Upon roll call, the following were present: Vice-Madam Chair K. Mackenzie-Chavez Commissioner F. Pawlowski Commissioner F. Kozeliski Commissioner M. Long Commissioner L. Miller Upon roll call, the following were absent: Commissioner J. Dooley Chairman Wilson asked if any Commissioner had a conflict of interest for any agenda item, if so to recuse him/herself prior to discussing the particular item. Chairman Wilson stated anyone wishing to speak limit their comments to three minutes and don't duplicate a previous point. Will have one opportunity to testify. ITEM ONE: CASE # 17-01100002: Application was withdrawn by appellant and the Commission does not need to take any action. No discussion on Item One. ITEM TWO: CASE # 17-01000001: Present before the Planning and Zoning Commission for review and recommendation to City Council. Request by Leo Fisher, property owner, for The City of Gallup to vacate the 10 Foot Public Utility Easement (P.U.E.) north of Mr. Fisher's property in order to construct a carport to property line. The property is located at 1010 Patton Drive; more particularly described as Lot 1, Block 1, Southfork Subdivision Unit 1. CB used the overhead screen to display the area located on Patton Drive in the Southfork Subdivision. He explained that the applicant is requesting to vacate a 10 foot public utility easement (P.U.E.) in the northern boundary line. He displayed the subdivision plat showing the 10 foot public utility easement and how it runs along the north property boundary line. There's also a 20 foot wide public utility easement line that runs along the length of the backside of the subdivision, which will remain intact. Displayed another subdivision plat that’s immediately adjacent to the north of Mr. Fisher's lot, which he also owns. There's a 10 foot P.U.E. on the neighboring lot as well. They're two easements butting up next to each other. The request to vacate the easement is for a couple of things; The City is not using the easement at this time and has no plan to locate utilities within that easement. CB explained that it’s kind of typical to put easements along the borders of boundaries of subdivisions when they're first platted, just in case. In this case, all of the lots are served so there's no need to develop utilities within that easement. The Gallup Task Force did review the request and they did not have an issue with vacating that portion of the easement; its 10 feet wide and 219.99 feet long. The issue comes with the construction of the carport. CB displayed the GIS Map explaining that the applicant wants to construct a carport to the property line. The Code requires that an accessory structure meets a setback minimum of five feet (corrected himself saying it's actually 10 feet) from the property line. The vacation of an easement will not negate that requirement; they'll still have to meet the setback regardless if the property owner owns the adjacent property. The Code doesn't give exceptions for properties that are owned next to each other; it goes by the property boundary lines. Anything that is attached will have to comply with the principal structure setbacks, which is 10 feet. If it's detached it will have to be separated a minimum of 10 feet from the principal structure and then 5 feet from the side lot line. CB wanted to make clear that the vacation of the Planning and Zoning Commission Meeting August 9th, 2017 Page 2 of 5 easement will not relieve that requirement of the setbacks. But the vacation of the easement is not a concern of The City's right now and they have no problem vacating the easement. Just to get it off the property and it's free and clear. Vice-Madam Chair Mackenzie-Chavez asked why the two easements are put in. CB replied that the subdivisions were platted at different times. This one was first and when Southfork Subdivision came in the easement was placed on this boundary line. Guessed maybe at the time they were anticipating to put electrical lines through there. But the way that it's configured now, it's not required or needed to serve the property. If this is ever subdivided they'll probably have to extend on the backside. Commissioner Long asked to view the displayed GIS Map with the water, sewer and electric layers off. CB showed the water line that runs a length of Patton Drive and where the sewer line terminates and picks back up going north. Showed where there's a void in the sewer. Commissioner Miller asked about electric. CB showed where the electric runs on the frontage, which is underground. Commissioner Miller asked if there's any natural gas in the area or is it on propane. CB said he doesn’t know because they don't service the gas. He deferred the question to property owner, Leo Fisher. Mr. Fisher stated that all the houses do have gas, but it's all through the street. Commissioner Kozeliski asked if they approve to vacate the land, is the carport actually going to be located on that vacated land. He noted requirement of 10 foot setback from boundary line. CB clarified that the side yard setback for MH-1 zone is 10 feet for the principal structure and 5 feet for accessory structures. By vacating the 10 foot easement it will give the property owner an extra 5 feet to work with. But the property owner will have to be setback a minimum of 5 feet if it's detached. Chairman Wilson added that it's 10 feet if it's attached. CB responded that was correct. Chairman Wilson asked if anyone wanted to speak in favor of this case to approach the podium and state their name. Property owner, Leo Fisher stated that he does own both sides (lots) and understands the codes. He’s previously served on City Council for California. Estimated the length from the existing structure to the property line is about 35 feet, which includes the easement. The structure he wants to put up is 18 feet wide and thinks if they vacate he will satisfy the 10 feet. He researched and agrees to why the garage would need to be up against the structure. But would allow him to go within 5 feet of the property line and still have that distance from the property line to the structure that he wants to put in and there's still a 10 foot gap. He appreciates the consideration and the help of CB and Roman. This is a structure he’s been wanting and it’ll help increase his property value. The acre and a half beside it, which they own will never be built on. All power, all water and all electric is on the street. Claims the easement has been there almost 18 years. Being that it’s trust land behind them, it'll be a long shot to ever build on that; no reason to put electric, water or power through there. Previously spoke with the utility & water departments who said the same thing as well. Hope they can help him with this and make his life easier. If not, will have to go back to the drawing board. Miller (Yes) CB reminded Commission that the approval tonight is for recommendation to City Council for approval of this request. Explained to Mr. Fisher that he'll have to go before City Council on August 22nd for final approval. They will carry this recommendation to Council. ITEM THREE: CASE # 17-01100003: Review Open Meetings Act for ratification of corrections to Resolution # RP2017-11 adopting The Open Meetings Act. CB stated this is the ratification of corrections to the resolution that was adopted in January 2017. After going through training he noticed there were certain things left out of the ordinance. The main one was the City's website, which has now been added to this resolution. Also the language in the original resolution referred them to the Land Development Standards section that deemed the reasonable time period. The section that they referred to didn't have that in it, so it was removed. He went off the boilerplate resolution that was provided in his materials at the training. So now it’s in compliance with the language for the resolution, per state law. Tonight he is asking for the Commission to ratify corrections to this resolution and adopt a new Open Meetings Act resolution that'll carry them through December. In January they'll adopt a new one.
