ADDENDUM e) Pursuant to A.R.S. § 38-431.03(A)(3) and (7) for discussion and consultation with designated Town Representatives and legal advice with Town Attorney regarding the Town’s position in negotiations for the sale or lease of real property in the Heritage District at the northwest corner of Gilbert Road and East Hearne Way. AGENDA ITEM CALL TO ORDER RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION Pursuant to: a) A.R.S. § 38-431.03(A)(3) and (4) for discussion and consultation for legal advice with Town Attorney and Special Counsel regarding Town of Gilbert v. Taylor Morrison/Arizona, Inc. (Maricopa County Superior Court Case No. CV2015-096632); and b) A.R.S. § 38-431.03(A)(3) and (4) for discussion and consultation for legal advice with Town Attorney regarding Power Sales Contract No. 2017-4108-0417 with Arizona Power Authority (APA) to purchase Federal Preference Power generated at Hoover Dam and enter into a bill crediting arrangement with Arizona Public Service (APS) and/or Salt River Project (SRP) for electricity delivery; and  c) A.R.S. § 38-431.03(A)(3) and (4) for discussion and consultation for legal advice with Town Attorney regarding contingency transfer from the Economic Development Reserve Fund in the amount of $250,000 for fee reimbursements associated with the Orbital ATK Development Agreement; and d) A.R.S. Sec. 38-431.03 (A)(3) and (4) for discussion and consultation for legal advice with Town Attorney regarding accessory structure at 1090 S. 131st Street in Gilbert. If you permit your child to participate in the Council Meeting, a recording will be made.
