CITY OF GRAND PRAIRIE CITY COUNCIL MEETING CITY HALL - COUNCIL CHAMBERS, 300 W. Prairie Lights 2021 Assistant Parks and Recreation Department Director Erin Hart introduced Whitney Walters, Special Events Supervisor, and Andrew Snyder, Special Events Coordinator. Ms. Walters presented information on the upcoming Prairie Lights season noting there would be a holiday village tent, outdoor walk through, carnival rides, concessions and drive through. She indicated both Sneak-A-Peak nights were sold out and reviewed the drive-through event map. Council Member Copeland asked if the event had the same vendor as in previous years, and Ms. Walters confirmed. Presented 2. ETJ Annexation Analysis Presentation – Southgate City Manager Steve Dye reminded Council of the Future Land Use Map (FLUM) presented to them previously and introduced David Jones, Urban Planning Project Manager from Freese and Nichols. Planning Director Rashad Jackson noted they worked with Mr. Jones and his team for several weeks on this study. Mr. Jones introduced the Freese and Nichols team and provided an overview of their scope of work, project objective and the Southgate 360 Land Use Plan. He reviewed the Extra Territorial Jurisdiction (ETJ) map and discussed initial assumptions of city acquisition and investment as well as cost of construction. Mr. Jones discussed how land would be allocated and what the demand is with noted transportation network assumptions. He also reviewed water/wastewater utilities capital costs, funding elevated storage and water mains, possible facility/building construction and staffing costs to City Council Meeting – November 16, 2021 Page 1 of 14 include a city administration building, service center, library/recreation center, fire station and a signature park. Mr. Jones discussed a cost breakdown for roadway construction and water/wastewater, reviewed revenue sources to include user fees and impact fees, ad valorem and sales tax revenue and a twenty-five year fiscal outlook. Deputy Mayor Pro Tem Humphreys asked for the cost of the study. Mr. Jones said the cost was sixty-seven thousand which included the report they would provide to Council. Mr. Jackson noted Council approved payment for this study in July. City Manager Steve Dye reviewed current development and noted this study was necessary to provide the best recommendation for future development. Council Member Johnson asked to review the revenue user fees and impact fees information. Mr. Jones indicated they are estimated numbers over twenty-five years. Council Member Copeland asked if this moves forward when the city would take over the ETJ. Mr. Jackson said the timeline depends on the developers and they are actively pursuing the opportunity. Mr. Dye said the development may be phased and noted if the area is annexed, the level of service to citizens would be greater. Council Member Lopez asked if office demand space changes are considered in this study due to people working from home and changes with big box stores. Mr. Jones said they are working with the trends as they see them to include their reporting. Council Member Lopez said there is a need for a library and recreation center south of I-20. Mr. Dye said this study does not guarantee these facilities will be placed further south but instead noted they would look throughout the city to see what the needs are before making the decision. Deputy Mayor Pro Tem Humphreys asked to review the city’s assistance in infrastructure before a decision is made as that is a cost normally covered by developers . Mr. Dye said they would review incentivization for development opportunities. Council Member Copeland said this is historic and he is confident Council has a vision for this development. Presented AGENDA REVIEW Mayor Pro Tem Del Bosque asked if there were any questions on items five through thirty-one. Council Member Copeland said items sixteen, eighteen through twenty-one, twenty-three, and twenty-five through thirty-one were reviewed by the Finance and Government Committee. There were no questions. EXECUTIVE SESSION Mayor Pro Tem Del Bosque called a closed session at 5:28 p.m. pursuant to Chapter 551, Subchapter D of the Government Code, V.T.C.A., to discuss the following: Section 551.071 “Consultation with Attorney” - Opioid Litigation; Section 551.072 “Deliberation Regarding Real Property;” and Section 551.087 “Deliberations Regarding Economic Development Negotiations.” RECESS MEETING Mayor Pro Tem Del Bosque adjourned the closed door session, opened the regular meeting and called a recess at 6:17 p.m. RECONVENE MEETING – 6:30 PM Invocation led by Pastor Carlos Pasillas of Grand Prairie Seventh-day Adventist Church. City Council Meeting – November 16, 2021 Page 2 of 14 Pledge of Allegiance to the US Flag and Texas Flag led by Council Member King. Mayor Pro Tem Del Bosque moved item number thirty-five to the beginning of the meeting. City Manager Steve Dye asked City Attorney Megan Mahan to explain the legalities of this item which concerns previously zoned multi-family development. Ms. Mahan reviewed the options Council has in consideration of the item and noted this is an administrative review for approval as Council has no authority to deny. PRESENTATIONS 3. Recognition of National Family Engagement Week Council Member Lopez read the proclamation then Deputy Mayor Pro Tem Del Bosque and Mayor Jensen recognized the many Grand Prairie Independent School District (GPISD) Family Engagement Liaisons present, including retired GPISD Community Liaison Esmerelda Rodriguez. Presented 4. Presentation of Appreciation to Blue Shoes Program Partners Chief Scesney acknowledged the Blue Shoes Program and explained its importance to children in Grand Prairie, noting many children of grades Pre-K through second grade received new shoes and socks. He said Deputy Chief Brad Leonard managed the project, and he also recognized all the partners who supported the project including Axon, Amazon, Rotary and Asia Time Square. Presented CONSENT AGENDA Mayor Jensen excused himself at 8:41 p.m. from the remainder of the meeting as he is recovering from an injury. Deputy Mayor Pro Tem Humphreys moved, seconded by Mayor Pro Tem Del Bosque, to approve Consent Agenda items five through thirty-one. The motion carried unanimously, 8-0. 5. Minutes of the November 2, 2021, City Council Meeting Approved 6. Purchase of two (2) new Toro Groundsmaster 3300 4WD for Parks and Recreation ($32,459.29 each), one (1) new Toro Reelmaster 3100-D Sidewinder for Parks and Recreation ($58,549.14), one (1) new Toro Workman MDX for Parks and Recreation ($12,797.87), three (3) new Toro Workman HDX- 2WD Kubota Diesel for Parks and Recreation ($31,757.46 each), one (1) new Toro Multi Pro WM Sprayer with Accessories for Parks and Recreation ($65,625.01), and one (1) new Toro Pro Force Debris Blower for Parks and Recreation ($9,690.70) from Professional Turf Products, L.P. for a combined total of $306,853.68 through a Cooperative Agreement with Omnia Partners Approved City Council Meeting – November 16, 2021 Page 3 of 14 7. Authorize the City Manager to execute the renewal options with aggregate price fluctuations of up to $50,000.00 of the original maximum price so long as sufficient funding is appropriated by the City Council to satisfy the city’s obligation during the renewal terms Approved 8. Price Agreement Contract for clerical temporary staffing from Howroyd-Wright Employment Agency Inc., dba AppleOne Employment Services, through a Master Interlocal Agreement with NCTCOG’s North Texas Share Cooperative. This agreement will be for six months ($80,000), with the option to renew for four additional one-year periods ($160,000 annually), totaling $720,000 if all extensions are exercised. An Ordinance of the City of Grand Prairie, Texas, authorizing the execution of an MOU with the Alliance For Children providing $100,000 in America Rescue Plan Act funds for expanding the Arlington center servicing victims of criminal child abuse in Grand Prairie Mr. Harold Willis, 538 Lindly, noted his objection to this item. He feels the money should be used to pay for Police dispatchers. City Manager Dye said funding is not an issue for dispatcher pay and advised fourteen percent of cases at Alliance for Children in Arlington are Grand Prairie cases. Police Chief Scesney concurred and said this organization helps tremendously with their investigations. Adopted ORD 11116-2021 26. Amend the Interlocal Agreement with the City of Fort Worth for joint engineering design and cost estimation services of the “NorthWest” Trail Connection to CentrePort Station in the amount of $59,412 for additional engineering services Adopted ORD 11117-2021 27. Ordinance amending the FY2021/2022 Capital Improvement Projects Budget; Construction contract with A&B Construction, LLC for High School Drive Slope Failure in the total amount of $626,947.00 for Base Bid; material testing with Alliance Geotechnical Group in the amount City Council Meeting – November 16, 2021 Page 6 of 14 of $34,760.80; in-house engineering in the amount of $31,347.35; and 5% construction contract contingency in the amount of $31,347.35 for a total project cost of $724,402.50 Adopted ORD 11118-2021 28. STP-21-08-0002 - Site Plan - Rosa's Cafe (City Council District 2). Site Plan for restaurant and retail sites on 8.52 acres. William Reed Survey, Abstract 1193, City of Grand Prairie, Dallas County, Texas, zoned PD-143 for General Retail Use, within the SH-161 Corridor Overlay District, and generally located on the southwest corner of Mayfield and SH 161 (On October 25, 2021, the Planning and Zoning Commission recommended approval by a vote of 7-0) Chief City Planner Savanah Ware presented this site plan for a restaurant, noting it meets density and dimensional requirements. She reviewed building elevations and said it meets parking, landscaping and screening requirements. Ms. Ware discussed the trail connections from CB Jenni Townhomes and reviewed variances requested, noting the Planning and Zoning Commission as well as the Development Review Committee (DRC) approved. Council Member Humphreys asked if all Rosas restaurants have drive-thru lanes. She said the one in Fort Worth has one. Bob Diaz, 1290 W. Pioneer Parkway, did not wish to speak but noted his support of this item. Mayor Pro Tem noted there were no speakers present. Council Member King moved, seconded by Deputy Mayor Pro Tem Humphreys, to approve with staff recommendations. The motion carried unanimously, 8-0. Approved 35. S210904 - Site Plan - Dechman MF (City Council District 6). Site Plan for a 298-unit multi- family development on 13.83 acres. Tracts 19, Thomas J. Tone Survey, Abstract No. 1460, City of Grand Prairie, Dallas County, Texas zoned PD-23, within the IH-20 Corridor Overlay District, and addressed as 4100 Westcliff Road (On October 11, 2021, the Planning and Zoning Commission recommended approval by a vote of 5-2) City Attorney Megan Mahan explained the legalities of Council to deny an item that has multifamily zoning. Ms. Mahan said the item is to be administratively approved noting City City Council Meeting – November 16, 2021 Page 8 of 14 Council has no authority to deny. Mr. Jackson presented this site plan request for a two hundred ninety-eight unit multifamily development located near the future expansion of Dechman noting the Zoning was passed in 1972. He reviewed landscape plan, proposed building elevations, renderings, Appendix W amenities which meet Uniform Development Code (UDC) requirements. Mr. Jackson said a traffic analysis indicates traffic will flow smoothly and with no significant impact on surrounding roadway networks. He advised there were thirty-six notes written in opposition and seven in support. Mr. Jackson reviewed requested exceptions which include garage and density, and he noted the Development Review Committee recommends approval. Council Member Lopez, Mr. Jackson and Transportation Director Walter Shumac discussed the north entry at Dechman and plans for the extension of Dechman. Mr. Jackson advised the extension was already planned before the developer came in. Public Works Director Gabe Johnson and Mr. Dye advised the design was already in the Capital Improvement Plan (CIP) before the developer came forward. Council Member Johnson said he hoped the developer would work with the citizens to consider some of the proposed changes. David Martin representing the applicant, 2728 N. Harwood St., Dallas, said this item is a site plan approval as zoning was approved years ago. He said they meet the requirements, and they took extra time to meet with neighbors and discussed a range of topics related to the project. Council Member Johnson asked if they would join the Public Improvement District. Applicant Evan McNaulty, 1800 Agusta, said they were happy to consider it. Council Member Johnson reviewed several requests including whether the developer is amenable to change the egress/ingress, if a brick fence would be considered and if they would relocate the retention pond. The developer denied the requests. Council Member Johnson asked if they plan to sell the complex. He said he is not sure but confirmed they normally sell within five years. Mr. Martin said they will participate in Officer Next Door program. Mr. Martin said they are confident they have a quality design, and they meet all requirements and requested Council approval. Council Member Lopez asked them to be considerate of lighting for school bus stops. Council Member Ezeonu said he received several calls and email asking if they considered a senior living center or other option. Mr. McNaulty said they develop high class boutique multifamily development which is in demand. Council Member Copeland said if they took part in the PID, it would mean they are part of the community. Ms. Mahan said they could review a change in the by-laws to accommodate. Barry Jude, 6047 Cedar Glen Drive, lead council from Oaks Baptist Church, spoke in support noting they know they are there for site plan approval and asked for approval of the site plan. Council Member Johnson asked if he spoke to the Westchester community. He said he attended the meeting two months ago, but he did not speak with them. Council Member Johnson asked if the church spoke to other developers and Mr. Jude confirmed they did, not all multifamily. Applicant’s Broker John Muzyka, 1700 Alman Drive, said they reached out to city staff to understand the development of Dechman Drive and engaged single-family and multi-family development, but most interest was from multifamily developers. Council Member Copeland asked if they received the highest offer. Mr. Muzyka said no, they had a better offer but did not accept it. Council Member Ezeonu inquired about purchase price and payment of capital gains taxes. Mr. Muzyka said they cannot disclose the purchase price and they do not pay capital gains taxes. Mr. Jude explained it has been a struggle to develop their facility. Council Member Johnson asked if they would consider not doing multi-family. Mr. Jude said they are morally City Council Meeting – November 16, 2021 Page 9 of 14 and legally bound to their contract and confirmed local, statewide and countrywide developers made offers. Council Member Johnson moved, seconded by Council Member Ezeonu, to table this item until the January 4, 2022, meeting to give the developer time to consider requested changes. Council Member Copeland asked Mr. McNaulty to speak to his investors and board to reconsider some of the requests. Council Member Johnson amended the motion, requested to table the item to December 14th to give the developer time to review requested items and discuss with staff. The motion was seconded by Council Member Clemson and passed unanimously. Tabled PUBLIC HEARING ZONING APPLICATIONS 36. SUP-21-08-0003 - Specific Use Permit/Site Plan – 1290 W Pioneer Pkwy (City Council District 2). Specific Use Permit/Site Plan for motorcycle repair and new warehouse on a 1.855- acre site. Lot 1, Block 1, Jones Nursery Addition, City of Grand Prairie, Dallas County, Texas, zoned Commercial (C), within the SH-161 Corridor Overlay District, and addressed as 1290 W Pioneer Pkwy (On November 8, 2021, the Planning and Zoning Commission recommended approval by a vote of 8-0) Ms. Ware presented this request to add a building to existing business for motorcycle repair. She reviewed the site plan, noting it meets density, dimensional, parking and landscaping City Council Meeting – November 16, 2021 Page 10 of 14 requirements. Ms. Ware reviewed building elevations and said the site is being brought up to UDC and Appendix F overlay requirements. She reviewed the variances requested and said the Planning and Zoning Commission approved. She also noted the DRC recommends approval with conditions that repairs do not take place outdoors and all repairs shall be accessory to sales. Council Member King asked if repairs are limited to those items sold on site. Ms. Ware confirmed it would be assembling and making adjustments only to those sold on site. Mr. Dye commended staff for their work. Council Member King moved, seconded by Council Member Johnson, to close the public hearing and approve with staff recommendations. She reviewed exemptions and gave examples. Ms. Ware said site layout adjustments can be made, when possible, to preserve trees. Council Member Copeland reviewed scenarios for removing trees. Ms. Ware noted City Planner Dana Woods worked with City Legal staff to put this information together. Council Member Johnson asked if a developer must pay a fee, where the money goes. Mr. Jackson said the money is placed in the Urban Forest Fund to be used by parks and for street public improvements. Council Member Lopez asked where a neighbor might report non-compliance and asked about exemptions. Ms. Ware said they would report it to the Planning Department, and she reviewed some of the exemptions. She said she has reached out to Chief Scesney and Mr. Dye regarding her desire to partner with Grand Prairie Police and noted the Grand Prairie Police COPE program is great. Robert Johnson, Grand Prairie, spoke on mental health issues and said he respects the training Grand Prairie has in place for its officers. He supports the class Ms. Lafayette has available through her program. Colonel Fred Alexander, 2859 Park Springs Drive, said he appreciates mental health from a military veteran's point of view. He said he offers assistance to Ms. Lafayette’s program. Calvin Beasley signed up to speak but was no longer present.
