MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF FRIDAY JUNE 19, 2020 AT 8:00 AM, VIRTUAL MEETING 50 E CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Jenn Daniels, Vice Mayor Scott Anderson, Councilmembers Yung Koprowski, Scott September, Bill Spence, Jared Taylor, and Aimee Yentes COUNCIL ABSENT: None STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Lisa Maxwell, Town Attorney Christopher Payne, and Mayor’s Aide Valerie Shaffer AGENDA ITEM CALL TO ORDER Mayor Daniels called the meeting to order at 8:00 a.m. PUBLIC HEARING 1. EMERGENCY ORDER - consider adoption of an Emergency Order requiring the wearing of face coverings in public. Town Attorney Payne outlined the three options presented to Council regarding the Emergency Order requiring the public to wear masks whenever they are in public. Option 1 is to take no action. Option 2 is to pass the Emergency Order requiring masks in public areas with penalties for people not wearing masks. Option 3 is to pass the Emergency Order requiring masks in public areas without any penalties. Mayor Daniels said the purpose of the Order is to encourage voluntary compliance based on the Governor’s Executive Order. Mayor’s Aide Shaffer gave a summary of the email received regarding the requirement to wear masks. Nearly 900 emails were received with 607 in support of and 262 against the requirement. Town Clerk Maxwell stated as of 7:00 a.m. over 1,800 comment cards were received with 825 in support of and 979 against the requirement. The list of people submitted comment cards is included at the end of these minutes. Rich Van Blurcum, Gilbert resident, said he is strongly opposed to requiring masks. He is a veteran and he and many others have fought for freedom. Adults can the decision of what is best for them. He believes this is a political move by the Governor and cities should all be consistent. Kerry Knicos, Gilbert resident, said she views wearing a face mask as a temporary band- aid which seems like a good option. She acknowledged this is a difficult decision for 1 Council and how the decision has been politicized. Colette Nichols, Gilbert resident and business owner, said she is strongly in favor of requiring masks. She is at high-risk for contracting the virus and she must go to work. She said the masks protect the businesses and the Governor should have required them. Cameron Grady, Gilbert resident, said he is opposed to the requirement and he views the requirement is a slippery slope. He has concerns about government forcing mask wearing on the people. He noted he protects his at-risk mother but he does not want to force other citizens to wear masks. John Chiazza, Gilbert resident, asked residents to be responsible and for businesses to require masks until the trend of increasing new cases starts going down. He would like the requirement posted on business doors and he would like to see anyone not complying shut down. Tony Bonse noted this is a difficult decision. He does not believe mask are good for the health of the community. People should have the freedom to use their own judgement to make the best decision for their health. The virus is not a cataclysmic disease with a 99 percent survival rate. La’Vista Jones, Gilbert resident, said she is in favor of masks. She believes everyone can do something simple to protect themselves and others. She is a healthcare worker and she has seen what the virus can do. Wearing a mask is a simple act of compassion. Councilmember Taylor said requiring people to wear mask in public is a violation of individual rights and a violation of the State Constitution. He noted one problem with the Emergency Order is there is no expiration date or exit criteria. He said masks have been a divisive symbol with people shaming or bullying anyone not wearing a mask. He stated this Order is unenforceable and the penalties are punitive. Lastly, he noted all masks are not created equal and he does not want the Town to be liable for people who get sick from the forced wearing of masks. Councilmember Taylor recommended education and allowing local businesses, schools and churches to decided whether or not they wanted to require masks in their facilities. Councilmember September said he replied to many of the emails sent to the Council. He has struggled with the idea of mandating that people must wear masks and enforcing that mandate. He is also sympathetic with residents who are vulnerable to the disease. He said he is leaning towards requiring masks with some exceptions and no enforcement. Councilmember Koprowski said this is a difficult conversation about a simple act. She noted government mandates no smoking areas and wearing seatbelts. Those requirements are about safety. She does not know how long people may have to wear masks but people cannot go back to a normal life without a mask wearing culture. She said when the Spanish flu came in 1918 when nothing was done there were four times 2 as many deaths. Up until now people have had the ability to decide if they want to wear masks or not and the number of cases has continued to increase. Vice Mayor Anderson said this is a difficult decision which should have been made by the Governor. He said his concern is there is no measure of success included in the Emergency Order and that needs to be defined. He would like Council to come back together at a set time and evaluate the situation at that time. Vice Mayor Anderson asked how exception would be verified and he stated he was uncomfortable with enforcement. Councilmember Yentes said there were a lot of comments from residents and she thinks masks, social distancing and hand washing are good but she is concerned about mandating people wear a mask. She is also concerned about the enforceability and unintended consequences. She would prefer to err on the side of freedom and she believes Council’s role is to educate the public on best practices. Councilmember Spence said he would like the violation process explained. Town Attorney Payne said if a business posts the requirement and a patron comes in without a mask and they refuse to leave then the business owner could call the police and the patron could be charged with trespassing. Councilmember Spence said he is concerned about the open ended takeover of power. He would like to have an on-going agenda item to discuss this item at future meetings. He would like office spaces where physical distancing is possible to be able to relax mask wearing. Town Attorney Payne noted the Emergency Order did allow for that when distancing is possible. Councilmember Spence inquired about how mask wearing would work at Parks facilities. Would someone playing volleyball have to wear a mask. Town Attorney Payne replied the Emergency Order did not require masks where it was not practicable or feasible. Councilmember Spence noted wearing a mask does not increase the spread of the virus. His struggle is with freedom versus safety. There is a current outbreak and they must take action. He supports the Emergency Order with exceptions. Mayor Daniels said she has been diligently following the data and the State set another record for new cases today. She wants people to make their own choices but she cannot ignore the data. She noted some changes to the Emergency Order including increasing the minimum age for children to 6 years old. She said the effective date should be 5:00 p.m. on June 19, 2020 with an expiration in 30 days. At that time the mandate will be re-evaluated. She noted there are groups around Town who will help anyone who does not have access to a mask. Councilmember Koprowski statd she did not know if 30 days was long enough. She would like to wait until schools re-open before discussing this. Mayor Daniels answered some schools will re-open the end of July and there will be data in 30 days to review. 3 Vice Mayor Anderson inquired about whether schools have policies. Mayor Daniels replied schools want a policy consistent with the Town’s policy. Councilmember Spence thanked the Gilbert police officers for keeping us safe. Mayor Daniels said the police will not be enforcing this policy and will only assist businesses when they are called to assist. Town Attorney Payne summarized the requested changes to the Emergency Order adding it will expire in 30 days. Mayor Daniels said she will continue to track the data for when the Council next meets. A MOTION was made by Mayor Daniels, seconded by Councilmember Koprowski, to approve item 1. Motion carried 5-2 with Councilmembers Taylor and Yentes casting the dissenting votes. Mayor Daniels asked everyone in the community to please wear a mask and not make this a divisive issue.
