CITY COUNCIL MEETING February 22, 2021 PUBLIC HEARING – 5:25 P.M.: TO RECEIVE PUBLIC INPUT A REQUEST FROM SOUTHERN LIGHT, LLC FOR A FRANCHISE AGREEMENT WITH THE CITY OF GREENVILLE . A Public Hearing was held at Beeland Park on Monday, February 22, at 5:25 p.m. for the purpose of receiving public opinion regarding Southern Light, LLC franchise agreement. Mayor Dexter McLendon called the hearing to order: Mayor McLendon, stated for the record all councilmembers were present except Councilmember Boris Thigpen who was absent. Mayor McLendon asked City Attorney Simmons to give an overview of the request. Attorney Simmons stated that Southern Light, LLC wants to install fiber on the city ROW for internet, telecommunications and information and data services. They will target business customers and have no interest in residential. They will pay the city 5% of gross revenue quarterly. The initial term is (5) five years with two more additional (5) five year renewal terms. Mayor McLendon called for public comment. With no comments against the measure, Mayor McLendon adjourned the public hearing at 5:27 p.m. The Greenville City Council convened at Beeland Park on Monday, February 22, 2021, at 5:30 p.m. for a regular Council meeting. Mayor Dexter McLendon called the meeting to order. City Clerk- Treasurer Dee H. Blackmon called the roll and recorded the following members present: Mayor McLendon, Councilmembers Bryan Reynolds, Ed Sims, Joseph West and Jae’Ques Brown. Councilmember Boris Thigpen was absent.. Mayor McLendon led those attending in the Pledge of Allegiance to the American Flag. Councilmember Brown delivered the invocation. APPROVAL OF MINUTES: Mayor McLendon advised each councilmember had received for review a copy of the proposed minutes for the Regular Council Meeting held on February 8, 2021. He asked if there were any additions, deletions or amendments to the minutes as presented. Councilmember Sims moved to dispense with the reading of the minutes and approve the minutes for February 8, 2021, as drafted . Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. NEW BUSINESS: ORDINANCE 2021-01. TO GRANT A FRANCHISE AGREEMENT TO SOUTHERN LIGHT, LLC. Mayor McLendon introduced Ordinance 2021-01 granting a telecommunication franchise agreement to Southern Light, LLC. The initial term of this franchise agreement is five-years with two additional five-year renewals. Southern Light, LLC is only interested in business customers not residential. The franchise agreement will ensure the city if paid 5% of gross revenues on a quarterly basis. Mayor McLendon called for the pleasure of the council. Councilmember Reynolds moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of Ordinance 2021-01 at this meeting, be suspended for the purpose of permitting the said ordinance be finally passed and adopted at this meeting . Councilmember Sims seconded the motion. Mayor McLendon called for a roll call vote to suspend the rules: Councilmember Reynolds Aye Councilmember Sims Aye Councilmember Ryan Aye Councilmember Lawson Aye Mayor McLendon Aye Mayor McLendon declared the motion to suspend the rules passed . Councilmember West moved to place Ordinance 2021-01 into final passage. Councilmember Brown seconded the motion. Mayor McLendon called for a roll call vote, which was recorded as follows: Councilmember Reynolds Aye Councilmember Sims Aye Councilmember Ryan Aye Councilmember Lawson Aye Mayor McLendon Aye Mayor McLendon declared the motion to adopt and ordain carried. RESOLUTION 2021- 10. A RESOLUTION A WARDING THE BID FOR THE KOLB CITY ROAD CULVERT PROJECT. Mayor McLendon asked City Clerk Blackmon to explain Resolution 2021-10. The Kolb City Road culvert was damaged during a weather event in March 2020. The city let bids for the project in January, but on the bid opening date, no bids were received. When this situation happens, the city may negotiate a price with a company. Public Works Director Garrett Luckie and City Clerk Blackmon called each company that was sent a bid. Only one company was interested in the project. Therefore, a price was negotiated with Boan Contracting Co. Inc. in an amount of $178,298.00. The city has been working with FEMA in order to recoup some of the repair money from damages incurred in March. FEMA has directed $70,000.00 toward the project and the rest is budgeted in the bond. Councilmember Sims moved to adopt Resolution 2021-10 awarding the bid for the Kolb City Road Culvert project to Boan Contracting Co, Inc. Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the council. APPROVAL OF EXPENDITURES: Councilmember Brown made a motion to approve the following expenditures: A. SERVPRO - $2000.00 CLEAN AND SANITIZE PUBLIC WORKS BUILDING DUE TO COVID B. GREENVILLE TIRE - $1,396.54 FOUR TIRES FOR #87 1997 GMC DUMP TRUCK – STREET DEPARTMENT C. SOUTHERN RED ROCK - $1,920.00 (BUDGETED ITEM) 24 TONS INFIELD CONDITIONER FOR BEELAND COMPLEX – RECREATION DEPT. D. ALTEC - $1,030.80 (BUDGETED ITEM) ANNUAL BUCKET TRUCK INSPECTION (#19 BUCKET TRUCK STREET DEPT.) E. SUNBELT FIRE - $1,288.90 (BUDGETED ITEM) SCBA ANNUAL MAINTENANCE FOR MSA AIR PACKS Councilmember Reynolds seconded the motion. Mayor McLendon announced the motion passed with unanimous vote of the Council. OTHER BUSINESS: BOARD APPOINTMENT ANNOUNCEMENTS AND ADJOURNMENT: Mayor McLendon announced the next regular council meeting will be held Monday, March 8, 2021.
