MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF TUESDAY, MAY 24, 2022 AT 5:30 PM, GILBERT PUBLIC SAFETY TRAINING FACILITY, ECHO ROOM 108, 6860 S. POWER ROAD, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Aimee Yentes, Councilmembers Scott Anderson, Yung Koprowski, Scott September, and Kathy Tilque COUNCIL ABSENT: Councilmember Laurin Hendrix STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Chaveli Herrera, Town Attorney Christopher Payne AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 6:16 p.m. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember Tilque, seconded by Councilmember Koprowski, to recess Special Meeting and reconvene in Executive Session pursuant to: a) A.R.S. §§ 38-431.03(A)(3),(4), (7) legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the Amended and Restated Cooley Center Development Agreement and a development agreement regarding the extension of Somerton Boulevard; The Executive Session was recessed at 6:38 p.m. and reconvened at 7:36 p.m. b) A.R.S. §§ 38-431.03(A)(3),(4), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the status of the broadband fiber to the premises request for proposals and contract negotiations with third parties for access to Town- 1 owned rights-of-way for the construction and maintenance of privately-owned fiber and conduit facility; and c) A.R.S. §§ 38-431.03(A)(3), (4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning legal aspects of right-of-way acquisition process and concerning alternatives for the design and construction of WW1060 (Western Canal Sewer Rehabilitation Project between Lindsay and Gilbert Roads). Motion carried 6-0, with Councilmember Hendrix absent. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING A MOTION was made by Councilmember Koprowski, seconded by Councilmember September, to adjourn Executive Session and reconvene Special Meeting.
