking spaces

Limitations and Grounds for Variance
A variance shall not be requested or granted in order to permit or expand a use not
generally or by conditional use permitted in a particular zoning district or to allow a
reduction in the dimensions of an existing lot with respect to its total area, width or
frontage below the minimum dimensions prescribed by this title for the applicable
district. All other provisions of this title may be subject to a variance request. Acceptable
grounds for petitioning for a variance are that, owing to special conditions on a particular
property, the literal enforcement of the provisions of this title would result in an
unnecessary and undue hardship upon the property owner. However, demonstration of
such hardship shall comply with the following criteria:
1. Special conditions and circumstances exist which are peculiar to the land (such as
exceptionally irregular, narrow, shallow, or steep lots, or other exceptional
physical conditions), structure or building involved and which are not generally

The Sisters of Our Lady of Guadalupe and St. Joseph are the official owners of the
Property at 711 S Puerco GaI]up, NM 87301.
During the Planning Department’s review of the small remodeling of our
future convent that will house a small Chapel with only 60 chairs and an altar and
living quarters for our nuns. We will have transformed 6 former offices into
bedrooms for the nuns who live, teach and help the people in Gallup. We have
another 3 sisters who care for our Orphanage in Guadalajara Mexico. They will
visit us maybe once or twice a year for vacation. We will have extra bedrooms to
accommodate them.
The Sisters own 3 vehicles here in Gallup.
I am Mother Superior, Magda Garcia. We have an USA Immigration Service
for nearly 40 years. This leads to Green Cards and eventually Citizenship.
Average Immigration Customers. (1) to (3) per day.
Our sisters have lived for nearly 40 years at 217 Black Diamond
Canyon Drive in the North of Gallup. There is a small chapel in a trailer. We have
24/7 Perpetual Adoration of the Blessed Sacrament for anyone from Gallup to
visit and pray at any time night or day. The same will occur in the new Chapel
that will contain 60 chairs. (Each chair, width 20”).
In a 24 hour average day there are about 10 to 15 people that come.
In our Chapel we have Mass once on Monday, Wednesday, and Saturdays.
Attendance averages, besides the Sisters, about 7 to 10 peopte.
The most we have ever had was about 20 for one mass. The mass lasts
about 30 minutes.
On Fridays at about 7 pm we have a Prayer Group that can attract from
12 to 20 people for about 30 to 45 minutes.
We understand that the regulations for our type of structure and activities
states that for every 4 seats in our gathering room (Chapel) we require
one (1) parking space. We have in our new property 21 marked parking
spaces that includes Two (2) handicap spaces.
Dear Sirs we do not understand why we need a variance for parking because
we believe the present marked spaces on the property are in our mind more than
ample for what is required. We are confused please explain.

DESCRIPTION: Variance: This is a new property owner who has applied for building permit at
the project location. Per Section 10-4C-1D.1.; General Parking Provisions, they are required to
have forty-two (42) off street parking spaces. They presently have twenty-one (21) parking
spaces available, therefore they are requesting a variance from the parking requirement because
their existing building occupies most of the property allowing for only a small parking lot and no
option to expand. This request for Variance will be presented to Planning & Zoning Commission
as soon as possible, any conditions for approval should be included in Staff recommendation to
the Commission.

COMMUNITY PLANNER COMMENTS:
P1.) Building footprint is not being expanded however use of building is changing
from office to convent requiring additional parking spaces.
P2.) Existing site conditions prohibits expansion of existing parking area to
accommodate additional spaces therefore a hardship exists that is peculiar to the
land. Existing parking lot shall be striped as close to current city standard as
possible including ADA space.

Variance.
