MINUTES OF THE GILBERT COUNCIL SUBCOMMITTEE ON LAND DEVELOPMENT CODE,
MAY 16, 2019, AT 7:00 A.M., ROOM 236, 90 EAST CIVIC CENTER DRIVE, GILBERT,

CALL TO ORDER
Vice Mayor Cook called the meeting to order at 7:15 a.m.
AGENDA ITEMS
1. Approval of the minutes of the May 2, 2019 meeting.
A MOTION was made by Councilmember Ray, seconded by Vice Mayor Cook, to approve
the minutes of the May 2, 2019 meeting. Motion carried 2-0.
2. Review of previous discussions.
None
3. Review and Discussion of Land Development Code Division 3 Article 3.4.
None
4. Review and Discussion of Land Development Code Division 3 Article 3.5.
Interim Principal Planner Temes said this section is not used very often and most of the
changes are for clarification.
3.502.A.2.B Boundaries: Interim Principal Planner Temes said it is difficult to see
boundaries on the static map available for public use. She would like to include a simple
line-drawing map here showing the district boundaries.
Table 3.503A Building Heights and Setbacks – Areas 1 & 5: This table excludes all multi-
family uses, including lofts. Interim Principal Planner Temes would like to reword this
section to allow lofts. There was discussion about “bonus” and what it means for this
section. Interim Principal Planner Temes said this was meant to encourage urban
planning standards that could be used if the building was going to be higher. Assistant
Town Attorney Davidson said other cities use incentive zoning. Interim Principal Planner
Amy Temes said note (b) is redundant and on note (c) she would like to change the
restriction on multifamily. The group will revisit this section later and decide what types
of multi-family building to include.
Table 3.503B Building Heights and Setbacks – Area 3 and Table 3.503B Building Heights
and Setbacks – Area 2 & 4: The same comments as above.
Table 3.503D Development/Bonus Matrix: Interim Principal Planner Temes said this
table outlines bonus points that are available for including certain land uses or design
features. Assistant Town Attorney Davidson said incentive zoning is liked by developers.
She gave an example of a developer adding a charging station instead of parking spaces.
Or designating a parking area for micro-mobility equipment. Vice Mayor Cook said he
likes the idea of incentives instead of bonuses.
5. Review and Discussion of Land Development Code Division 4 Article 4.1.
Interim Principal Planner Temes noted several items from previous sections will be
added to Division 4 General Regulations. She said a purpose will be added to the start of
Division 4, same as is located in the other divisions of the Land Development Code.
Assistant Town Attorney Davidson said a purpose is needed for legal reasons.
4.101 Encroachments into Building Setback and Interior Building Separation Areas:
Interim Principal Planner Temes said this section needs to be reorganized with similar
districts grouped together.
4.101.H Roof Overhangs: Interim Principal Planner Temes wants to remove “except SF-D
and SF-A” from this line.
4.101.J Separation Fences: Interim Principal Planner Temes is adding language to clarify
this line.
4.101.K Freestanding Signs: Interim Principal Planner Temes said this is redundant and
will be removed.
4.102.E Church Steeples: Vice Mayor Cook asked why churches are different. Interim
Principal Planner Temes said this restriction has not been an issue and it will be
removed.
4.102.F Signs and 4.102.G Flagpoles: Interim Principal Planner Temes said these lines are
redundant and will be removed.
4.103 Lighting Standards: Interim Principal Planner Temes said this section will be
rewritten with items grouped into single family, multi-family and non-residential
sections.
There was discussion about replacing streetlights and the appropriate level of lighting in
the Town. 2700k LED lights are the recommendation but 3000k is the maximum
strength acceptable.
4.103.A.4 Wall-mounted Fixtures: The maximum height is 14 feet and Interim Principal
Planner Temes recommended changing the process to get a higher fixture changed to
an administrative permit.
Add a section regarding Heritage Village Center, Gateway Village Center, and Gateway
Business Center lighting standards because those districts cannot meet standards with a
0 foot front setback. This section needs to include standards for a tighter urban area.
4.104 Outdoor Business Property Storage: Interim Principal Planner Temes said items
from the previous sections regarding outdoor retail storage, height of screening and
height of fence will be added to this section.
4.104.G Outdoor Storage: Interim Principal Planner Temes would like to add Light
Industrial and allow those zoning areas to have outdoor storage when it is not adjacent
to residential developments. There was discussion about storage adjacent to roads.
4.105 Screening of Mechanical and Electrical Equipment: Interim Principal Planner
Temes would like to reorganize this section and add an applicability statement.
4.105.B.1.a Nonresidential Uses: This section needs to be updated as it is outdated.
4.105.B.1.b Nonresidential Uses: Nonresidential Uses said this section will be simplified
and images added.
4.105.B.1.c Nonresidential Uses: This section will refer developers to use the Public
Works Standards.
4.105.B.1.d Nonresidential Uses: Utility companies have strict guidelines and this line is
outdated and unenforceable. Developers will be referred to the local utility company.
4.105.B.1.e Nonresidential Uses: Interim Principal Planner Temes will add the sight
visibility triangle for safety reasons.
4.105.B.1.f Nonresidential Uses: This section will refer developers to use the Public
Works Standards.
4.105.B.2.a Residential Uses: Interim Principal Planner Temes said there are cases where
home have their AC units in the front of the house. That equipment needs to be
screened.
4.105.B.2.b Residential Uses: 4.105.B.2.a Residential Uses would like to change the two
inch limit to one foot.
4.105.B.3.c Multi-family Residential Uses: This section will refer developers to use the
Public Works Standards.
4.106 Refuse and Recycling Enclosures: This section will refer developers to use the
Public Works Standards.
4.106.B.3 Enclosure Gates: Interim Principal Planner Temes said there used to be some
flexibility to match architecture style. She would like that added back.
There was discussion about General and Light Industrial zoning districts. Some business
parks have asked if they could eliminate the screening if their refuse and recycling
containers are in an enclosed yard and not visible from the street. Vice Mayor Cook said
he is open to adding that flexibility.
The next meeting will be on May 29, 2019 at 7:00 a.m.
