MINUTES OF THE GILBERT COUNCIL SUBCOMMITTEE ON LAND DEVELOPMENT CODE, NOVEMBER 19, 2019, AT 7:00 A.M., ROOM 236, 90 EAST CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Chair Brigette Peterson, Vice Mayor Eddie Cook and Councilmember Jordan Ray COUNCIL ABSENT: None STAFF PRESENT: Deputy Town Clerk Chaveli Herrera, Planning Manager Eva Cutro, Inspections Supervisor Lorrie DeOrio, Development Services Director Kyle Mieras, Principal Planner Catherine Lorbeer, Senior Planner Amy Temes, and Development Engineer Manager Tom Condit CALL TO ORDER Chair Peterson called the meeting to order at 7:03a.m. AGENDA ITEMS 1. Approval of the minutes of the November 7, 2019 meeting. A MOTION was made by Vice Mayor Cook, seconded by Councilmember Ray, to approve the minutes of the November 7, 2019 meeting. Motion carried 3-0. 2. Review of previous discussions. None. 3. Review and Discussion of Land Development Code Division 2, Article 2.9. None. 4. Review and Discussion of Land Development Code, Division 6, Article 6.1. None. 5. Review and Discussion of Land Development Code Glossary of Terms (Appendix K). Senior Planner Temes discussed updating some of the terms in the glossary and adding additional clarification on this section of the Code. Abutting or Adjoining and Adjacent terms were recommended to all be combined since they have similar definitions. Discussion was had on secondary dwelling units and Senior Planner Temes stated she would contact Development Engineer Manager Condit for clarification. Accessory Entry Monument- Senior Planner Temes provided clarification that this item was referred to as a freestanding monument and stated she would coordinate with Principal Planner Lorbeer on this item. Accessory Structure- clarification would be gathered on the definition. Apartment Building- there was a recommendation from Senior Planner Temes to add language to state “see residential multi-family”. Vice Mayor Cook asked if there were separate definitions for condos and townhome. Senior Planner Temes stated there was and provided additional details. There was additional discussion on apartment buildings and Senior Planner Temes stated she would cross reference the items discussed. Area – this term was not in the glossary and was added. Term was recommended to be defined as a group pf parcels linked together for a specific purpose. Public Art- this term was not in the glossary and was added. There was discussion on the definition and the decision was made to check with other municipalities to see how it was being defined. Alley this term was not in the glossary and was added. Senior Planner Temes stated she would double check with Development Engineer Manager Condit to ensure the definition is not too limiting. Senior Planner Temes stated that the airport terminology was already included in the overlay section and stated that the terms should also be included in the glossary but expressed concerns in duplicating the language. There was discussion about being consistent in the terminology. As-built- this term was not in the glossary and was added. Development Engineer Manager Condit will assist with the process. There was discussion on the definition on animals being inconsistent. Senior Planner Temes provided a list of how animals had been defined in Municode. There was discussion on consistency concerns. Basements- There was discussion on what was considered a basement. Senior Planner Temes stated she would check with Plan Review Inspection Manager Larry Taylor on the new building code and obtain confirmation on how it should be written. There was discussion on the history of why the term was defined as it was and further clarification will be gathered. The terms pole barn and enclosed barn were not defined and Senior Planner Temes asked whether those terms need to be included. Chair Peterson stated that if it was something we speak to then it needs to be defined. Bedroom- confirmation with Plan Review Inspection Manager Larry Taylor on the definition. Bicycle- this term was not in the glossary and was added – Inspections Supervisor DeOrio recommended that a statement is included to say “see Municode”. Buffer- this term was not in the glossary and was added, language to say “see landscape” Building, attached- this term was not in the glossary and will be added since detached is already defined. Chair Peterson asked that both definitions be looked at for consistency. Building Envelope- update some of the language to for clarification. Vice Mayor Cook asked what the building envelope referred to and Senior Planner Temes and Principal Planner Lorbeer provided clarification. Building, Main, or principal - update to the language. The recommendation was to use the word primary. Building Step-Back- recommendation was to provide a new definition for this item for clarification that it was on the second floor not the first floor. Building Wall- recommendation was to replace the word building in the definition and add additional language to state finished structure Building, footprint- this term was not in the glossary and was added. Vice Mayor Cook asked for clarification on the difference between building footprint and building envelope. There was discussion on defining the two terms. Contiguous lot or parcel- Senior Planner Temes asked why this term was defined separately and Principal Planner Lorbeer stated that it was used in annexation. Cornice- There was a recommendation to remove the word “molding” and replace with the word “element” and to add the words “architectural feature” at the end Day care is defined for both adults and children and Senior Planner Temes asked one definition could be used for both. Development plan- recommended change to the clarification of the language. There was discussion on drive through facilities and Senior Planner Temes clarified that this definition did not include Sonics. There was additional discussion on what was considered a drive thru and Chair Peterson suggested the language should say “drive in” facility rather than drive through. Inspections Supervisor DeOrio suggested the term “drive up.” There was additional discussion on drive in facilities to include curbside pickup. Driveway, Major- recommendation was made to clarify the language and remove the terms “principal” and “nonresidential or multifamily” and add “or the driveway or projects that only have one access regardless of turning motions”. Chair Peterson asked if driveway, minor was defined and there was discussion. The consensus was that there was no need to add minor driveway to the glossary. Dust Free- There was discussion whether 1. asphaltic concrete and 2. cement concrete were still current and the consensus was that the terms would remain. Inspections Supervisor DeOrio provided some clarification on item 3. Senior Planner Temes recommended that dust free should just be defined and the options listed elsewhere. Dwelling, Unit- Recommendation was to remove the words “unit” and “a portion thereof” and add language to say “a dwelling may have more than one kitchen as long as the kitchens are open to the entire residence”. Dwelling Unit, Attached – Senior Planner Temes would seek additional information on this term. The next meeting will be on December 5, 2019 at 7:00 a.m. in Municipal Center II, Room 100.
