MINUTES OF THE GILBERT COUNCIL SUBCOMMITTEE ON LAND DEVELOPMENT CODE,
NOVEMBER 29, 2018, AT 11:00 A.M., ROOM 236, 90 EAST CIVIC CENTER DRIVE,
GILBERT, ARIZONA
COUNCIL PRESENT: Vice Mayor Brigette Peterson and Councilmembers Eddie
Cook and Jordan Ray
COUNCIL ABSENT: None.
STAFF PRESENT: Town Clerk Lisa Maxwell, Development Services
Director Kyle Mieras, Interim Principal Planner Amy Temes
Vice Mayor Brigette Peterson was selected to serve as Chair.
CALL TO ORDER
Chair Peterson called the meeting to order at 11:02 a.m.
AGENDA ITEMS
1. Discussion of roles and responsibilities.
Development Services Director Mieras said this item is on the agenda so the
subcommittee members and get an understanding of the purpose of this subcommittee.
For future meetings Assistant Town Attorney Nancy Davidson and any other staff will be
invited as needed.
Interim Principal Planner Temes asked if the subcommittee was going to review the
entire code. The consensus was they would. Councilmember Ray said he saw this as a
chance to rid of non-important and out-of-date regulations due to Arizona Revised
Statutes (ARS) and Town Code changes. It is also a chance to remove regulations which
are over burdensome. The Land Development Code (LDC) can be cross reference with
other documents including the Engineering codes. Development Services Director
Mieras said staff has compiled a list of sixteen items than need to be changes.
Interim Principal Planner Temes noted when the sign code section was updated it
included more tables and less text making that section simpler to understand.
Councilmember Cook said he would like the LDC to be more consistent. Development
Services Director Mieras said giving more power to planners to be flexible and the ability
to make changes, flexible.
There was discussion about whether anyone was hearing of any problems with the LDC.
None of the Councilmembers have received any feedback. Now is a good time to review
the LDC since there is a subcommittee reviewing the Building Codes.
2. Discussion of meeting logistics.
There was discussion about how often to meet. The first meeting will be in December
and the first couple of sections of the LDC will be reviewed. The LDC can be displayed in
the meeting room and meeting attendees can go through the sections page by page.
Interim Principal Planner Temes said staff can look for sections that need review by the
subcommittee. Interim Principal Planner Temes said she will also check with Assistant
Town Attorney Davidson on ARS changes. The Arizona Legislature is talking of making
changes to protest procedures and sober homes during the next legislative session.
Highlighted hard copies will be provided to the subcommittee members for discussion
at the next meeting.
3. Discussion of process for reviewing Land Development Code.
It was decided to go through the LDC in order by sections. Councilmember Ray said he
would like this to be completed quickly and not to drag on. Councilmember Cook said he
would be open to taking twelve months to review the LDC. Councilmember Ray noted
stakeholder groups will also need to be included. Chair Peterson said the LDC review will
fit in well with the General Plan update. Development Services Director Mieras said the
subcommittee can report back to Council in six months.
There was discussion about the different sections and the size of the sections. Section 1
is General Purpose. Section 2 on Land Use Designation is a large section. Meetings will
be scheduled for one hour and the subcommittee will work through the LDC. The next
meeting will be on December 19 at 7:00 a.m.
