GRANDVIEW CITY COUNCIL REGULAR MEETING MINUTES APRIL 23, 2013 1. CALL TO ORDER Mayor Norm Childress called the regular meeting to order at 7:00 p.m. in the Council Chambers at City Hall. Present were: Mayor Childress and Councilmembers Mike Bren, Pam Horner, Diana Jennings, Bill Moore, Jesse Palacios, Javier Rodriguez and Joan Souders. Staff present were: City Administrator/Public Works Director Cus Arteaga, City Attorney Quinn Plant, City Treasurer Matt Cordray, Assistant Public Works Director Santos Trevino, WWTP Superintendent Dave Lorenz and City Clerk Anita Palacios. 2. PLEDGE OF ALLEGIANCE WWTP Superintendent Lorenz led the pledge of allegiance. 3. PRESENTATIONS – None 4. PUBLIC COMMENT – None 5. CONSENT AGENDA On motion by Councilmember Horner, second by Councilmember Rodriguez, Council unanimously approved the Consent Agenda consisting of the following: A. Minutes of the April 9, 2013 regular meeting B. Payroll Electronic Fund Transfers (EFT) Nos. 4987-4991 in the amount of $58,164.58 C. Payroll Check Nos. 6687-6704 in the amount of $93,649.58 D. Payroll Direct Deposit 04/01/13–04/15/13 in the amount of $81,957.56 E. Claim Check Nos. 103478-103575 in the amount of $493,683.69 6. ACTIVE AGENDA A. Resolution No. 2013-27 approving petition for boundary line adjustment Pursuant to RCW 35.13.340 – Keith & Marco Oliver, 1500 South Euclid, Grandview On March 25, 2013, City Clerk Palacios received a phone call from an appraiser performing an appraisal on Parcel No. 230927-14406 owned by Keith & Marco Oliver located at 1500 South Euclid, Grandview. The appraiser questioned whether the parcel was in the City or the County. Upon review of the parcel information and also speaking with the Yakima County Assessor’s Office, it came to the City’s attention that a portion of Parcel No. 230927-14406 was in City limits and the other portion was in the County. The portion within City limits was annexed into the City by Ordinance No. 963 dated June 3, 1980. The portion of the parcel inside City limits was then merged with the portion outside City limits by a short plat exemption approved by the City and forwarded to the County dated July 17, 1992. The following year, the property owners applied for a building permit from the City to construct their residence. The County has Regular Meeting Minutes April 23, 2013 Page 2 collected and retained the property taxes on the entire parcel. The property owner has received City utility services (water/sewer/garbage) at inside City rates. The property owners were not aware that half of their parcel was in the City and the other half was in the County. The property owners petitioned the City to have their entire parcel located within City limits. Pursuant to RCW 35.13.340 “Boundary line adjustment – Inclusion or exclusion of remaining portion of parcel,” the City Council may approve a resolution annexing said property to the City. On motion by Councilmember Horner, second by Councilmember Moore, Council unanimously approved A. Resolution No. 2013-27 approving petition for boundary line adjustment pursuant to RCW 35.13.340 – Keith & Marco Oliver, 1500 South Euclid, Grandview. B. Ordinance No. 2013-5 amending the 2013 Annual Budget At the March 12, 2013 Transportation Benefit District (TBD) Board meeting, the TBD Board authorized matching funds for two projects funded through the Transportation Improvement Board (TIB): Euclid Road from Groom Lane to Stassen Way and West Second Street from Euclid Road to Grandridge Road. The City received two TIB grants, $152,820 for Euclid Road and $415,890 for West Second Street to be expended in 2013. The budget amendment authorized the TIB revenues and expenditures in 2013 for project completion. Ordinance No. 2013-5 provided for the amendment of the 2013 Annual Budget to accommodate the changes in revenue and expenditures within the street fund as follows:  Street Fund – Increase revenue from TIB Grants and increase expenditure estimates for road improvements. No change in estimated ending fund balance. On motion by Councilmember Moore, second by Councilmember Bren, Council unanimously approved Ordinance No. 2013-5 amending the 2013 Annual Budget. C. Resolution No. 2013-28 accepting the bid and authorizing the Mayor to contract with Inland Asphalt Company for the West Second Street (Euclid to Grandridge) and Euclid Road (Stassen to Groom) Expanded Pavement Preservation Project Bids for the West Second Street (Euclid to Grandridge) and Euclid Road (Stassen to Groom) Resurfacing were opened on April 17, 2013. A total of four (4) bids were received with Inland Asphalt Company of Richland, Washington, submitting the low bid in the amount of $425,876.50. The low bid was approximately 15% below the City Engineer’s estimate of $502,270.00. On motion by Councilmember Souders, second by Councilmember Rodriguez, Council unanimously approved Resolution No. 2013-28 accepting the bid and authorizing the Mayor to contract with Inland Asphalt Company for the West Second Street (Euclid to Grandridge) and Euclid Road (Stassen to Groom) Expanded Pavement Preservation Project. Regular Meeting Minutes April 23, 2013 Page 3 D. Resolution No. 2013-29 authorizing the Mayor to sign a Transportation Improvement Board (TIB) Consultant Agreement with Huibregtse, Louman Associates, Inc., for construction services on the West Second Street (Euclid to Grandridge) and Euclid Road (Stassen to Groom) Expanded Pavement Preservation Project On August 14, 2012, Council approved Resolution No. 2012-45 authorizing application submittal to the Transportation Improvement Board for Road Preservation Program Funding for Euclid Road Improvements from Groom Lane north to Stassen Way and West Second Street Improvements from Euclid Road to Grandridge. On December 11, 2012, Council approved Resolution No. 2012-61 authorizing the Mayor to sign the Washington State Transportation Improvement Board Fuel Tax Grant Distribution Agreement for the FY 2014 Arterial Preservation Project 3-E-183(003)-1 Euclid Road Improvements from Stassen Way to Groom Lane. Resolution No. 2013-29 was the TIB Consultant Agreement with Huibregtse, Louman Associates, Inc., for construction services in the amount of $60,000 for said projects. On motion by Councilmember Bren, second by Councilmember Moore, Council unanimously approved Resolution No. 2013-29 authorizing the Mayor to sign a Transportation Improvement Board (TIB) Consultant Agreement with Huibregtse, Louman Associates, Inc., for construction services on the West Second Street (Euclid to Grandridge) and Euclid Road (Stassen to Groom) Expanded Pavement Preservation Project. 7. UNFINISHED AND NEW BUSINESS – None 8. CITY ADMINISTRATOR AND/OR STAFF REPORTS WWTP Aqua Aerated Lagoon Liner Separation – WWTP Superintendent Lorenz reported that on April 14, 2013, the liner at the aqua aerated lagoon was reported as separating and floating to the surface. The lagoon was being drained and the aerators were being removed in order to determine the needed repairs. Earth Day Celebration – On April 25th, USDA Rural Development would hold an Earth Day Celebration at City Hall highlighting the City’s dedication and commitment to natural resources and environment through the upgrade to the Wastewater Treatment Facility. COPS Grant – City Administrator Arteaga reported that the US Department of Justice Office of Community Oriented Policing Services (COPS Office) would be accepting applications for the Fiscal Year 2013 COPS Hiring Program through May 22nd. The grant would cover up to 75% of the approved entry-level salary and benefits for three years for newly hired, full-time officer positions with a maximum federal contribution of $125,000. A 25% local match was required. Upon conclusion of federal funding, grantees must retain all sworn officer positions awarded under the grant for 12 months. The School District agreed to participate in the local match in order to place this officer in the schools during the school year. On motion by Councilmember Horner, second by Councilmember Souders, Council unanimously instructed staff to submit a COPS Hiring Program application to the US Regular Meeting Minutes April 23, 2013 Page 4 Department of Justice Office of Community Oriented Policing Services for one officer position. Soccer League Nezahualcoytl – City Administrator Arteaga presented a letter from Jose Luis & Teresa Vazquez requesting permission to use City-owned property located adjacent to the Public Works shop on Willoughby Road (new cemetery property) for their soccer league. Following discussion, Council concurred and instructed staff to negotiate a Recreational Use Permit with Mr. and Mrs. Vazquez. 9. MAYOR & COUNCILMEMBER MEETING REPORTS Dog Park Committee – Councilmember Souders reported that the Dog Park Committee met with the Yakima Valley Fair & Rodeo Board to discuss utilization of their non-profit status for the Dog Park. YVCC Grandview Campus Student Activity Center – Councilmember Jennings reported that the YVCC Grandview Campus Student Activity Center had their grand opening to the student body. Byam Business Park Dedication – The Port of Grandview held their dedication of the Byam Business Park on April 10th. Arbor Day Celebration Tree Planting – In celebration of Arbor Day on April 10th, students from the McClure Elementary School and Teddy Bear Corner Day Care helped the City plant six trees at Westside Park. Community Clean-up – The Community Clean-up was held on April 13th and 20th at the Public Works Shop. Mayor Childress commended the Public Works crew for their outstanding efforts. 10. EXECUTIVE SESSION – Property Matters Mayor Childress adjourned the meeting to an executive session at 7:55 p.m., for approximately 10 minutes to discuss property matters per RCW 42.30.110(1)(b) with the aforementioned Mayor, Councilmember, City Administrator and City Clerk present. The meeting resumed at 8:05 p.m. No action was taken. 11.
