MINUTES OF THE GILBERT COUNCIL SUBCOMMITTEE ON LAND DEVELOPMENT CODE,
SEPTEMBER 9, 2019, AT 7:00 A.M., ROOM 100, 90 EAST CIVIC CENTER DRIVE, GILBERT,
ARIZONA
COUNCIL PRESENT: Chair Brigette Peterson, Vice Mayor Eddie Cook and
Councilmember Jordan Ray
COUNCIL ABSENT: None

CALL TO ORDER
Chair Peterson called the meeting to order at 7:02 a.m.
AGENDA ITEMS
1. Approval of the minutes of the August 27, 2019 meeting.
A MOTION was made by Vice Mayor Cook, seconded by Councilmember Ray, to approve
the minutes of the August 27, 2019 meeting. Motion carried 3-0.
2. Review of previous discussions.
None
4. Review and Discussion of Land Development Code Division 4 Article 4.5.
Senior Planner Temes is going to condense this article by moving the information to the
appropriate site regulation section. The content is mainly staying the same, it is just
redundant.
4.502 Home Occupation: Senior Planner Temes is going to add a reference to the
Arizona Revised Statutes (ARS). Home occupations may be limited under ARS.
4.503 Residential Day Care: Senior Planner Temes said there are three different kinds of
day care and there are different rules for each one. People using this section need to
refer to the definitions to see which type is the one that applies to them. Senior Planner
Temes said there are other regulations in the Town Code and ARS.
4.504 Group Homes for the Handicapped: Senior Planner Temes is going to check with
Larry Taylor on what is in the Building Codes. She is also going to reference ARS as well.
4.506 Vacation or Short-Term Rentals: This was recently addressed by the State
Legislator and Senior Planner Temes will add a reference to ARS.
4.508 Animal Services: Senior Planner Temes is moving this to the site regulations.

discussion about animal sales and the appropriate section to place the regulations.
Senior Planner Temes noted breeding of animals is under a different category and she is
going to leave animal sales in the retail section.
4.5010 Non-Traditional Business Uses: Senior Planner Temes asked if the list of business
types should be reduced. Vice Mayor Cook said he would like to remove this entire
section. Senior Planner Temes said staff does not get a lot of questions about this
section. Chair Peterson said businesses will only open in spaces that make sense for that
business. Councilmember Ray said he would like to see more research. He is open to
making changes but he would like to see input from the Police and Fire Departments.
4.5011.B Municipal Code Compliance: Senior Planner Temes is going to put a reference
to the Town Code.
4.5012 Temporary Uses: Senior Planner Temes most of what is in this section falls under
special events or there is reference to it in the Town Code.
4.5012 Temporary Uses Table: Inspections Supervisor DeOrio wants the word tent
removed from Tent Sale – Vehicle because most of the vehicles are not under a tent.
4.5013 Temporary Structures: Senior Planner Temes is going to reorganize this section
and let trailers and containers be separate categories. She is going to remove
redundancies and change the list of approved surfaces to dust control material.
4.5013.C Storage Containers: Senior Planner Temes is going to add these are allowed on
single family residential property and prohibited in the Heritage Village Center (HVC),
Gateway Village Center (GVC), Gateway Business Center (GBC) and Multi-Family (MF).
Previously there was some room in these districts, but space is becoming tighter. Vice
Mayor Cook asked about allowing some flexibility with a use permit. Senior Planner
Temes said that would be possible with a time limitation on the permit. The containers
can be tied to construction or special event permits.
4.5013.C.4 Temporary Storage Containers: Chair Peterson noted 30 days is not long
enough for a pod if someone is doing a home remodel. An extension could be added in
that situation.
4.5013.D Classroom Structures: Senior Planner Temes will add these are mobile and
temporarily permitted and give a time frame for when the trailers will be removed. She
will work on determining an appropriate length for allowing the Will work on a time
frame for those to be allowed.
4.5013.E Place of Worship Structures: Same issues as 4.5013.D Classroom Structures.
Councilmember Ray left the meeting.
4.5015 Recovery Residences: Senior Planner Temes will add a reference to ARS. These
facilities have to be licensed by the State and a copy of the license needs to be provided
to the Town.
4.5016 Miscellaneous Provisions: Senior Planner Temes is moving these sections:
A – move to site and use standards
B – move to parking
C – moved to parking
D – move to parking
E – move to site and use standards
F – move to accessory structures
G – Senior Planner Temes will check with Assistant Town Attorney Davidson on
this section.
There was discussion about tiny houses and where they fit in the Land Development
Code. They could go under accessory structures and if they have wheels they could be
considered trailers. There needs a bigger discussion involving what is in the Building
Code. Inspections Supervisor DeOrio noted the trailer used to haul the tiny house is
inspected but not structure it is hauling. There are no inspections when the tiny house is
built.
The next meeting will be on September 24, 2019 at 7:00 a.m. in Municipal Center II,
Room 100.
