The property is located at 610 West Mesa Avenue; more particularly described as Block 55 Lot 15, & The W. 12 ½ of Lot 16, O.T.S. Addn. ITEM TWO: CASE # 17-00300001: Request by Itaf Rashid, property owner for Concurrent Preliminary and Final Plat approval of a Minor Subdivision; Replat No. 1 of Lots 3, 4, & 5, and 16’ Wide Alley A Portion of Block 1, Lebeck-Atkins Subdivision. The property is located to the East of 1811 W. Highway 66 & 1830 Barbara Avenue; containing 4.4475 acres. This item will also go before the City Council for final approval at its regular meeting to be held on November 28th, 2017. Upon roll call, the following were present: Vice-Chair K. Mackenzie-Chavez Commissioner J. Dooley Commissioner F. Pawlowski Commissioner F. Kozeliski Commissioner M. Long Upon roll call, the following were absent: Chairman K. Wilson Commissioner L. Miller Madam Chair Mackenzie-Chavez asked if any Commissioner had a conflict of interest for any agenda item and if so to recuse him/herself prior to discussing the particular item. Upon roll call, the following votes were: Vice-Chair K. Mackenzie-Chavez (No) Commissioner J. Dooley (No) Commissioner F. Pawlowski (No) Commissioner F. Kozeliski (No) Commissioner M. Long (No) Presented to the Madam Chair and Commissioners for their approval were the minutes of the September 13th, meeting. Commissioner Pawlowski motioned for approval of the minutes as presented. Seconded by Commissioner Dooley, A.V.A. Motion Carried. Upon roll call, the following votes were: Commissioner F. Pawlowski (Yes) Commissioner J. Dooley (Yes) Commissioner F. Kozeliski (Yes) Commissioner M. Long (Yes) Madam Chair Mackenzie-Chavez administered the oath required by state law for public forum. Madam Chair Mackenzie-Chavez stated anyone wishing to speak limit their comments to three minutes and not to duplicate a previous point; they will have one opportunity to testify. Planning and Zoning Commission Meeting October 11th, 2017 Page 1 of 5 ITEM ONE: CASE # 13-00200008: Request by Khalaf Investments, Inc., property owner, for approval of corrections to the final plat of La Paloma Subdivision Unit One, containing thirty-four (34) lots. CB Strain explained that when the final plat was recorded at the county the McKinley County Assessor’s Office discovered some typographical errors. The Planning & Zoning Commission previously approved that plat, so to officially correct the final corrected plat has to return to the Commission. Once the corrected plat is approved it can be recorded. Thus, the corrected plat will replace the original previously recorded plat. CB used the overhead projector to display the corrected plat. He pointed out the errors that were corrected such as, adding the fifty (50) foot right- of-way in the legal description and revising metes & bounds measurements. He further explained that when plats are submitted they are expected to be accurate. The engineers are paid to review and finalize plats professionally; it’s their responsibility to submit a correct plat. The City’s part is to ensure that all procedures are followed and all the required signature lines and data are on the plat. Since errors were found the corrected final plat was resubmitted for ratification of the corrections. Commissioner Dooley asked if that phase was all zoned RS-1. CB responded that it's RS-2. It's all single family residential, just smaller lot sizes. Madam Chair Mackenzie-Chavez asked if there were any further questions by Commissioners; there were none. CB continued to explain that the presence of the applicant was not required, since they're just correcting errors on the plat. This action is a City action. Madam Chair Mackenzie-Chavez asked if anyone wished to speak on the case; there was no response. Madam Chair Mackenzie-Chavez stated the hearing was closed. Motion to approve or deny the request for Case Number 2013-00200008. Commissioner Kozeliski motioned for approval of Item One. Seconded by Commissioner Pawlowski, A.V.A. Motion Carried. Dooley (Yes) ITEM TWO: CASE # 17-00600003: Request by Gallup Holding & Investment Corp./Rick Murphy, property owner, for the rezoning of approximately 1.5812 acres FROM Rural Holding Zone Planning and Zoning Commission Meeting October 11th, 2017 Page 2 of 5 (RHZ) TO Single Family Residential District (RS-2). Said property is located within the east portion of Lot 2A Replat No. 1 of Lot 2 Woodard Subdivision Unit 1 and Tract 1-A, Golf Course Subdivision Unit 2. CB Strain explained that the applicant (Rick Murphy) recently went through the Administrative Subdivision process to reconfigure a lot and didn’t need to go through the Commission for approval because there were no more than two (2) lots involved. CB used the overhead projector to display the lots using the GIS map. He explained how the applicant and prospective buyer started with a huge tract of land and a smaller (developed) lot. A portion was carved off of the tract of land and it was added to the smaller lot, which reconfigured each side. There are still two (2) lots, just different sizes. CB pointed to the lots showing how they’re each sitting in different zoning districts RHZ and RS-2. The reconfiguration created a situation where there's one lot (east) with two (2) different zoning designations. In order to clean it up the applicant has to request a rezone for the portion that was reincorporated. Basically it’s a housekeeping thing; there can’t be one lot with two zoning designations. Furthermore, the Planning & Zoning Commission are the only ones who are authorized to rezone property. Thus the reason the case is being presented. The entire lot will be rezoned RS-2 Single Family Residential District and will be in compliance with the Zoning Ordinance. The large tract of land will remain RHZ Rural Holding Zone. Madam Chair Mackenzie-Chavez asked if there were any questions by Commissioners. Commissioner Kozeliski asked if Plateau Drive will be open anytime in the future. CB responded that to his knowledge Plateau Drive will stay as it is (a dead end). There are no immediate plans to extend through, unless the larger tract is developed and further subdivided. Commissioner Kozeliski asked if the applicants could someday request to put back the way it was before subdividing it. CB indicated that if they chose to they could, but the lots would have to be replatted again and doesn't think that's their intent. The intent was to give that property owner more land; instead of having a smaller triangle lot, they now have a bigger lot. Overall, the owner will be gaining more acreage. Madam Chair Mackenzie-Chavez asked if the zone change would change any allowable building sizes or setbacks. CB stated that once the rezone is complete, any further development of the lot will have to comply with the RS-2 district regulations. Commissioner Kozeliski asked if the piece of land currently has anything on it. CB explained that the (west) lot is vacant, but the (east) lot has an existing house. CB used the overhead projector to display imagery from the GIS map. Commissioner Dooley asked if there was a dedicated easement or if it would come into play when Plateau Drive possibly hooks up to Plateau Circle. CB responded that with this action tonight, it would not and that there is no reason to dedicate an easement at this time because there are no utilities going through there. Any proposed developments of that property in the future would be handled with that subdivision. Any new right-of-ways, public utility easements or anything needed to serve the newly platted area would be handled at that time. CB emphasized that it’s simply a rezone from a portion carved off a tract of land that was incorporated into a smaller lot. The Planning and Zoning Commission Meeting October 11th, 2017 Page 3 of 5 applicant is not changing the service of the lot or anything that would require an extension of utilities or any improvements other than what's there. Commissioner Dooley asked if a road were brought through (Plateau Drive), would it be the responsibility of the land owners to build. CB stated that she was correct. He explained that the applicant would have to go through the subdivision process, dedicate right-of-ways, subdivide the lots as desired and make necessary improvements. Commissioner Dooley asked CB to define RS-1 and RS-2. CB stated that RS-1 and RS-2 are both single family residential districts and the difference is that RS-1 has larger lots (9,000 square feet) and deeper setbacks (25 foot front/rear and 8 feet sides). The RS-2 zoning district has 6,000 square foot lots and 20 foot setbacks front/rear and 5 feet sides. Commissioner Dooley asked if the homes surrounding this area are large lots. CB clarified that those sizes are just the minimum, so the property owner could exceed that if they wanted to. Commissioner Dooley asked if at the time of development, did the developers determine whether it should be RS-1 or RS-2. CB responded that the lot will remain RS-2; can't spot zone. Commissioner Dooley was confused so she clarified; when the Woodard Subdivision was brought in as an RS-2, in her opinion it should've been RS-1. CB used the map to show how the entire subdivision is under RS-2 and to be consistent with current zoning, the subdivision has to be RS-2 as well. CB assured her that they’re not changing the subdivision, just rezoning the lot to match the lot that it's being incorporated into. Commissioner Dooley stated that she thinks the subdivision up the hill should've been RS-1 because those are large lots and homes. CB stated he understood what she was trying to say. He explained that the lot size requirements are minimum measurements and if they want to exceed that they can. Sometimes smaller lots are replatted to larger lots, but that doesn't mean they need to change the zoning. As long as the lots meet the minimum requirements they're legal. In other words, property owners can go above the required lot size, just not below. Madam Chair Mackenzie-Chavez added that there are some topographical issues with that as well. CB agreed, stating that a lot has to have at least a 35% buildable area when initially platted. If not, the developers can do improvements to make it buildable. He clarified that the zoning will stay the same and the large lots do not make a difference; the lots just have to meet the minimum measurements. Madam Chair Mackenzie-Chavez asked if anyone wanted to speak in favor of the case to approach the podium and state their name. Property owner, Rick Murphy stated that they're just increasing the size of the lot in an existing subdivision. They're not changing anything other than making a lot bigger. It's a very small lot in that subdivision and they're increasing size of it and that's all it is. Madam Chair Mackenzie-Chavez asked if there were any questions by Commissioners. The Commissioners had no questions. Madam Chair Mackenzie- Chavez stated anyone wishing to speak against this case, this was their time to come to the podium and state their name. No opponents came forward. Madam Chair Mackenzie-Chavez stated the hearing was closed. Motion to approve or deny the request for Case Number 2017-00600003.
