CITY OF GREEN RIVER CITY COUNCIL PROCEEDINGS December 15, 2015 The Governing Body of the City of Green River met in regular session at 7 pm in the City Hall Council Chambers. Mayor Pete Rust called the meeting to order. The following Council Members were present: Gary Killpack, Mark Peterson, Ted Barney, Allan Wilson, Brett Stokes, and Lisa Maes. The following were present representing the City: City Administrator Reed Clevenger, Director of Public Works Mike Nelson, City Engineer/Utility Manager Mark Westenskow, Director of Finance Chris Meats, Director of Community Development Laura Profaizer, Police Lieutenant Burke Morin, Fire Chief/Emergency Services Mike Kennedy, Parks and Recreation Director Brad Raney, and City Attorney Galen West. APPROVAL OF THE AGENDA Council Member Wilson moved to approve the agenda. Council Member Killpack seconded. Motion carried. (7-0) PRESENTATIONS Mr. Clevenger presented Mike Nelson with a plaque for his 17 years of service, Mike Kennedy with a plaque for his 16 years of service and Doug Malicoat with a plaque for his 30 years of service with the Volunteer Fire Department. Judy Owens gave a brief update on the STAR Transit. Zac Taylor gave a brief update on his upcoming race in the 2016 Chili Bowl Nationals. Mayor Rust announced Castle Rock Realty as the winner of the Downtown Holiday Decorating Contest. CITIZEN REQUESTS AND OTHER COMMUNICATIONS Resident Tim Laboria said he is concerned with the Disorderly Conduct Ordinance and he asked council to use discretion when they are dealing with the transients in town. BOARD AND COMMITTEE APPOINTMENTS Green River Arts Council Council Member Killpack moved to confirm the Mayor’s appointment of Katelynn Beckermann to a two year term on the Green River Arts Council. Council Member Maes seconded. Motion carried. (7-0) ORDINANCES Addition to the Disorderly Conduct Ordinance 2nd Reading: An ordinance adding a new division to Article IV, of Chapter 18, of the Green River Code of Ordinance, City of Green River, State of Wyoming, to establish and regulate disorderly conduct Council Member Peterson moved to approve the ordinance on 2nd reading. Council Member Stokes seconded. Council Member Barney moved to table the motion to discuss it at a workshop. Council Member Stokes seconded. Council will discuss the ordinance at the workshop on January 12, 2016. Motion carried. (7-0) City Council Proceedings December 15, 2015 Page 1 of 4 Amendment to Ordinance 12-3, Burning Prohibited in City Limits 2nd Reading: An ordinance amending Article 1 of Chapter 12, of the Green River Code of Ordinance, State of Wyoming, to establish and regulate Burning Prohibited; Bonfire Permits Council Member Maes moved to approve on second reading an ordinance adding a new division to Article 1, of Chapter 12, of the Green River Code of Ordinance, City of Green River, State of Wyoming, to establish and regulate burning prohibited; bonfire permits. Council Member Peterson seconded. Motion carried (6-1) with Council Member Wilson voting no. Council Member Wilson said he requested to have changes made to the ordinance for this meeting and none of them were done. He would like to see a time limit established and a screen protection being required. Council Member Peterson said he agrees with Council Member Wilson. Mr. Pineda said in discussions with Chief Steffen, it was decided some issues are resolved through the nuisance ordinances or breach of peace. Requiring screens would be an enforceability issue and would limit the fire pits too much. Most screens are decorative and not protective. Council Member Peterson thanked Mr. Pineda for his work on the ordinances. Council Member Stokes agreed. If there are other ordinances that can cover these types of things there is no need to add more. Council Member Killpack asked if there is another ordinance that would cover the 24 hours. Mr. Pineda said there is not a specific 24 hour fire ordinance. Council Member Killpack said there are no time limits to the ordinance and he thinks there should be. As it reads now they can have a fire pit burning for 24 hours. Mr. Pineda said they felt in the summer when people will be enjoying the fire pits it gets dark later so midnight may be too early but they are still discussing the issue. Mayor Rust asked Council Member Wilson if he had a time limit he would like to see. Council Member Wilson suggested 2 am but he does want to see a screen required. Council Member Barney said people could put the fire pit out at 2 am and then start it again at 2:05 am. Council Member Killpack said he has a number of people call him that do not want the ordinance changed. Mr. West suggested having a prohibited time. Council Member Wilson suggested it would be prohibited from 2 am to 6 am. Mayor Rust said he would like to see some sort of screen required when people make their own fire pits. Council Member Maes said there are people who are building decorative ones and may not be able to build a screen. Council directed staff to make the changes for the next reading. Motion carried (6-1) with Council Member Wilson voting no. RESOLUTIONS City Council Proceedings December 15, 2015 Page 2 of 4 Resolution R15-69 Amending Resolution R15-55 R15-69: A resolution amending resolution R15-55, which approves the Final Plat of the Lynn Subdivision, by accepting standby letter of credit in lieu of Funds in escrow, and authorizing the Mayor to execute a subdivision improvement agreement between the City of Green River and New Peak Land Development Company, LLC. Council Member Wilson moved to approve the resolution amending Resolution R15-55, which approves the Final Plat of the Lynn Subdivision, by accepting a Standby Letter of Credit in lieu of funds in escrow, and authorizing the Mayor to execute a Subdivision Improvement Agreement. Council Member Peterson seconded. Council Member Killpack said he will abstain from voting due to a conflict. Motion carried (6-0-1) with Council Member Killpack abstaining. COUNCIL ACTION ITEMS Wyoming Office of Homeland Security Grant Council Member Stokes moved to authorize the Mayor to sign the grant agreement with Wyoming Office of Homeland Security in the amount of $45,954. Council Member Wilson seconded. Mayor Rust asked for explanation. Police Lieutenant Morin said it will provide accessing door locks for the Police Department and City Hall and some cameras that will be placed around the city. Motion carried. (7-0) CONSENT AGENDA Council Member Killpack moved to approve the following consent agenda items. Council Member Stokes seconded. Motion carried. (7-0) • 2016 Crystal Classic Band Contract with T.J Foss of “Nowhere Fast” and the “Party Squad” to perform on February 12 and 13, 2016, for a total amount of $1,250 • Crystal Classic Winter Festival Judges contract with Vernon Barker, in the amount of $600, Bryan Cordova and Jeiremy Gomez in the amount of $200 each • Michael Parker for Puzzle Reproduction in the amount of $250 • Horse Corral Lease with Mike Carlson for corrals #108 and #109 • Horse Corral Lease with Timothy & Mylinh Buggy for corral #40 • Approval of Minutes for: November 17, 2015 Council and December 1, 2015 Council • Payment of Bills: Prepaid Invoices = $92,951.33 Outstanding Invoices = $200,336.42 Payroll Expenditures = $312,362.24 Pre-authorization Payments = $1,072,092.30 CITY ADMINISTRATOR’S REPORT Mr. Clevenger congratulated Mike Nelson, Mike Kennedy, and Doug Malicoat. He thanked the Streets Department for working so hard on cleaning the streets of snow. He said staff has put the snow plow priority list on the city’s website since they have had questions on where they plow first. He wished everyone a Happy Holiday Season. CITY ATTORNEY’S REPORT Mr. West wished everyone a Merry Christmas and a Happy New Year. Council Member Maes thanked the Streets Department for cleaning the snow up on Flaming Gorge Way from the last snow storm. Council Member Peterson thanked Penny’s Dinner staff for helping a mother with her children coming through town. He said he will be ringing the Salvation Army bell at Smith’s on December 19th and the 24th. Mayor Rust thanked the Streets Department for doing a great job removing snow.
