The regular meeting of the Planning and Zoning Commission was called to order at 6:00 p.m. by
Madam Chair Keegan Mackenzie-Chavez.
Upon roll call, the following were present:

Presented to the Chairman and Commissioners for their approval were the minutes of the April 12th,
2017 regular meeting.
Commissioner Dooley motioned for approval of minutes as presented. Seconded by Commissioner
Pawlowski, A.V.A. Motion Carried.
Madam Chair Mackenzie-Chavez administered the oath required by state law for public forum.
ITEM ONE: CASE # 17-00800003: Request by Sisters of Our Lady of Guadalupe & St. Joseph
Incorporated, property owner, for a Variance of Fourteen (14) off street parking spaces from the
required Thirty-Four (34) spaces per Section 10-4C-1D1 of our City Code. The property is located at
711 S. Puerco Drive; more particularly described as Lots 1 through 4, Block 1, Highland Park
Addition.
CB explained that the property was previously owned by the Roman Catholic Church, and has actual
year built in 1935 and the effective year built is 1965; meaning that there were modifications done
through the years and the major ones were done in 1965. CB continued stating that this is where the
original Catholic Diocese offices were and contains a chapel. Since then the Sisters of Our Lady of
Guadalupe and St. Joseph acquired the property and is currently being remolded in to a convent in the
south southern wing which changed the occupancy of the building. The use as a convent is a
permitted use in this zoning district, when the use changed; the parking requirements were also
included. When it was built the building took up the entire site and a parking lot was added in the
back and contains 21 spaces angled at 60 degrees. The convent is considered to be a similar type of
use as that of the office, so the calculations for the parking would be a minimum of 2 off-street
parking spaces in addition to one space per sleeping room. There will be 10 sleeping rooms which will
require 12 spaces and the chapel requires 1 space per 4 seats. In the primary assembly room there are

96 seats requiring 24 spaces for the chapel; combined is total 35 spaces overall, which would consist
of 34 standard off-street parking spaces and 2 handicap accessible space with one being van
accessible.
CB continued that as mentioned before when the property was built out, it did not leave room for
expansion for additional parking anywhere on site. The parking that’s there does comply with the
current regulations dimensional requirements. It will need to be restripe and the hand cap will have to
be modified a little bit, the driving isle and the space depths do meet the minimum dimensional
requirements for the 45 degree angle parking.
In the use of a convent there is really not a lot of traffic that will be going to this place; it’s basically
going to be the nun’s that occupy the building. They will have mass there. CB was unclear how
frequently mass will be held. A representative for the case clarified that it will be during the week on
weekdays. CB continued that there is sufficient parking in the back of the convent for people who
attend mass. CB explained that the hardship is the site itself and does give room for expansion of any
kind for additional parking. Thus they meet the limitations and grounds for a Variance with the
hardship peculiar to the property that there is no room for expansion; staff believes that this does
qualify for a Variance because of site conditions and the use will not generate any further traffic.
Madam Chair, Mackenzie-Chavez, asked Commissioners if they had any questions. Commissioner
Dooley asked the City is requiring the parking lot to be restriped and adequately signed. CB
confirmed this requirement, stating the parking lot will be restriped with 45 degree angles the
handicap parking will have to have the appropriate signage per code.
Madam Chair, Mackenzie-Chavez asked if there were any issues with the neighborhood increasing the
street parking. CB stated he received a couple of calls inquiring about what the variance was for and
after CB explained they had no issues. No further questions or comments were presented.
Motion was made by Commissioner Kozeliski for approval of this item per staff’s recommendations.
Seconded by Commissioner Pawlowski. A.V.A., Motion Carried.
INFORMATION ITEMS
ITEM TWO: City Council Actions Taken.
CB stated that Commissioners were reappointed for 2 years. [CB was referring to the recent re-
appointment Commissioner Mackenzie-Chavez, Acting Madam Chair, Commission Loren Miller,
Commissioner Pawlowski, Commissioner Kozelski and Chairman Kent Wilson on May 9th, 2017 by the
Gallup City Council.]
ITEM THREE: April 2017 Building Permit Activity Report – Reviewed and not discussed.
Commissioner Dooley did have a question for CB not related to the permit report but a question regarding
new construction with a foundation, not a slab, if a crawlspace was required to be vented. CB confirmed
that a crawlspace should be vented; depending on the square footage of the crawlspace there is a

calculation used for determination. Commissioner Dooley continued to ask if a home that was built in
2012, would it fall under that regulation. CB affirmed that it did that venting is required for a crawlspace
and attic. Commissioner Dooley continued that for a final approval for a Certificate of Occupancy that
should have been checked. CB affirmed that was correct. CB anticipated further questions to which
Commissioner Dooley responded she did not want to go on record.
Madam Chair, Mackenzie-Chavez asked if there were any further questions or statements. Commissioners
discussed the recent New Mexico League of Zoning Officials training that some attended. Discussion
transitioned to current procedures of the meeting. CB said that there are areas where improvement is
needed and he will be meeting with the Chair and Vice Chair to outline how meetings are to be held,
testimony, cross examination, closing the floor and to open it for discussion for the commission. Then they
will get with the rest of the Commissioners; this will have to be advertised as a public meeting. CB
continued discussion on the appropriate way to make a motion and have discussion then approval. CB
discussed ex parte communication and how the Commissioners and staff cannot talk about the cases with
anybody other than inside the meeting, including staff.
Commissioner Long asked if a case had ever gone to district court. CB stated that cases have been
appealed to council and that is usually where it stops, but it is possible. Discussion turned to a previous
Conditional Use Permit Case that was heard by the Planning & Zoning Commission and appealed to the
Gallup City Council. CB stated that cases can even go to the Supreme Court. CB explained how the
State gives the cities authority to zone so that they can hear cases. Discussion continued on how the
previous Chairman Phil Garcia ran the meetings.

The Special Meeting of the Planning and Zoning Commission was called to order at 6:10 p.m. by
Chairman Kent Wilson.
Upon roll call, the following were present:

ITEM ONE: Implementation of new policies and procedures pertaining to public hearings held by
the Planning and Zoning Commission.
CB opened with an explanation of the meeting. We had a Planning and Zoning Commissioner
training with NM Zoning League Officials this past May where CB, Chairman Wilson and Vice-
Madam Chair Mackenzie-Chavez and Commissioner Kozeliski attended. We discovered a lot of
procedures that weren’t being done or followed. From that, we’re going to redo how we conduct our
meetings; how we take motions, how we close cases and take testimonies. Chairman Wilson drafted
the, “Planning & Zoning Commission Meeting Procedures” based on the training attended.
Chairman Wilson explained how we want to come up with a final format that will be followed at
every meeting by whoever is Chairing. We want to ensure that it’s consistent. A copy of the format
will be in our binders so each Commissioner will know exactly where we are in a meeting. After
being more educated in this matter, we want to correct our procedures in order to provide a more
effective and efficient meeting for our community. We will go through just like a regular meeting,
except that we will stop at any point to clarify or rewrite if necessary.
Chairman Wilson explained that if there is a case coming before the Commission that represents a
conflict of interest the Commissioner will have to recuse himself/herself. Commissioner Dooley
asked if they can sit (on the stand) until the case is over. Chairman Wilson responded yes and when
case is presented Chairperson will state, “Commissioner Dooley may recuse herself from Case#____.”
That way it’s on the record. CB stated if it were their (Commissioner’s) actual item, they could speak
at the podium to testify after being sworn in. If a Commissioner wants to make a comment personally
(ex: I think this should go through because it’s good for the community), CB recommends not doing
because that’s opinion; not fact. Commissioner Miller asked what to do if he recuses himself and
there is no longer a Quorum. Chairman Wilson stated that we will have to postpone to a future date.
It is the responsibility of Chairman to recuse Commissioner when case comes up.

CB stated the reason for the 3 minute limit is because some people get long winded and you can lose
control of a meeting. But it’s at the Chairperson’s discretion to lengthen and if a person is duplicating
statements Chairperson can also let them know.
Discussed how Commissioners may ask questions of any party at any time, but can’t state comments
or opinions. This is not the time to thank the individual for work done in community. Chairman
Wilson stated that we’re always discovering facts that lead to their recommendation.
Chairman Wilson stated that when they want to speak, since it’s a Quasi-Judicial meeting it’s proper
to say, “Mr. Chairman” or “Madam Chair.” Once they’re recognized, they can speak. Commissioner
Kozeliski asked if it was okay if they put up their hands instead. CB stated no, because it has to be
stated on the record. Also, the rest of Commissioners need to wait until done speaking. Need to be
consistent all the way through.
Chairman Wilson stated we will give the general public a meaningful opportunity to be heard even if
doesn’t have facts. Sometimes people just want to know what’s going on. At the Chairman’s
discretion the time limit can be lengthened. CB warned them that we’re always going to get an
opinion from the public, but Commissioners can’t state their opinions. It’s the Commissioners who
need to weed out and get to the facts.
CB stated that after Commissioners hear the case they immediately vote. Based on what they just
heard they need to make their decision, based on facts. Reminded them that they don’t need to make
their decision at that meeting, can think about it and decide later. If they’re wanting to open a
discussion they can and state why/how they came to their decision (ex: I made my decision because it
met the criteria.) But if they don’t want to state anything that’s fine too. It’s not meant to debate or
try to convince each other otherwise. Commissioner Long stated that we now have to be very careful
what we say when we discuss a case. Chairman Wilson recalled prior Chairman who expressed his
opinion very freely and now Randy is saying that’s illegal and can get us in trouble. CB stated that if
after having discussion Commissioner wants to change their vote they can.
Chairman Wilson noted that when we read the Case Number; it’s just the number, not the entire
description.
CB gave an example of a setback variance that didn’t meet Code requirements where Staff
recommendation was to disapprove request. If they’re basing decision off opinion and not code, then
they’re not following the rules. Commissioner Long stated that we’re all here for the good of the
community and we want to see it flourish. Chairman Wilson added that our job is not to rubber stamp
Staff’s recommendation; it is to discover if the facts support Staff’s recommendation. CB added that
it’s up to Commissioners how they want to vote; they don’t need to go with his recommendation. But
be prepared for ramifications of lawsuits. Have to go by the law; not opinion. We support code!
Commissioner Dooley asked if they’re covered by liability insurance under The City of Gallup. CB
stated yes they will be defended, but if’s its pure negligence on Commissioner’s part, they will be held
liable. Remember that anyone can be sued personally. For example, ex parte; making deals outside of
the hearing. You can’t discuss a case outside of this setting with anybody. Whole purpose of the

Open Meetings Act is for transparency. Property and land use is one of the most litigated laws.
Discussed different actions, which all require a motion:
-Approve/Deny
-Executive Session- Commissioners meet privately (without Staff CB)
-Table- lay aside and bring up later during the same meeting (ex: if someone is on their way)
-Continue- move case forward to a specified time (ex: next meeting)
-Postpone- put off to a specified time indefinitely
Chairman Wilson stated that he thinks it would be a good idea to put land use definitions in their
binders. So they can read and make sure they know what’s going on. Will also have a copy of the
newly revised, “Planning and Zoning Commission Meeting Procedures.” Also spoke about the
formatting of the Meeting Minutes; record of decisions made; not what they thought. Just hit the high
points; not verbatim. Suggests sending our “Planning & Zoning Commission Meeting Procedures” to
Randy and get his blessing.
Commissioner Dooley asked about The Gallup Task Force (GTF) letters and why sometimes there are
no comments. CB explained the reason we have the GTF, it’s for all different departments (Water/
Waste Water, Electric, Engineering, Solid Waste, Fire and Planning & Zoning) to be informed of
what’s going on and if it impacts them. That’s their opportunity to comment and say what needs to be
done. They do have a deadline to submit comments and it’s their responsibility. If CB sees some red
flags, he’ll address it and decide if that Department needs to be present. CB does try to catch stuff and
remind them. If they make no comment, then he assumes they’re good with it. If it later comes up
that they missed something, it’s on them. Commissioner Dooley asked if they can continue to next
meeting to request the Department head be there. CB stated that’s up to them, but would need to vote
on it. Commissioner’s main job is to protect the health and safety. Commissioner Mackenzie-Chavez
stated this is a good point because she always assumed “No Comments” meant everything was okay.
Now she knows to look at that a little more closer. Commissioner Miller suggested making a
statement on the GTF letter, “Those who don’t complete comments will be required to attend P&Z.”
If Commissioner reads the agenda prior to meeting and realizes that they want Animal Control there,
they can’t tell CB or anyone because that’s ex parte. But CB will try his best to anticipate who needs
to be there.
If have a closed session, Staff (CB) can’t go in. Keep in mind Commissioners are the decision makers
and Staff is just there to present.
Commissioner Miller asked if they can go on their own to look at property when receives agenda prior
to the P&Z Meeting. CB explained that if the property is on their way home, we’re not going to ask
them to take a different route. As long as they’re not intentionally going there. If you do go
specifically to that property and look at it by yourself, that’s ex parte communication. The correct
way to go about this is to request a site visit during the P&Z Meeting, which they will need to vote on.
In that case, Chair reconvenes at site (no talking) and reconvenes at the meeting.
Commissioner Long wanted clarification that they can’t have discussion during testimony. CB stated

that is correct. Commissioner Mackenzie-Chavez stated that if that does happen, a Chairperson can
hit the gavel and say, “Point of order.” CB stated that the Chairperson’s job is to keep the focus on the
facts of the testimony; keep the meeting under control.
Chairman Wilson stated this is the benefit of getting involved in the NM Planning & Zoning League
meetings. If Commissioners can possibly attend those; we’re getting so much good out of it. It’s
bringing this group of Commissioners to a higher standard and maybe an exceptional one by the state
and that would be wonderful. We will have some more important decisions as land gets developed.
We want to do what’s right for the community. We need to stay sharp and informed.
Commissioner Kozeliski stated there is a Request for Proposal (RFP) for a new Code. CB stated we
will have 1st Public Meeting on August 1st and 2nd, 2017. Will be able to review that internally before
presented.
Commissioner Dooley stated that she has attended a meeting in Albuquerque (NM Planning & Zoning
League) and it was very beneficial. Recalls one year when Randy came here and does think we
should consider having him come maybe every 3 years. CB will see if he’s available and thinks it is a
good idea as well.
