MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF MONDAY, JUNE 17, 2024 AT 4:00 PM, MUNICIPAL BUILDING I, COMMUNITY ROOM 202, 50 E. CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Scott Anderson, Councilmembers Chuck Bongiovanni, Bobbi Buchli, Kathy Tilque and Jim Torgeson COUNCIL ABSENT: Councilmember Yung Koprowski STAFF PRESENT: Town Manager Patrick Banger, Town Attorney Christopher Payne, Deputy Town Clerk Judy Martinez AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 4:03 p.m. ROLL CALL Deputy Town Clerk Martinez verified a quorum was present. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember Torgeson, seconded by Councilmember Buchli, to recess the Special Meeting and reconvene in Executive Session pursuant to: a) Pursuant to A.R.S. §§ 38-431.03(A)(3), (4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning legal aspects of potential acquisition of right of way and easements related to CIP No. 1180 (Warner Road: Power Road to Recker Road); 1 b) Pursuant to A.R.S. § 38-431.03(A)(3), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning Town public works and engineering standards and legal issues involving microtrenching and related fiber installation methods; c) Pursuant to A.R.S. §§ 38-431.03(A)(3), (4),legal advice from the Town Attorney and discussion and consultation with Town representatives concerning legal issues involving infrastructure at the Lakeview Trails Southeast development near the northwest corner of Warner and Recker Roads; d) Pursuant to A.R.S. §§ 38-431.03(A)(3), (4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning legal aspects of property acquisition for wellsite for WA1612 near Higley Road and Loop 202; and e) Pursuant to A.R.S. §§ 38-431.03(A)(3)(7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning legal aspects of access easement located on property near Page Avenue and Ash Street in the Heritage District. Motion carried 5-0; Councilmember Bongiovanni was absent at time of vote, arriving at 4:04 p.m. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING A MOTION was made by Councilmember Bongiovanni, seconded by Councilmember Tilque, to adjourn Executive Session and reconvene in Special Meeting. Motion carried 6-0.
