HUMAN RESOURCES – consider: a) adoption of revised salary structures; b) approval of implementation of compensation plan and pay for performance, to include use of full salary range for non-sworn performance merit adjustments within FY2017; and c) authorization to reapportion funds necessary for implementation and use of contingency as needed. ADDENDUM #2 8A. DEVELOPMENT AGREEMENT - consider adoption of a Resolution approving a Development and Disposition Agreement with CBDG Gilbert, LLC (Common Bond) for the sale and development of property located on the northeast corner of Hearne Way and Gilbert Road and authorize the Mayor to execute the required documents. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation may be offered by a person of any religion, faith, belief or non-belief, as well as Councilmembers. ROLL CALL COMMUNICATIONS FROM CITIZENS At this time, members of the public may comment on matters within the jurisdiction of the Town but not on the agenda. The Council’s response is limited to responding to criticism, asking staff to review a matter commented upon, or asking that a matter be put on a future agenda. CONSENT CALENDAR All items listed below are considered consent calendar items and may be approved by a single motion unless removed at the request of Council for further discussion/action. Other items on the agenda may be added to the consent calendar and approved under a single motion. 8. INTERGOVERNMENTAL AGREEMENT – consider approval of Intergovernmental Agreement No. 2017-1105-0453 with Maricopa County for development and operation of a wireless communications facility for public safety on Town property located north of the northwest corner of Higley Road and Ocotillo Road and authorize the Mayor to execute the required documents. 9. AGREEMENT – consider approval of Project Agreement No. 2017-7003-0467 with Maricopa Association of Governments for the Germann Road - Gilbert Road to Val Vista Drive Arterial Life Cycle Program, Project No. ST145, and authorize the Mayor to execute the required documents. 10. AGREEMENT – consider approval of License Agreement No. 2017-2105-0476 with Caliente Construction in the amount of $324.95 per month beginning September 14, 2016 for four months for use of Town owned land located at 28 East Vaughn Avenue for a construction trailer, construction staging and subcontractor parking and authorize the Mayor to execute the required documents. 11. AGREEMENT – consider approval of a second renewal of Lease Agreement No. 2005- 7101-0303 with the Gilbert Chamber of Commerce for the Town owned Heritage Annex Building located at 119 North Gilbert Road for a five-year renewal period and authorize the Mayor to execute the required documents. 12. AGREEMENT – consider approval of Cemetery Development, Operating and Maintenance Lease Agreement No. 2016-5001-0122 with Gilbert Cemetery LLC for the development, operation and maintenance of a cemetery and authorize the Mayor to execute the required documents. 13. CONTRACT – consider approval of Construction Services Contract No. 2017-2106- 0441 with Pro-Low Joint Venture in an amount not to exceed $1,052,964.78 for the Heritage Trail Middle Segment Project, Project No. PR006, and authorize the Mayor to execute the required documents. 14. CONTRACT – consider approval of Design Phase Contract No. 2016-7012-0253 with Morrison Maierle, Inc. in an amount not to exceed $876,512 for the Elliot District Park  Improvements, Project No. PR125, and authorize the Mayor to execute the required documents. 15. CONTRACT – consider approval and authorize the Mayor to execute the required documents: a) Purchase Order Contract No. 2017-1105-0452 with Taser International in an amount not to exceed $164,650 for body worn camera storage, licensing and warranty of 133 cameras; b) a General Fund Contingency Transfer in the amount of $35,000 for body worn camera storage, licensing and warranty of 32 cameras; and c) a General Fund Contingency Transfer in the amount of $6,000 to pay balance of tax for 133 cameras. 16. PARKS AND RECREATION - consider approval of the Gilbert Sports Coalition Membership Criteria, Policies and Operational Procedures as recommended by the Parks, Recreation and Library Services Advisory Board. 17. FINAL PLAT SP1544 - consider approval of the final plat for Festival at Santan Village located south of the southeast corner of Ray Road and Santan Village Parkway. 18. FINAL PLAT SP1538 - consider approval of the final plat for Weinberger East Transfer Station, located approximately one-quarter mile south of Guadalupe Road, adjoining the Union Pacific Railroad tracks, on the east side of Cooper Road. 19. TEMPORARY EXTENSION OF PREMISES – consider approval of a temporary extension of premises for Copper Still Moonshine Grill located at 2531 South Gilbert Road, Suite 101 for an event to be held on November 5 - 6, 2016. 20. TEMPORARY EXTENSION OF PREMISES – consider approval of a temporary extension of premises for Jimmy's of Chicago located at 884 East Williams Field Road, Suite 102 for an event to be held on November 13, 2016. 21. PERMANENT EXTENSION OF PREMISES – consider approval of a permanent extension of premises for 1455 American Grill located at 1455 West Elliot Road. 22. MINUTES – consider approval of the minutes of the Special Meeting of September 21, 2016 and September 27, 2016; Council Retreat September 22 & 23, 2016; and Regular Meeting of September 29, 2016. PUBLIC HEARING Items will be heard at one Public Hearing; at which time anyone wishing to comment on a Public Hearing Item may do so. Comments will be heard from those in support of or in opposition to an item. Hearings are noticed for 7:00 p.m. In order to comment on a Public Hearing Item, you must fill out a public comment form, indicating the Item Number on which you wish to be heard. Once the hearing is closed, there will be no further public comment unless requested by a member of the Council. After the Public Hearing, the Council may act on all items not requiring additional staff, public, or Councilmember comment with a single vote. 23. LIQUOR LICENSE – conduct hearing and consider approval of a Series 6 Bar Liquor License for Flipside located at 4874 South Val Vista Drive. 24. LIQUOR LICENSE – conduct hearing and consider approval of a Series 12 Restaurant Liquor License for Nicantonis located at 323 South Gilbert Road, Suite 111. 25. BONDS – conduct hearing and consider adoption of a Resolution authorizing the reimbursement of expenses for construction, maintenance of town streets and traffic lights from a future bond issuance. 26. ZONING Z16-06B - conduct hearing and consider adoption of an Ordinance amending the Town of Gilbert Land Development Code, Chapter I Zoning Regulations, Division 1: General Provisions, Division 2: Land Use Designations, Division 3: Overlay Zoning Districts, Division 4: General Regulations, Division 5: Administration, and Division 6: Use Definitions; Chapter III: Subdivision Regulations, Glossary of General Terms, to amend and reorganize the Land Use Table with new use definitions and regulate where uses are permitted. In addition, amendments will codify the product of a comprehensive review to clarify terms and add cross references where needed. In addition, amendments will resolve discrepancies, reflect current development standards and amend the glossary. 27. CODE OF GILBERT - conduct hearing and consider adoption of an Ordinance amending the Code of Gilbert, Arizona, by amending Chapter 10 Buildings and Construction Regulations, Article IX Utility Extensions and Connections, Division 3 Sewer, Section 10- 312 Connection Required, Expenses, Abatement Of Cesspools related to wastewater collection and septic systems. 28. CODE OF GILBERT - conduct hearing and consider adoption of an Ordinance amending the Code of Gilbert, Arizona, by amending Chapter 14 Business, Article VII Pawnbrokers, Junk Dealers and Secondhand Dealers, Section 14-201 Definitions, Section 14- 204 Reports to Police Generally. ADMINISTRATIVE ITEMS Administrative Items are for Council discussion and action. It is to the discretion of the majority of the Council regarding public input requests on any Administrative Item. Persons wishing to speak on an Administrative Item should complete a Request to Speak Form and indicate the Item they wish to address. Council may or may not accept public comment.  29. ADJOURN NOTICE TO PARENTS: Parents and legal guardians have the right to consent before the Town of Gilbert makes a video or voice recording of a minor child. A.R.S. 1-602.A.9. Gilbert Council Meetings are recorded and maybe viewed on Channel 11 and the Gilbert website. If you permit your child to participate in the Council Meeting, a recording will be made.
