PROJECT NAME: Rezone from Single-Family Residential B (SFR-B) to Mixed-Use

PROJECT LOCATION: Vacant Lot east of Basilio Drive north of Clay Avenue where Clay
Avenue terminates / A Parcel of Land 18 15 17, Within the SW ¼ of Cont. 8.97 Acs M/L
DESCRIPTION: The property owner is requesting the one (1) parcel described above be
granted a zone change from Single-Family Residential B (SFR-B) to Mixed-Use Neighborhood
(MXN) Zone District. The reason for the rezone is so the new property owner can build multi-
family dwelling units there, which is not allowed in the existing SFR-B Zone District. The
proposed rezone of the MXN Zone District will be consistent with the zoning to the west.
The Rezone case will be presented to the Planning and Zoning Commission as soon as possible,
any conditions for approval should be included in staff’s recommendation to the Commission.

COMMUNITY PLANNER COMMENTS:
P1.) Request for rezone from Single Family Residential (SFR-B) Zone District to
Mixed-Use Neighborhood (MXN) Zone District is necessary to allow for multi-
family development.
P2.) Criteria for rezone is as follows:

• Due to changing circumstances of land use in the area, the proposed
district would be better suited to the area than the existing district.
• The social, economic or environmental interests of the public good would
be better served by the proposed district than the existing one.
P3.) Ok to proceed to public hearing.
CITY ENGINEER COMMENTS: The street frontage along the south property line
at Clay Ave. is without pedestrian infrastructure. Any infrastructure requirements
will be addressed during the permitting process. No issues with rezone.
WATER DEPARTMENT COMMENTS: No issues with rezoning. All other
requirements will be addressed during building permit process.
WASTEWATER DEPARTMENT COMMENTS: No issues with rezoning. All
other requirements will be addressed during building permit process.
ELECTRIC DEPARTMENT COMMENTS: The Electric Department has no
issues with rezone.
FIRE DEPARTMENT COMMENTS: Fire Department has no issues with rezone.
Future fire code requirements will be addressed during the building permit
process.
SOLID WASTE COMMENTS: No issues with rezone. Will address any further
issues during construction.
CENTURYLINK COMMENTS: No comments submitted by the given deadline.
NM GAS COMPANY COMMENTS: No comments submitted by the given
deadline.
COMCAST COMMENTS: No comments submitted by the given deadline.
NM DEPT. OF TRANSPORTATION COMMENTS: The proposed rezoning will
not impact any NMDOT facilities. The Department has no comments to provide.
