PUBLIC HEARINGS
ITEM ONE: CASE # 17-01100004: Request by Hannah Sehn, property owner, appealing
an Administrative Decision requiring a twenty feet (20’) front yard setback in a Single Family
Residential Zoning District (RS-2), as required by section 10-4B-1:D.1 of the City of Gallup Land
Development Standards. The property is located at 318 Valentina Drive; more particularly
described as Lot 12, Block 8, Zecca Height Addition.
ITEM TWO: CASE # 17-01100005: Request by Chris Muniz to rename McBride Circle to
Lisa Court. The cul-de-sac is located east of Jay Street between Marcella Circle and Clay
Avenue; further described as Lots 7-A thru Lots 14-A, Block 2, Rocky View Subdivision Unit #2.
This item will also go before the City Council for final approval at its regular meeting to be held
on January 9th, 2018.
ITEM THREE: CASE # 17-01100006: Annual Open Meetings Act, Resolution #
RP2017-16. The Open Meetings Act requires that the Planning and Zoning Commission (at
least) annually review what constitutes reasonable notice to the public of its meetings.
Accordingly, the resolution is presented to the Board for consideration and approval.

The special meeting of the Planning and Zoning Commission was called to order at 6:07 p.m. by
Vice-Chair Keegan Mackenzie-Chavez.
Upon roll call, the following were present:

Madam Chair Mackenzie-Chavez asked if any Commissioner had a conflict of interest for any
agenda item and if so to recuse him/herself prior to discussing the particular item.

minutes and not to duplicate a previous point; they will have one opportunity to testify.

ITEM ONE: CASE # 17-00700003: Request by Rebeca Rodriguez, property owner for a
Conditional Use Permit to allow the operation of a restaurant in a Multiple-Family Residential
District (RM-5). The property is located at 610 West Mesa Avenue; more particularly described as
Block 55 Lot 15, & The W. 12 ½ of Lot 16, O.T.S. Addn.
CB Strain explained that a restaurant is permitted in the Multiple-Family Residential Zoning District
(RM-5) as a Conditional Use, per the City of Gallup Land Development Standards. C.B. referenced
a previous situation where Genaro's Restaurant wanted to remodel, but the Code at that time didn't
allow restaurants to operate within an RM-5 Zoning District. Later the Code was amended to allow
restaurants in a RM-5 Zoning District, which is why El Metate is permitted today. In 2006 when a
sit-down restaurant was not permitted in a RM-5 Zoning District, El Metate had a business license to
operate only as a takeout restaurant. Eventually, the owners moved tables and chairs inside and
started operating illegally with a sit-down restaurant. In between that time the Code did change.
When ownership changed, the new owner applied for a business license and was informed that a
Conditional Use Permit was required in order to operate as a restaurant. However, the owner never
submitted a Conditional Use Permit application. They continued to operate illegally and the case
was forwarded to the City Attorney's Office, but no action was ever taken. Recently ownership has
changed, which has triggered the requirement again. The current owner, Rebeca Rodriguez wants to
continue the operation of a restaurant. When the Code was amended to allow restaurant operations in
the RM-5 Zoning District there were specific restrictions tied to it to protect the adjacent properties
and the surrounding neighborhood. One of those conditions was that any neighboring restaurants had
to be separated within one-thousand (1,000) feet of each other in any direction. Although, El Metate
and Genaro's Restaurant are non-conforming being within three-hundred and fifty feet (350') of each
other, they aren’t required to meet conditions since they were established prior to the Code change.
El Metate can remain and still operate as long as they comply with the conditions placed on the
Conditional Use Permit. However, if a new restaurant were to come into the RM-5 Zoning District
they would be required to meet the one-thousand feet (1,000') separation. CB used the overhead
projector to display the GIS map showing the property on Mesa Avenue and 6th Street. C.B.
explained that the El Metate Restaurant is in a residential neighborhood and because of that there are
safeguards in place to ensure it doesn't become a nuisance to the surrounding neighborhood. C.B.
went over the required conditions such as, screening, landscaping and parking. CB used the
overhead projector to display the GIS map showing where the driveway leads to the rear of the
property where the off street parking spaces will have to be installed; seven (7) standard and one (1)
handicap within ADA standards. The rear parking will also need to be installed with a hard surface
such as, concrete or pavement; currently it's dirt. C.B. also spoke about the front area where concrete
would have to be taken out in order to comply with the landscaping requirements. C.B. added that if
they decided to have outdoor lighting and/or seating there will be additional requirements such as,
not going beyond 9 p.m., maintaining light glare, level of music, etc. Prior to the issuance of El
Metate's City Business License all the conditions discussed will need to be met.

Commissioner Dooley stated her concerns about the driveway leading to the parking at the rear of the
property. C.B. used the overhead projector to display the site photos and GIS map showing the
driveway. Commissioner Dooley asked if the applicants own the property the driveway is located
on. C.B. stated yes and there is sufficient room for a vehicle to go through (one at a time).
Commissioner Dooley spoke about the landscaping requirements and asked if possible for them do
tree planter containers opposed to tearing up the sidewalk concrete to install trees. C.B. stated that
the Code requires ground cover and concrete is not acceptable as ground cover for landscaping.
Commissioner Miller asked if the applicant can use the alley as an exit. C.B. responded no; they
have to exit on Mesa Avenue and wouldn't be able to use the alley.
Madam Chair Mackenzie-Chavez stated her concerns about the screening with the narrow space
between the restaurant and adjacent property; will there still be room for driveway. C.B. explained
that on the east side of property they'll probably have to start past the existing structure. Madam
Chair Mackenzie-Chavez stated she had same idea as Commissioner Miller whereas customers can
enter through Mesa Avenue and exit out through the alley. C.B. stated that the alley is not really
used for that type of traffic; more for utility access.
Commissioner Kozeliski asked if the Commission is able to remove some of the landscaping
requirements (tress & bushes in front). C.B. stated that they could, but would have to rewrite the
Code, also reminded Commission that those requirements were for beautification. C.B. added that if
the Commission wants to require concrete sidewalks and dirt parking lots it's up to them, but has to
realize that they would be violating the Code.
Commissioner Dooley stated her concerns about not having enough room in the front of property for
landscaping since there is a ramp there. C.B. stated that it is feasible and if it is entirely infeasible to
comply with the three-hundred & fifty square feet, the applicant needs to comply with as feasibly
close as possible. C.B. stated that he understands that older neighborhoods with small areas it's more
difficult to comply with, but still needs to list what the Code requires. Commissioner Dooley stated
that she agreed that they need to stay within the Code, but also wants to maintain sidewalks. She
spoke about how buildings are built so close to the curb and street they do accent landscape with a
planter; that’s what started that suggestion. C.B. stated that it’s not an exception in the current Code,
but could add that in there with the rewrite if wanted to. Discussion about problems that arise from
allowing people to use planters for landscaping.
Madam Chair Mackenzie-Chavez stated that it looks like (from the site photos) the property owners
are using the front area (where landscaping is being required) for two (2) parking spaces. C.B.
clarified that they're not recommending they use or remove the sidewalk area for landscaping
because that has to remain for pedestrian traffic, however what area is left over can be used for
landscaping.
Commissioner Kozeliski asked if the three-hundred & fifty square feet of gravel, can be included
with the sidewalks. C.B. responded no, not according to the Code. C.B. stated that they could put
decorative concrete or artificial turf for an alternative option.

Commissioner Kozeliski stated his concerns about property owners not being able to control blowing
dirt and weeds. C.B. stated they do have to maintain their property and it is their responsibility.
C.B. stated there was an objection letter submitted, which was included in the agenda packets (page
1-10).
Madam Chair Mackenzie-Chavez read aloud the objection letter from M.K. Rosales and J. Lucero
dated October 30th, 2017.
Madam Chair Mackenzie-Chavez asked if there was any further questions by Commissioners.
Commissioner Pawlowski commented that it seemed the objection letter was due to the busy traffic.
Commissioner Pawlowski noted C.B.'s comments about having adequate space in the rear of
property, but asked if it would be possible to allow off road parking. C.B. stated there is enough
room in the rear of property for the required number of off street parking spaces, however can't
prevent people from parking on the street since it is permitted in that neighborhood for anybody.
Commissioner Kozeliski asked if could put a sign that states, "Don't park in driveway. Park in the
back." C.B. stated that they can only control what happens on the site of their property; they don’t
have authority to direct people outside of their property.
Commissioner Dooley asked if there was times frame that all that had to be done. C.B. stated it's up
to the applicant to get done before the City will issue a business license; didn't set a time limit. C.B.
explained the Letter of Agreement (page 1-3) between the City and Rebeca Rodriguez to allow
restaurant operations until the Planning & Zoning Commission meeting today. Furthermore, if the
Conditional Use Permit was approved, then all conditions required will need to be met before issuing
the new business license.
Madam Chair Mackenzie-Chavez asked if anyone wanted to speak in favor of the case to approach
the podium and state their name. Luis A. Rodriguez, property owner stated he is Rebeca Rodriguez's
husband and they understood they were given a three (3) month period to comply with the parking
spaces. Madam Chair Mackenzie-Chavez asked C.B. for clarification on that. C.B.initially stated
that there was no time frame, but corrected himself stating that it was deferred to ninety (90) days.
C.B. stated that property owners have ninety (90) days from the Letter of Agreement to install
everything that is required, if want to remain in operations. If the ninety (90) days passed and still
have an outstanding issue, will have to close until those issues are addressed and completed.
Commissioner Dooley asked if the restaurant can remain open while they're doing the work to meet
the conditions. C.B. responded yes, according to the Letter of Agreement.
Mr. Rodriguez addressed C.B.'s previous comments about the back area being dirt; it's actually
gravel. C.B. stated that gravel wasn't an acceptable hard surface.
Madam Chair Mackenzie-Chavez asked if there were any questions by Commissioners.

Commissioner Pawlowski stated his concern about the property owners not being able to meet the
conditions within ninety (90) days. Mr. Rodriguez stated that he didn't feel ninety (90) days was
enough time to complete either, especially having to do concrete in the winter; so he would also like
to request for an extension.
Madam Chair Mackenzie-Chavez asked C.B. if the Commission was allowed to grant an extension.
C.B. stated if the Commission wants to grant an extension beyond staff's recommendations, then the
Commission needs to deliberate. C.B. added that he's provided staff recommendations and
conditions; now it's up to the Commission to decide.
Madam Chair Mackenzie-Chavez stated the hearing was closed.
Motion to approve or deny the request for Case Number 2017-00700003. Commissioner Kozeliski
motioned for approval of Item One. Seconded by Commissioner Dooley, A.V.A. Motion Carried.
Madam Chair Mackenzie-Chavez stated the discussion can begin.
Commissioner Kozelisksi suggested giving property owners until April 2018 to complete.
Commissioner Miller acknowledged the difficulty of having landscaping installed in the winter
months and recognized the property owner's costs to meet the conditions. Commissioner Miller
stated that if the property owners do their due diligence they can show the City and Commission
they're doing their best to be in compliance.
Madam Chair Mackenzie-Chavez stated that if the Commission is going to grant an extension, they
need to be fair and clarify exactly what the property owners have an extension on.
Madam Chair Mackenzie-Chavez stated the hearing was now open.
Commissioner Dooley asked Mr. Rodriguez what type of hard surface they're going to install in the
back area for parking. Mr. Rodriguez stated he will have to look into it and see which is least
expensive, but his first choice would be concrete. Commissioner Dooley asked since gravel is
currently in the back area, can cars park back there. Mr. Rodriguez responded yes, but sometimes it
gets icy in the back area with the cold weather and customers tend to park on the street or sidewalk.
Commissioner Dooley stated that once the front landscaping was installed, it will certainly alleviate
parking on the sidewalk and suggested putting signs directing customers not to park on the sidewalk.
Mr. Rodriguez stated that he had a question for C.B., can he do the landscaping in the back instead of
in the front. C.B. responded no, the Code is very specific on the placement of landscaping. C.B.
stated the whole purpose for landscaping is for beautification; if it's in the back you can't see it and
defeats the purpose. C.B. stated another issue that needs to be made clear is that we moved
compliance with handicap parking space to a minimum and needs to be installed per federal
standards. C.B. added that if the rest of the back area is going to be left gravel until the spring (or

deadline Commission sets); property owner still needs to install the handicap parking space; that's
federal law compliance.
Commissioner Miller stated that the first three (3) conditions (of Resolution No. RP2017-14) are
mandatory for approval, but wanted to know if the property owners are going to have an outdoor
seating area. Mr. Rodriguez stated no. Commissioner Miller stated for property owners to do the
best to comply with what they can.
Madam Chair Mackenzie-Chavez stated the hearing was closed.
C.B. stated that if the Commission wishes to extend the time frame, he will need a specific date to
amend the Resolution No. RP2017-14; need a record of any modifications to staff recommendations.
Madam Chair Mackenzie-Chavez asked for motion of suggestions.
Commissioner Kozeliski made a motion to require handicap parking space to be completed within
ninety (90) days and rest for the landscaping and off street parking until June 1, 2018.
Madam Chair Mackenzie-Chavez stated that June 1, 2018 seemed too long of an extension and
suggested March or April 2018. Commissioner Kozeliski reminded Commission that in March and
April it is still very cold and not sure if property owner can complete by then. Commissioner Dooley
stated that June was too long of an extension and agreed with Madam Chair Mackenzie-Chavez for
March or April 2018. Commissioner Dooley also stated that the handicap parking space needs to be
installed as soon as possible.
Motion to approve extension request for Case Number 2017-00700003 to April 30, 2018, but require
handicap parking space at rear of property within ninety (90) days from today. Commissioner
Kozeliski motioned for approval of Item One. Seconded by Commissioner Dooley, A.V.A. Motion
Carried.

ITEM TWO: CASE # 17-00300001: Request by Itaf Rashid, property owner for Concurrent
Preliminary and Final Plat approval of a Minor Subdivision; Replat No. 1 of Lots 3, 4, & 5, and 16’
Wide Alley A Portion of Block 1, Lebeck-Atkins Subdivision. The property is located to the East of
1811 W. Highway 66 & 1830 Barbara Avenue; containing 4.4475 acres.

CB Strain explained that the current subdivision consists of five (5) lots and the property owner was
requesting for approval of replat to three (3) lots, whereas three (3) lots will be combined to one (1)
lot (Lot 3A). Generally when an applicant replats to reduce the number of lots and not more than
two, they can do it administratively if all required infrastructure is in place such as, curbs, gutters,
sidewalks, utilities and water/wastewater. C.B. stated, in this case Barbara Avenue which is on the
south side of the property is currently unimproved, so there are no infrastructures and no pavement
within that right-of-way. For that reason, the case has to go before a public hearing in order to defer
those utility extensions. C.B. explained that the Gallup Task Force has reviewed the request and
have no problem deferring the utility extensions. C.B. explained that the City has agreed to defer
extensions of city water & sewer lines, pavement, curbs, gutters and sidewalks along the entire
Barbara Avenue frontage to the proposed Lot 3A. C.B. used the overhead projector to display the
GIS map where the proposed Lot 3A will be and pointed to where the right-of-way and easements
are. C.B. stated that there are also some vacations of easements and right-of-ways, which will have
to go before City Council for final approval on November 28, 2017. C.B. spoke about the
background of the various vacations associated with case such as, the sixteen feet (16’) alley right-of-
way, ten feet (10’) utility easement and fifty feet (50’) easement. C.B. summarized that property
owner was requesting approval of the subdivision and for recommendation to City Council for
vacation of easements and right-of-way.
Madam Chair Mackenzie-Chavez asked if there were any questions by Commissioners.
Commissioner Dooley asked if the zoning will remain the same once the lots change from three (3)
to one (1). C.B. responded yes and added that the proposed lot also meets the dimensional
requirements for that zoning district.
Madam Chair Mackenzie-Chavez asked if anyone wanted to speak in favor of the case to approach
the podium and state their name. Property owner, Itaf Rashid approached the podium.
Madam Chair Mackenzie-Chavez administered the oath required by state law for public forum (since
Ms. Rashid didn't participate in the oath at the beginning of hearing.)
Ms. Rashid stated that she wanted to replat to one (1) lot, which will make it easier for her to sell and
pay property taxes for one lot, instead of separate lots.
Madam Chair Mackenzie-Chavez asked if there were any questions by Commissioners. The
Commissioners had no questions.

time to come to the podium and state their name. No opponents came forward.
