GRANDVIEW CITY COUNCIL REGULAR MEETING MINUTES MARCH 12, 2013 1. CALL TO ORDER Mayor Norm Childress called the regular meeting to order at 7:00 p.m. in the Council Chambers at City Hall. Present were: Mayor Childress and Councilmembers Mike Bren, Pam Horner, Diana Jennings, Bill Moore, Jesse Palacios, Javier Rodriguez and Joan Souders. Staff present were: City Administrator/Public Works Director Cus Arteaga, City Attorney Quinn Plant, City Attorney Tony Menke, City Treasurer Matthew Cordray, Fire Chief Pat Mason, Assistant Public Works Director Santos Trevino, Assistant Police Chief Kal Fuller, Parks & Recreation Director Mike Carpenter and City Clerk Anita Palacios. 2. PLEDGE OF ALLEGIANCE Councilmember Bren led the pledge of allegiance. 3. PRESENTATIONS A. Grandview Community Awards – Community Development Mayor Childress presented the Community Development award that was given to the City of Grandview at the Grandview Community Awards banquet held on February 19th. 4. PUBLIC COMMENT – None 5. CONSENT AGENDA On motion by Councilmember Rodriguez, second by Councilmember Souders, Council unanimously approved the Consent Agenda consisting of the following: A. Minutes of the February 12, 2013 study session B. Minutes of the February 12, 2013 regular meeting C. Payroll Electronic Fund Transfers (EFT) Nos. 4961-4965 in the amount of $57,477.51 and Nos. 4968-4973 in the amount of $63,864.51 D. Payroll Check Nos. 6539-6558 in the amount of $92,503.43 and Nos. 6559-6648 in the amount of $33,892.36 E. Payroll Direct Deposit 02/01/13–02/15/13 in the amount of $82,001.34 and 2/16/13–2/28/13 in the amount of $84,025.83 F. Public Hearing – Community Development Block Grant Close-Out for North Birch Area Neighborhood Improvement Project Mayor Childress opened the public hearing to review final project performance on the North Birch Area Neighborhood Improvement Project funded by the Community Development Block Grant by reading the public hearing procedure. City Administrator/Public Works Director Arteaga explained that the North Birch Area Neighborhood Improvement Project was complete and the contractor finalized all requirements to close out the project. The project included the reconstruction of existing roadways, curb, sidewalks, water and sewer utilities. No comments were received during the public hearing or by mail and the hearing was closed. B. Ordinance No. 2013-1 amending the 2013 Annual Budget City Treasurer Cordray explained that staff monitoring and review of fund and department budgets during the first two months of 2013 identified numerous budget accounts to be amended. Ordinance No. 2013-1 provided for the amending of the 2013 Annual Budget to accommodate the changes in sources and uses, as follows: Current Expense Fund: Increased estimated beginning fund balance. Appropriation for purchase of property from the Water/Sewer Fund. Increased estimated ending fund balance. E.M.S. Fund: Increased estimated beginning fund balance with equal change in estimated ending fund balance. Yakima Co. Law & Justice Tax Fund: Increased estimated beginning fund balance with equal change in estimated ending fund balance. Street Fund: Reduction of estimated beginning fund balance. Decreased estimated ending fund balance. Cemetery Fund: Reduced estimated beginning fund balance with equal reduction in estimated ending fund balance. Capital Improvements Fund: Increased estimated beginning fund balance with equal increase in estimated ending fund balance. Water/Sewer Fund: Increased beginning fund balance. Addition of proceeds from the sale of land to the Current Expense fund. Corrected appropriation error made during budget development (results in the reduction in expenditures). Increased in estimated ending fund balance. Solid Waste Fund: Increased beginning fund balance. Equal increase in estimated ending fund balance. Equipment Rental Fund: Reduced beginning fund balance. Decreased ending fund balance. Regular Meeting Minutes March 12, 2013 Page 3 On motion by Councilmember Bren, second by Councilmember Rodriguez, Council unanimously approved Ordinance No. 2013-1 amending the 2013 Annual Budget. C. Closed Record Public Hearing – Comprehensive Plan Amendment and Rezone Applications submitted by Bleyhl Farm Service, Inc. Mayor Childress opened the closed record public hearing to consider a Comprehensive Plan Amendment and Rezone applications submitted by Bleyhl Farm Service, Inc., by reading the public hearing procedure. There was no one in the audience who objected to his participation as Mayor or any of the Councilmembers’ participation in these proceedings. None of the Councilmembers had an interest in this issue nor did any stand to gain or lose any financial benefit as a result of the outcome of this hearing and all indicated they could hear and consider the issue in a fair and objective manner. The purpose of the hearing was for the Council to review the record and consider the pertinent facts relating to this issue. No new public testimony was allowed. City Clerk Palacios provided the following review of the record. She explained that Bleyhl Farm Service, Inc., submitted a Comprehensive Plan Amendment and Rezone applications for Parcel No. 230924-13401 consisting of 2.98 acres located at 1141 Highland Road, Grandview, WA. The applicant requested a Comprehensive Plan Amendment from Commercial to Industrial and a rezone of the property from C-2 General Business District to M-1 Light Industrial District to be consistent with adjacent parcels owned by the applicant zoned M-1 Light Industrial. On January 24, 2013, a public hearing was held before the Hearing Examiner to receive comments on the proposed Comprehensive Plan Amendment and Rezone. Staff recommended Council accept the Hearing Examiner’s conclusions and recommendation as presented and approve Bleyhl Farm Service Comprehensive Plan Future Land Use Map Designation and Rezone CPA/RZ #2013-01 dated February 22, 2013. Council did not request clarification of the record and the public hearing was declared closed. D. Ordinance No. 2013-2 amending the Comprehensive Plan Future Land Use Map designation, changing the zoning classification of certain lands and amending the zoning map of the City of Grandview as requested by Bleyhl Farm Service, Inc. On motion by Councilmember Palacios, second by Councilmember Jennings, Council unanimously accepted the Hearing Examiner’s conclusions and recommendation as presented and approved Ordinance No. 2013-2 amending the Comprehensive Plan Future Land Use Map designation, changing the zoning classification of certain lands and amending the zoning map of the City of Grandview as requested by Bleyhl Farm Service, Inc. Regular Meeting Minutes March 12, 2013 Page 4 E. Ordinance No. 2013-3 amending Section 10.20.070 of the Grandview Municipal Code to prohibit the parking of certain large vehicles and equipment on City roads and rights-of-way The Grandview Municipal Code does not prohibit parking of certain large vehicles and equipment on City roads and rights-of-way. Currently, large vehicles and equipment were being parked on City streets, both in the residential and other zoned areas of the City. The City streets were not built to take the weight load of these vehicles, which were a continual traffic hazard to other vehicles using those existing City streets. The Police Department received numerous complaints from citizens in the past few years complaining of the large vehicles blocking visual access as well as encroaching into the street. On motion by Councilmember Moore, second by Councilmember Souders, Council unanimously approved Ordinance No. 2013-3 amending Section 10.20.070 of the Grandview Municipal Code to prohibit the parking of certain large vehicles and equipment on City roads and rights-of-way. 7. UNFINISHED AND NEW BUSINESS A. Private Utility Tax Fact Sheet – Review draft Council reviewed the draft fact sheet regarding a proposed private utility tax proposition in preparation of the March 19th public outreach meeting. Following considerable discussion, Council decided not to distribute the fact sheet at the March 19th meeting. Council instructed staff to prepare a five-year financial projection for distribution at the meeting along with a survey of City services for the public to prioritize in order to determine whether to move forward with the private utility tax proposition. 8. CITY ADMINISTRATOR AND/OR STAFF REPORTS YVCOG General Membership Meeting – Grandview would be hosting the YVCOG General Membership meeting on Wednesday, March 20th, 6:30 p.m., at the Community Center. YCDA New Vision Annual Meeting – Yakima County Development Association (YCDA) New Vision’s Annual meeting was scheduled for Tuesday, March 26th from 12:00 – 1:30 p.m., at the State Fair Park room adjoining the Sundome in Yakima. 9. MAYOR & COUNCILMEMBER MEETING REPORTS Public Outreach Meeting – The public outreach meeting to obtain public input on a proposed private utility tax proposition was scheduled for March 19th, 6:30 p.m., at the Community Center. Councilmember Jennings advised she would be unable to attend the meeting. 10. EXECUTIVE SESSION – Union Negotiations Mayor Childress adjourned the meeting to an executive session at 8:25 p.m., for approximately 20 minutes to discuss Public Works union negotiations per RCW 42.30.140(4) with the aforementioned Mayor, Councilmembers, City Attorneys and City Administrator present. The meeting resumed at 9:40 p.m., with the aforementioned Mayor, Council and staff present. 11.
