Chairman Wilson stated that the meeting was being live streamed for the public through the City of Gallup’s Facebook page. Upon roll call, the following were present: Chairman K. Wilson Commissioner F. Pawlowski Commissioner L. Miller Commissioner J. Cresto Commissioner K. Spolar Upon roll call, the following were absent: Commissioner K. Mackenzie-Chavez Commissioner M. Long Chairman Wilson asked if any Commissioner had a conflict of interest for any agenda item and if so to recuse him/herself prior to discussing the particular item. Upon roll call, the following votes were: Chairman K. Wilson (No) Commissioner F. Pawlowski (No) Commissioner L. Miller (No) Commissioner J. Cresto (No) Commissioner K. Spolar (No) Presented to the Chairman and Commissioners for their approval were the minutes of the April 13th, 2022 regular meeting. Commissioner Pawlowski motioned for approval of the minutes as presented. Seconded by Commissioner Cresto. Motion Carried. Upon roll call, the following votes were: Commissioner F. Spolar (Yes) Chairman Wilson administered the oath required by State Law for public forum. Chairman Wilson stated that anyone wishing to speak limit their comments to three minutes and not to duplicate a previous point; they will have one opportunity to testify. Chairman Wilson also reminded the Commission that the meeting was being live streamed so everyone needed to speak loud and clear for the public to hear. ITEM ONE: CASE # 22-00800001: Request by Eric Miller, SGA Design Group on behalf of Bridgestone Retail Operations, LLC, applicant in conjunction with Bonapace II, LLC, property owner for a Variance from Section 10-3-C-T1biii of the City of Gallup Land Development Standards regulating the location of an Accessory Storage Structure in areas between the façade of the principal structure and street frontage. The property is located at 400 West Coal Avenue; more particularly described as E. 11’ of Lot 21, All of Lots 22 thru 26, Block 32, OTS Addn. CB Strain began by explaining how Bridgestone Retail Operations wants to submit a building permit to locate a 10’x18’ accessory structure at 400 West Coal Avenue. He used the overhead projector to display the GIS map showing the property’s location. CB pointed out how the property was built all the way out to the northern and southern property lines. Firestone’s parking lot is on the east side of the building whereas there is no room for storage on the north or south lot. They’re also built right up against an alley. The reason the applicant is requesting to place a storage structure there is because Code Enforcement had issues with the way they were storing their tires. CB used the overhead projector to display a site photo where it showed the stacking of tires (a copy is attached hereto, marked as Exhibit A and made a part of these official minutes). CB spoke about how the transients were stealing tires and making make-shift shelters out of them whereas some were already set on fire. So, they need a place to safely store the used tires. CB continued by explaining how the property has a hardship peculiar to the land being that they have two street frontages and are built to the property line. Therefore, it makes it impossible for them to comply with the rule meaning that they meet the criteria for a variance. CB used the overhead projector to display the site plan (Page 1-3) pointing to the proposed location of the accessory structure. CB informed the Commission that the Gallup Task Force did review the variance request whereas the Public Works Department informed them they had to keep the clear sight triangle open for alley access. CB stated that the code said there must be a 25’x10’ clear sight triangle so when vehicles are exiting the alley, they’re able to see oncoming traffic. The applicant did make the change to their site plan whereas now the accessory structure is not within the clear sight triangle. FINDINGS OF CONCLUSION: CB informed the Commission that the request met the minimum variance criteria under Section 10-5-B-d-ii2 of the City of Gallup Land Development Standards. Therefore, CB recommended approval of the variance whereas there was a hardship peculiar to the land that prevented the owners from complying with the rule. Chairman Wilson asked the Commissioners if they had any questions for staff. Planning and Zoning Commission Meeting May 11th, 2022 Page 2 of 5 Commissioner Cresto stated that he understood the alleys ran one direction; east to west, but how do people know the way traffic actually flows. CB stated that normally the one-ways are designated and are marked as one-ways. Chairman Wilson stated that since the accessory structure was going to be built up against Fourth Street, he wondered if there was going to be any aesthetic requirements. CB responded yes; when the building permit is submitted, they’ll request that it be designed with the same color as the principal structure so it blends in. Chairman Wilson added how he thought it was pretty strange to build a structure so close to a street and was worried it may cause issues. CB pointed out how the Firestone business needs extra areas of storage for their tires whereas this was the only alternative to get it done. Chairman Wilson asked CB if it was a permanent accessory structure; CB responded yes. Chairman Wilson asked if the accessory structure could later be enlarged. CB stated that the Land Development Standards prohibited accessory structures from being more than ten percent (10%) of the gross floor area of the principal structure. As long as they stay within that ten percent (10%), it will be okay. CB added how they do not want to eliminate any more parking spaces than they need to. Although the accessory structure would be placed in a parking space, they would still be able to meet the minimum number of parking spaces. Commissioner Pawlowski asked CB if the accessory structure was going to be solely used for tires. CB responded yes; as far as he knew, but the applicant was present if he wanted to ask him. Eric Miller, SGA Design Group approached the podium and introduced himself as the agent for Bridgestone Retail Operations, LLC, applicant and Bonapace II, LLC, property owner. Mr. Miller stated that their intent was to only store tires in the accessory structure. He stated that they were going to place a roof on the structure whereas the total height of the accessory structure would be eight feet (8’) and there would also be fencing around it. Commissioner Pawlowski stated his concerns about not storing liquids in the accessory structure, which could cause a fire. Mr. Miller stated that he understood Commissioner Pawlowski’s concerns whereas they will only be storing used tires; no batteries, oil or fluid will be in there. Commissioner Miller asked Mr. Miller about the type of material and colors they would use when building the accessory structure. Mr. Miller stated that they normally use cedar. Chairman Wilson thanked Mr. Miller for speaking in favor of this case and asked the Commission if they had any additional questions. There were none. Chairman Wilson asked if there was anyone wishing to speak against this case. There were none. Chairman Wilson asked if there were any other interested parties wishing to speak to this case. Jon Pairett, Fire Marshal approached the podium and stated that he was in support of the variance. He spoke about how the downtown area has an issue with transients taking tires and building homes with Planning and Zoning Commission Meeting May 11th, 2022 Page 3 of 5 them or setting them on fire. Another fire issue they’ve dealt with at the tire shops is the fire code. Mr. Pairett explained how the fire code requires the tires to be stored at least ten feet (10’) away from the building. And with this property, ten feet (10’) away from the building is in the middle of their parking lot. So, there is no adequate place for them to store their used tires; unless they just put in the open parking lot. However, storing them in the open like that, people will take them and build houses or set them on fire. Mr. Pairett stated that the Fire Department supported the variance request in order to keep the building and downtown area safe. Chairman Wilson thanked Mr. Pairett for his comments and asked the Commission if they had any questions. There were none. Chairman Wilson stated that the hearing was closed. Motion to approve or deny the request for Case Number 2022-00800001. Commissioner Cresto motioned for approval of Item One. Seconded by Commissioner Pawlowski. Motion Carried. Spolar (Yes) CB wanted to inform the applicant that there was a ten (10) day appeal period. If no appeals are submitted, then the decision is final whereas they can submit their building permit. Rezoning smaller tract from Single Family Residential (SFR-A) to Mixed-Use Neighborhood (MXN), Rezoning larger tract from Rural Holding Zone (RHZ) to Mixed Use Neighborhood (MXN). Property owner wishes to develop property with mixed use residential development therefore the MXN Zone designation is appropriate. P2.) Both tracts currently meet all minimum dimensional requirements for the Mixed-Use Neighborhood (MXN) Zone District. P3.) Criteria met is as follows: “The social, economic or environmental interests of the public good would be better served by the proposed district than the existing one”. P4.) Ok to proceed to public hearing. CITY ENGINEER COMMENTS: The property frontage along Strong Drive is currently unpaved and without curb and gutter, and sidewalks. The property frontage along Philipina Avenue does have curb and gutter, however it is without sidewalks. The requirements for pedestrian infrastructure/street improvements will be deferred until the building permitting process. No issues with Rezone. WATER DEPARTMENT COMMENTS: Water Department has no issues with rezone. WASTEWATER DEPARTMENT COMMENTS: Wastewater department has no issues with rezone. ELECTRIC DEPARTMENT COMMENTS: Electric has no issues of rezone to Mixed-Use Neighborhood FIRE DEPARTMENT COMMENTS: Fire Department has no issues with rezone. Fire code requirements will be addressed during the building permit process. SOLID WASTE COMMENTS: No Solid Waste Issues CENTURYLINK COMMENTS: No comments submitted by the given deadline.
