MINUTES OF THE GILBERT TOWN COUNCIL, IN REGULAR MEETING OF TUESDAY, APRIL 20, 2021 AT 6:30 PM, MUNICIPAL CENTER I, COUNCIL CHAMBERS, 50 E CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Yung Koprowski, Councilmembers Scott Anderson, Laurin Hendrix, Scott September, Kathy Tilque, and Aimee Yentes COUNCIL ABSENT: None STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Chaveli Herrera, Deputy Clerk Judy Martinez, Town Attorney Christopher Payne, and Environmental Compliance Inspector Kellie Elliott AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 6:32 p.m. INVOCATION AND PLEDGE OF ALLEGIANCE Councilmember Yentes led the Pledge of Allegiance. Pastor Lisa Henry of Central Christian Church gave the invocation. ROLL CALL Town Clerk Herrera called roll and declared a quorum present. PRESENTATIONS; PROCLAMATIONS 1. RECOGNITION - Recognition of the 2021 Gilbert Feeding Families Food Drive partners. Mayor Peterson announced that the Gilbert Feeding Families Donation Sites collected 61,167 pounds of food and $12,308 in cash donations, which provided 112,512 meals to those in need. She thanked the following 2021 Gilbert Feeding Families Food Drive Partners: Chalice Christian Church, Central Christian Church, Desert Cross Lutheran Church, Evident Life Church, First Methodist Church of Gilbert, Living Word Bible Church, Redeemer Bible Church, and Resurrection Episcopal Church/Spirit of Joy. She also thanked the following Church of Jesus Christ of Latter-day Saint Stakes: Boulder Creek, Chandler East, Gateway, Gilbert, Greenfield, Highland East, Highland West, Higley, San Tan, Seville, Stapley, Superstition Springs, Val Vista, Williams Fields, and YSA. 2. RECOGNITION - Recognition of the 2021 Sustainability Artwork winners in 1 celebration of Earth Month. Environmental Compliance Inspector Elliott of Public Works recognized the following recipients of the 2021 Sustainability Artwork: Jadyn O, 1st Place; Katelyn Acuff, 2nd Place; and Lauren Jones, 3rd Place. 2A. PROCLAMATION - Proclamation that was issued and not presented during a Council Meeting is as follows: Proclamation declaring the month of April as Fair Housing Month. COMMUNICATIONS FROM CITIZENS Charlie Girard, Gilbert resident, spoke in reference to the San Tan Adventure Parkway project. He discussed the need for the Town to conduct thorough noise, traffic, and parking studies and talked about his work experience. He stated there was incomplete data and incompetency in the project and in the recommendation of the Planning Commission on April 7, 2021. He asked that a Councilmember be assigned to work with residents around the Adventure Park project. Sandra Avery, Gilbert resident, spoke in reference of the Town’s noise ordinance and Gilbert’s decisions that she said needed to be revisited. She discussed noise decibel levels and a lack of community notification of changes that affected her neighborhood and a lack of communication. She discussed the appeal fee in order to bring and item to the Council. She discussed the proposal of a water park in the past, noting changes since then in staff accountability and communication. Randy Nelson, Gilbert resident, spoke of the proposed go-kart track behind his home, adding he would be appealing it with the Planning Commission. He discussed not being able to open his windows or use his backyard, noting the impact to his quality of life. He said the Council could overturn the lease. Nicki Reber, Gilbert resident, talked about the impacts to the appraisal of her property if the San Tan Adventure Park project went through. Leslie Novak, Gilbert resident, spoke in reference to the Project No. WW1060. She referenced a prior Council meeting discussion regarding gender-affirming surgery and asked why a future Town applicant would be more important then the 24 residents impacted by the land grab of WW1060 Project. She said the Council was more concerned with being socially forward than fiscally responsible. Ron Coon, Gilbert resident, discussed Project No. WW1060 and said the group created the website www.gilbertwastingtaxes.com. He said the staff was working with the residents and felt encouraged that the Town was working with them. Terri Miller and Donald Jordan, Gilbert residents, were present and noted their opposition to the San Tan Adventure Park, but did not wish to speak. 2 CONSENT CALENDAR A MOTION was made by Councilmember September, seconded by Councilmember Yentes, to approve Consent Items 3, 3A, 4, 5, 6, 7, 9, 10, and 11; and remove Item 8 from the Consent Calendar. Motion carried 7-0. 3. INTERGOVERNMENTAL AGREEMENT – consider of approval of: a) Intergovernmental Agreement No. 321000301 with Maricopa County Animal Care and Control for animal control services in an amount not to exceed $193,276 and authorize the Mayor to execute the required documents; and b) a Contingency Transfer from the General Contingency Fund to the Police General Fund in the amount of $5,630. This item was approved with the Consent Calendar vote. 3A. AGREEMENT- consider approval and authorize the Mayor to execute the required documents of: a) Replacement Reimbursement and Security Agreement No. 320000218 with USCIF Artis Park Lucero Venture LP, a Delaware limited partnership; and b) Termination of Reimbursement and Lien Agreement No. 320000218 with USCIF Artis Park Lucero Venture LP, a Delaware limited partnership. This item was approved with the Consent Calendar vote. 4. CONTRACT – consider approval of a Cooperative Purchase Agreement No. 321000296 with Arizona Recreation Design, Inc. utilizing 1 Government Procurement Alliance (1GPA) Cooperative Purchasing Contract No. 18-04P-01 in an amount not to exceed $282,335 for the purchase of Playground Equipment and Installation and authorize the Mayor to execute the required documents. This item was approved with the Consent Calendar vote. 5. CONTRACT – consider approval of: a) Job Order No. 14 to Contract No. 320000233 with PCL Construction, Inc. in an amount not to exceed $216,439.27 for the Neely Water Reclamation Plant Fire Suppression System Replacement, Project No. WW1245, and authorize the Mayor to execute the required documents; and 3 b) a Contingency Transfer from the Wastewater Replacement Contingency Fund in the amount of $216,450 to establish Project No. WW1245. This item was approved with the Consent Calendar vote. 6. CONTRACT – consider approval of Professional Consulting Agreement Contract No. 321000192 with Greenlight Traffic Engineering, LLC, in an amount not to exceed $120,000 for the School Safety and Congestion Study, Project No. ST2105, and authorize the Mayor to execute the required documents. This item was approved with the Consent Calendar vote. 7. CONTRACT – consider approval of a Cooperative Purchase Agreement No. 321000300 with J.P. Morgan Chase Bank N.A. utilizing the City of Mesa Cooperative Purchasing Contract No. 2019115 for banking services and authorize the Mayor to execute the required documents. This item was approved with the Consent Calendar vote. 8. BUDGET – consider approval of a Contingency Transfer from the Contingency General Fund to the Fire and Rescue Departments operational overtime budget in the amount of $850,000 to cover the incurred and projected overtime costs associated with the impacts of the COVID-19 pandemic through the end of FY21. Councilmember Yentes asked if there would be an opportunity with the second round of COVID relief monies to apply it to that line item for this use. Town Manager Banger affirmed, stating it was possible and would be brought back to the Council for consideration. A MOTION was made by Councilmember Yentes, seconded by Councilmember Anderson, to approve Item 8. Motion carried 7-0. 9. GRANT – consider application of a 12% Gaming Contribution Grant Contract No. 320000272 from the Fort McDowell Yavapai Nation in the amount of $60,000, for the purchase of a Gilbert Fire and Rescue canine transportation vehicle. This item was approved with the Consent Calendar vote. 10. GRANT – consider: a) application and acceptance of Governor’s Office of Highway Safety Grant Funding Solicitation, Contract No. 321000304 in an amount not to exceed $69,000 police traffic services; 4 b) application and acceptance of Governor’s Office of Highway Safety Grant Funding Solicitation, Contract No. 321000302 in an amount not to exceed $108,000 for DUI enforcement; c) application and acceptance of Governor’s Office of Highway Safety Grant Funding Solicitation, Contract No. 321000305 in an amount not to exceed $3,300 for accident investigation related materials; d) application and acceptance of Governor’s Office of Highway Safety Grant Funding Solicitation, Contract No. 321000306 in an amount not to exceed $5,500 for pedestrian and bicycle safety; and e) a Contingency Transfer from the Grant Contingency Fund in the amount of $185,800. This item was approved with the Consent Calendar vote. 11. MINUTES – consider approval of the minutes of the Regular Meetings of March 30, 2021 and April 6, 2021, Special Meeting of March 30, 2021, and Study Session of April 6, 2021. This item was approved with the Consent Calendar vote. PUBLIC HEARING 12. ZONING Z20-13- conduct hearing and consider approval of the findings and adoption of an Ordinance for Caballero Vista to rezone approximately 2.3 acres generally located at the northwest corner of Lindsay Road and Galveston St. from Single Family-43 (SF-43) to Single Family-35 (SF-35). Mayor Peterson opened the public hearing for Item 12. No one wished to speak and Mayor Peterson closed the public hearing. A MOTION was made by Councilmember Tilque, seconded by Vice Mayor Koprowski, to approve Item 12. Motion carried 7-0. Ordinance No. 2796 was adopted. 13. COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS – conduct hearing and consider authorizing the Mayor or her designee to execute and submit the Town of Gilbert FY2022 Annual Action Plan for Community Development Block Grant (CDBG) Activities to the United States Department of Housing and Urban Development (HUD). Mayor Peterson opened the public hearing for Item 13. Councilmember Yentes said she had previously made her position clear on Federal monies, adding CDBG Funds were a small contributor to Federal debt. She said the money went to worthy causes, but she believed that function as a government crowded out private giving. She 5 said within the plan the intention was to purchase another unit for low-income housing and did not believe Gilbert should be the business of buying or managing properties in the subsidization game. Mayor Peterson closed the public hearing for Item 13. A MOTION was made by Councilmember Tilque, seconded by Vice Mayor Koprowski, to approve Item 12. Motion carried 5-2, with Councilmembers Hendrix and Yentes casting the dissenting votes. ADMINISTRATIVE ITEMS 14. RISK MANAGEMENT - consider acceptance of the Risk Management Quarterly report for the Fiscal Year 2021 Quarter 3. A MOTION was made by Councilmember Anderson, seconded by Councilmember September, to approve Item 14. Motion carried 7-0. 15. She stated the first would be virtual-only on April 28, 2021. She said the Task Force would also hold one on May 12, 2021 at the Southeast Regional Library and one the following Thursday at the Public Safety Training Facility. POLICY ITEMS None. 6 FUTURE MEETINGS No discussion. COMMUNICATIONS Report from the TOWN MANAGER on current events. Town Manager Banger recognized the Gilbert Parks and Recreation Special Olympics All- Abilities Cheer Team for their accomplishment in the Virtual Statewide Special Olympics Cheer Competition. He stated the video of the performance received a gold medal in the Traditional- Intermediate category. Report from the COUNCIL on current events. There were no reports. Report from the MAYOR on current events. Mayor Peterson announced that it was National Volunteer Week and thanked the board, commission, committee, task force and department volunteers for their contributions to the Town. She said the community could not function without the many volunteers who serve in various ways throughout the Town. Meeting Access Due to the ongoing impacts of the COVID-19 pandemic, which have prompted declarations of a public health emergency at the local, state, and federal levels, members of the public will either be able to attend Town Council meetings in person or participate remotely. The number of people allowed in the Council Chambers will be limited to ensure physical distancing as recommended by both the Centers for Disease Control and the Arizona Department of Health Services. Admittance to the Council Chambers will be on a first come, first served basis. Anyone who arrives after the Council Chambers is at capacity will be able to participate in the public meeting in the lobby or elsewhere via one of the various remote options. Members of the public attending these meetings in person are encouraged to wear a mask. For any members of the public who decide to participate in the public meeting in the lobby, a staff member will ask whether anyone wishes to address the public body both prior to the Communications from Citizens agenda item and prior the Public Hearing agenda item. Those members of the public in the lobby wishing to address the public body, if any, will then be escorted into the Council Chambers one by one and will be given the opportunity to address the public body.
