MINUTES OF THE GILBERT COUNCIL SUBCOMMITTEE ON LAND DEVELOPMENT CODE, DECEMBER 19, 2018, AT 7:00 A.M., ROOM 236, 90 EAST CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Vice Mayor Brigette Peterson and Councilmembers Eddie Cook and Jordan Ray COUNCIL ABSENT: None. STAFF PRESENT: Town Clerk Lisa Maxwell, Development Services Director Kyle Mieras, Interim Principal Planner Amy Temes, Interim Planning Manager Catherine Lorbeer, and Assistant Town Attorney Nancy Davidson CALL TO ORDER Chair Peterson called the meeting to order at 7:05 a.m. AGENDA ITEMS 1. Approval of the minutes of the November 29, 2018 meeting A MOTION was made by Councilmember Ray, seconded by Councilmember Cook, to approve the minutes of the November 29, 2018 meeting. Motion carried 3-0. 2. Review and Discussion of Land Development Code Division 1 Article 1 Interim Planning Manager Catherine Lorbeer reviewed the direction given at the first meeting of the Subcommittee on Building Codes. There was a discussion about why the Land Development Code (LDC) is needed. The following sections of Division 1 Article 1 were discussed: 1.101 Title and Authority: Check Arizona Revised Statute (ARS) §9-462. 1.102 Purpose: There was discussion of the eleven intentions listed and how they align to items on Council agendas. Line 1.102F deals with lot coverage. Assistant Town Attorney Davidson said this comes from the ARS which has simpler language. Interim Principal Planner Temes said the Planning Manager Temes said the Town’s LDC may have broader language because it also covers land development. Chair Peterson said it may be possible to condense this section. 1.103B Graphic Illustrations: Chair Peterson asked if a table was considered a graphic illustration. There was discussion about what to do when a graphic is in conflict with the text. Assistant Town Attorney Davidson said statute states the text overrules the graphic when there is conflicting information. 1.104D Substandard Lot: Assistant Town Attorney Davidson described an issue when a substandard lot that cannot ever meet the setback requirements. This means the property owner can never expand their building. Interim Planning Manager Lorbeer said a later section of the LDC allows for the property owner the right to request a variance. Most people would not know they had this option. 1.104E Lots or Parcels Divided by District Boundaries: Have the zoning boundaries serve as district boundaries 1.105 General Rules for Applicability of Land Use and Development Regulations: There was discussion about a new future zoning designation for multi-family units. 1.105B Establishment of Overlay Zoning Districts: hyperlinks to the City of Phoenix, the Phoenix-Gateway Airport and the Heritage District would be useful. 1.106C Maintenance of Official Zoning Map: Remove references to department names and titles. 1.106D Copies of the Official Zoning Map: Assistant Town Attorney Davidson will review ARS. Development Services Director Mieras will look at workflows to see how various versions of the map are updated. 1.108 Rules of Transition: Assistant Town Attorney Davidson will review this section to see if it can be simplified. 1.109 Rules for Interpretation: Assistant Town Attorney Davidson will look at inaccuracies in the LDC. Interim Planning Manager Lorbeer said the Planning Department keeps a log. 3. Review and Discussion of Land Development Code Division 2 Article 2 2.103B Unlisted Uses: This seems to be contradicted by 2.103C Prohibited Uses. Sections B and C will be combined and simplified. Table 2.104 Lot Development Regulations – Single Family Residential Districts: There was discussion about eliminating the two story from SF-43 through SF- 15. A maximum height could be given and the builder could decide on the stories. Also the option of zero or five is confusing in SF-D. A note can be added to explain what that means. 2.104B Height: Interim Principal Planner Temes said this seems obsolete now and should allow for at least two stories. 2.104C Front Setback: Interim Principal Planner Temes asked if in Section 1.b and 2.b porches could be included and detached garages removed. Interim Planning Manager Lorbeer said this section can be improved. Councilmember Cook said a graphic would be helpful. 2.104C.3 Staggering: There is no clear understanding of that this means. Chair Peterson asked staff to look at other communities and come back for more discussion.
