MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF TUESDAY AUGUST 11, 2020 AT 5:30 PM, MUNICIPAL CENTER I, ROOM 233 50 E CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Jenn Daniels, Vice Mayor Scott Anderson, Councilmembers Yung Koprowski, Scott September, Bill Spence, Jared Taylor, and Aimee Yentes COUNCIL ABSENT: None STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Lisa Maxwell, Town Attorney Christopher Payne AGENDA ITEM CALL TO ORDER Mayor Daniels called the meeting to order at 5:31 p.m. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember Bill Spence, seconded by Councilmember Scott September, to recess the Special Meeting and reconvene in Executive Session pursuant to: a) Pursuant to A.R.S. §§ 38-431.03(3),(4), and (7) legal advice from the Town Attorney regarding contract negotiations and requests for temporary relief from various contractual obligations of certain lessees, tenants, and other parties to contracts with the Town of Gilbert; b) Pursuant to A.R.S. § 38-431.03(A)(3), legal advice from the Town Attorney concerning settlement authority regarding a claim by J. Lachica involving an accident in the 500 block of west Douglas St; c) Pursuant to A.R.S. §§ 38-431.03(A)(3) and (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the possible offering for invitation for bids of an approximately 0.2-acre surplus parcel located at the southwest corner of Pecos Road and Mercy Road; and d) Pursuant to A.R.S. §§ 38-431.03(A)(3), (4), legal advice from the Town Attorney concerning litigation entitled American Furniture Warehouse v. Town of Gilbert, Maricopa County Superior Court Case No. CV2013-009113. Motion carried 6-0 with Councilmember Taylor not present for the vote.
