Chairman Wilson stated that the meeting was being live streamed for the public through the City of Gallup’s Facebook page. Upon roll call, the following were present: Chairman K. Wilson Commissioner K. Mackenzie-Chavez Commissioner F. Pawlowski Commissioner M. Long Commissioner L. Miller Upon roll call, the following were absent: Commissioner J. Cresto Commissioner K. Spolar Chairman Wilson asked if any Commissioner had a conflict of interest for any agenda item and if so to recuse him/herself prior to discussing the particular item. Miller (No) Presented to the Chairman and Commissioners for their approval were the minutes of the March 9th, 2022 regular meeting. Commissioner Pawlowski motioned for approval of the minutes as presented. Seconded by Commissioner Mackenzie-Chavez. Motion Carried. Upon roll call, the following votes were: Commissioner F. Chairman Wilson stated that anyone wishing to speak limit their comments to three minutes and not to duplicate a previous point; they will have one opportunity to testify. Chairman Wilson also reminded the Commission that the meeting was being live streamed so everyone needed to speak loud and clear for the public to hear. Planning and Zoning Commission Meeting April 13th, 2022 Page 1 of 4 ITEM ONE: CASE # 22-01000001: Request by Everett Bigthumb, on behalf of Gallup Christian Center, Inc., property owner, for the City of Gallup to vacate a 14’ wide, 188.21’ long utility easement within the property east of the existing building to allow the construction of a new building. The property is located at 2133 Cipriano Avenue; more particularly described as 2.08 acres M/L in NE ¼ Sec. 28 T15N R18W. This item will go before City Council for final approval on April 26, 2022. CB Strain began by explaining how the request was asking for a positive or negative recommendation to City Council for the vacation of an existing utility easement at 2133 Cipriano Avenue. The property owner, Gallup Christian Center also known as The Door Church wants to build a new structure on the property. CB used the overhead projector to display the GIS map showing the property’s location. He also pointed to the area where the electric line was located within the existing easement which would be vacated if the request was approved. CB explained how the property owner wanted to build a new structure which would be built directly over the existing easement. Being that they cannot build over an existing easement, the owner is requesting that the city vacate the dedicated easement. The city has deemed that the existing easement is no longer needed whereas the vacation is supported by staff. CB informed the Commission how the Electric Department was present to answer any technical questions they may have. It was a pretty straight forward request to vacate an existing easement so the owners were free to construct the proposed building. CB used the overhead projector to display the easement survey (Page 1-3) pointing to the area being vacated. The Gallup Task Force did review the request and had no issues with the vacation. The request will go before the City Council on April 26, 2022 for final approval. Chairman Wilson asked the Commissioners if they had any questions for staff. Commissioner Pawlowski asked if the existing building would remain on the property. CB responded yes; the existing building would remain and a second structure would be built. He informed the Commission that a representative from the church was present if they wanted to ask him. Everett Bigthumb approached the podium and introduced himself as the agent for Gallup Christian Center, property owner. Mr. Bigthumb stated that The Door Church was planning on keeping the existing building and building a new structure; they would not be connected and be separate buildings. He expressed his appreciation for the City of Gallup considering their request so they can move forward with their plans. Mr. Bigthumb pointed out how his letter stated that the proposed building was 12,000 square feet, however it would be 16,000 square feet. Their plans are to build where the easement is located, which is why they are requesting to vacate it so they can be in compliance with the city requirements. He again thanked the Commission for working with them on their request. Chairman Wilson thanked Mr. Bigthumb for speaking in favor of this case and asked the Commission if they had any questions. There were none. Chairman Wilson asked if there was anyone else wishing to speak in favor of this case. There were none. ITEM ONE: CASE # 22-00600002: Request by the City of Gallup, property owner, for the Rezoning of an Unplatted Tract of Land FROM Single-Family Residential B (SFR-B) Zone District TO Mixed- Use Neighborhood (MXN) Zone District containing 10.7 acres M/L. The property is generally located east of Basilio Drive north of Clay Avenue where Clay Avenue terminates. Planning and Zoning Commission Special Meeting April 20th, 2022 Page 1 of 4 CB began by explaining how the City of Gallup owned the property, which was currently zoned Single- Family Residential B (SFR-B). The tract of land is adjacent to the Mixed-Use Neighborhood (MXN) Zone District immediately to the west. CB used the GIS map to display the property’s location with the zoning layer. He pointed to the triangular tract that the city was requesting to rezone to the MXN Zone District. CB explained how the City of Gallup was in the process of doing a land swap with the Gallup-McKinley County Schools for the bus barn property. The city is soon going to construction with the new safety building along Boardman Drive whereas the current safety building will be demolished and a new one will be built in its place. During construction the Police Department will need an impound lot which is why the city is planning on acquiring the school’s bus barn property. It was decided that the school would swap their bus barn property with the city for the tract of land near Rocky View Elementary. The school wishes to develop the tract with teacher housing (multi-family) which is why the rezone is being requested this evening. Before the exchanging of land, the school requires that the tract be rezoned appropriately to accommodate their future development. CB emphasized how there was a large need of housing in Gallup especially for teachers. He explained how the rezone will simply move the zoning designation line being that the property to the west is zoned MXN. CB pointed out how the rezone would not cause an issue of spot zoning; just increasing the size of the MXN Zone District. CB stated that in this case the property owner, City of Gallup represented one hundred percent (100%) ownership of the property for the proposed rezone and as such was making a request for the zoning map amendment to the Planning and Zoning Commission. He reiterated the purpose of the request, which is to change the zoning designation from Single-Family Residential B (SFR-B) Zone District to Mixed-Use Neighborhood (MXN) Zone District to allow for multi-family development. CB read aloud the Zoning Map Amendment Criteria that the property qualified under: 3. Due to changing circumstances of land use in the area, the proposed district would be better suited to the area than the existing district. 5. The social, economic or environmental interests of the general public good would be better served by the proposed zoning district than the existing one. FINDINGS OF CONCLUSION: CB stated that the findings of staff for the proposed request met the Acceptable Grounds for Amending the Official Zoning Map per Section 10-5-B-d-i2 of the City of Gallup Land Development Standards. CB recommended approval of the rezone; Resolution Number RP2022-5. Chairman Long asked the Commissioners if they had any questions for staff. Commissioner Cresto asked for clarification on the zoning designation of Rocky View Elementary and why that rezone was not included with the action presented this evening. CB stated that the Rocky View Elementary property was zoned SFR-B whereas a school was a permitted use within that district. However, multi-family development is not a permitted use within the SFR-B Zone District, which is why they want to rezone to MXN to allow that type of use. CB informed Commissioner Cresto that there was no need to rezone the school at this time. Commissioner Mackenzie-Chavez asked how they would access their property. CB stated that along the southern property line is a dedicated right-of-way Clay Avenue which is where they will gain access. However, it is an undeveloped right-of-way which the developers will be responsible for at the Planning and Zoning Commission Special Meeting April 20th, 2022 Page 2 of 4 time of development. CB explained how all projects within the city are responsible for any required infrastructure including vehicular and pedestrian infrastructure. Commissioner Mackenzie-Chavez asked who owned the property to the west that was already zoned MXN. CB responded that it was a private property owner, however the small parcel on the corner where the Olivia Park was located was owned by the city. Commissioner Cresto asked CB if the Olivia Park property was also being exchanged with the schools. CB stated that just the triangular tract was being swapped with the school’s bus barn property. Chairman Long stated that the city initiated the zone change whereas CB Strain, Planning and Development Director presented the item on behalf of the city whereas they are the party speaking in favor of the case. Chairman Long asked if there was anyone else wishing to speak in favor of this case. Anthony Ciocco approached the podium and introduced himself. Mr. Ciocco stated that he was a resident who lived south of Zuni Drive In Road. As a resident, he wanted to state a few ideas and concerns he had with the area. Mr. Ciocco stated that the triangular tract was currently being used as a baseball field, archery range, dog park, and place to climb rocks. The Olivia Park is used quite often by the neighborhood whereas it is often at full capacity. He thought that as a consideration for the neighborhood, the developers could add more recreational space at the triangular tract to support the neighborhood. Mr. Ciocco wanted to mention how there was a pretty high population density in that area. He stated that where the road turns south to Old Zuni Drive In Road, they get a lot of trespassing back there, which is on Tribal Trust Land and Allotment Land. Mr. Ciocco spoke about the problems they have back there with people partying, drinking, and dumping trash. There have also been incidents where people dumped dead bodies back there. So, with the expansion of the multi-family use, more people will live there affecting the welfare of teacher housing. Mr. Ciocco just wanted to inform the Commission of his concerns for that area. Chairman Long thanked Mr. Ciocco for stating his concerns; his comments will be noted. Chairman Long asked the Commissioners if they had any questions for Mr. Ciocco. There were none. The existing business, Bridgestone Retail Operations, LLC has a hardship peculiar to the land being that the west and north sides of the property are built up to the property line leaving no room for an accessory structure. And the east and south side of the property is along a street frontage whereas there is no way for them to comply with the code. These hardships deprive the property owner of rights commonly enjoyed by adjacent property owners and would work an unnecessary and undue hardship upon the property owner and business. No building permit application has been submitted till such time as action is taken by the Planning & Zoning Commission. The Variance will be presented to the Planning and Zoning Commission as soon as possible, any conditions for approval should be included in staff’s recommendation to the commission. Existing structure is built out to the northern, western and southern property boundary lines. The property also has two street frontages, Coal Ave. and 4th St. These site conditions create a hardship peculiar to the land making it impossible to comply with the location requirements for accessory storage structures. P2.) Request for variance meets the minimum criteria set forth in Section 10-5-B- d-ii2 of the Variance Procedures of the Land Development Standards. P3.) Ok to proceed to public hearing. CITY ENGINEER COMMENTS: The proposed location of the enclosure would obstruct the clear sight triangle for the alley driveway to the North of the property. The driveway would have an obstructed view of traffic for anyone leaving the alley going Eastbound. The enclosure would need to be moved 20 feet toward the South property line from the Northeast corner of the property to comply with the Streets Clear Sight Triangle for Site Access and Driveways standard 10-4-B- c-iii-3-a. WATER DEPARTMENT COMMENTS: No issues with the City water system. WASTEWATER DEPARTMENT COMMENTS: No issues with the City sewer system.
