MINUTES OF THE GILBERT COUNCIL SUBCOMMITTEE ON LAND DEVELOPMENT CODE,
DECEMBER 5, 2019, AT 7:00 A.M., ROOM 100, 90 EAST CIVIC CENTER DRIVE, GILBERT,
ARIZONA
COUNCIL PRESENT: Chair Brigette Peterson, Vice Mayor Eddie Cook and

CALL TO ORDER
Chair Peterson called the meeting to order at 7:02 a.m.
AGENDA ITEMS
1. Approval of the minutes of the November 19, 2019 meeting.
A MOTION was made by Vice Mayor Cook, seconded by Councilmember Ray, to approve
the minutes of the November 19, 2019 meeting. Motion carried 3-0.
2. Review of previous discussions.
None.
3. Review and Discussion of Land Development Code Division 2, Article 2.9.
None.
4. Review and Discussion of Land Development Code Glossary of Terms (Appendix K).
Family: Senior Planner Temes said the current definition is working well. It has been
used for recent cases involving group homes and recovery care facilities. As there have
been no issues she is going to leave the definition as is. This definition also covers what
is not a family.
Fence: Senior Planner Temes is going to add that a fence is a form of physical barrier to
the definition. She is also going to change “clear vision” to “visibility.”
Flag: Senior Planner Temes will add a reference to the section of the Land Development
Code (LDC) that describes different sign types. Inspections Supervisor DeOrio asked
about pennants. This has come up in the past and it is not addressed in the sign section
of the LDC. Senior Planner Temes said this situation is usually a temporary thing and she
will include a time limit in the definition.
Flag Lot: Senior Planner Temes will add a referent to see lot types. This type lot has a
narrow access to a wider lot.
Floor Area Ratio: Senior Planner Temes is redoing graphic and removing the reference to
the appendix.
Garage: Senior Planner Temes will combine the detached and side-entry definitions and
have one definition. She will make sure the language is consistent with the carport
definition.
Foot Candle: Senior Planner Temes will add a reference to see the section on lighting.
Gatehouse: This is an accessory structure and not a dwelling unit in place of incidental
structure. It will be added to the list of types of accessory structures.
Grade Plane: Senior Planner Temes is going to remove “where the lot line is more than 6
feet from the building, between the building and a point 6 feet from the building.” She
believes this is old language that needs to be updated to be consistent with the updated
Building Code.
Handicapped: There was discussion whether this term is still used by the State of
Arizona. Planning Manager Cuatro believes the term currently used is disabled.
Incidental Use: Senior Planner Temes is going to add a note to see Accessory Use.
Interior Building Separation: Senior Planner Temes is going to remove “Interior” from
the title. This is confusing and sounds like it is discussing the inside of the building.
Landscape interior: Senior Planner Temes said this means the landscaping within the
bounds of the project.
Land, Vacant: Senior Planner Temes will add the definition found in the Planner’s
Dictionary.
Livestock: Senior Planner Temes will add a reference to the Municipal Code.
Lot Area: Senior Planner Temes will remove “Lot area does not include that area of a lot
where the lot width is less than the minimum required by the base zoning district.” The
county’s line will be used for this calculation. Planning Manager Cuatro asked if there
were only lots that contain part of a street. Senior Planner Temes replied there are lots
that go to the center of a private street and she will add “public” street.
Lot Coverage: Senior Planner Temes will change the definition and reword sections one
through 4 below.
Lot Lines: Senior Planner Temes will change “lot” to “parcel of land” and remove the
reference to the appendix.
Lot Lines, Rear: Senior Planner Temes said this is very confusing for people with odd
shaped lots. She is going to add graphics showing examples. For lots with two rear
setbacks, like found in a cul de sac, creating a faux rear line works.
Lot Lines, Side: Senior Planner Temes will reword this when she makes changes to the
Lot Lines, Rear definition.
Lot Types: Senior Planner Temes will remove the reference to the appendix.
Lot Width: Senior Planner Temes will remove “entirely outside of the front setback
area” and the reference to the appendix.
Marquee: There was discussion about where a marquee would be located. Senior
Planner Temes will add “at the front entrance to a building”
Median: Senior Planner Temes will add this can be a public or private street.
Mural: Senior Planner Temes is going to change “hand-painted work” to “original visual
work of art that is located on the exterior’ and it cannot promote a particular business
or product “located or sold on the premises.” There was a discussion about the San Tan
Mall area and using vacant storefronts to advertise for other stores. That is all
considered one lot. Senior Planner Temes said she will discuss this with Assistant Town
Attorney Davidson. Chair Peterson said the goal is to encourage creativity. There was
more discussion about signage versus art. Senior Planner Temes will add the works
cannot be mass-produced.
Non-Conforming Lot or Parcel, Non-Conforming Sign, Non-Conforming Structure, and
Non-Conforming Use: Senior Planner Temes will remove the definitions from within a
chapter once that chapter has been completed.
Nonresidential Use: Senior Planner Temes will add a better definition.
Open Air Accessory Structure: Senior Planner Temes will add at the end that the wall
must be “solid.” She will rewrite this definition.
Open Air Attached Patio: Senior Planner Temes will remove “Open Air Attached from
the title. She will keep “The patio may have a solid roof, lattice roof or fabric roof
surface supported by polies, posts, columns or other vertical structure members.”
Open Air Porch: Senior Planner Temes will remove “Open Air” from the title and add a
definition of a porch.
There was discussion about examples of different structures and how they fit in these
definitions with set-backs.
The next meeting will be on December 18, 2019 at 7:00 a.m. in Municipal Center II,
Room 100.
