CITY COUNCIL MEETING SEPTEMBER 27, 2021 The Greenville City Council convened in the Council Chamber of City Hall on Monday, September 27, 2021, at 5:30 p.m. for a regular Council meeting. Mayor Dexter McLendon called the meeting to order. City Clerk – Treasurer Dee Blackmon called the roll and recorded the following members present: Mayor McLendon, Councilmembers Bryan Reynolds, Ed Sims, Joseph West, Jae’Ques Brown, and Boris Thigpen. Mayor McLendon led those attending in the Pledge of Allegiance to the American Flag. Councilmember Brown delivered the invocation. APPROVAL OF MINUTES: Mayor McLendon advised each councilmember had received for review a copy of the proposed minutes for the Regular Council Meeting held on September 13, 2021. He asked if there were any additions, deletions or amendments to the minutes as presented. Councilmember Brown moved to dispense with the reading of the minutes and approve the minutes for September 13, 2021, as drafted . Councilmember Sims seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. NEW BUSINESS: ORDINANCE 2021-03. AN ORDINANCE TO AMEND CHAPTER 4 – ANIMALS OF THE CODE OF ORDINANCES OF THE CITY OF GREENVILLE. Councilmember West moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of Ordinance 2021-03 at this meeting, be suspended for the purpose of permitting the said ordinance be finally passed and adopted at this meeting . Councilmember Thigpen seconded the motion. ORDINANCE 2021-04. AN ORDINANCE TO AMEND THE CODE OF ORDINANCES OF THE CITY OF GREENVILLE, ALABAMA, 1987, CHAPTER 10 LICENSES AND BUSINESS REGULATIONS, ARTICLE II. Councilmember Brown moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of Ordinance 2021-04 at this meeting, be suspended for the purpose of permitting the said ordinance be finally passed and adopted at this meeting . Councilmember Sims seconded the motion. ORDINANCE 2021-05. AN ORDINANCE TO AMEND CHAPTER 2 – ADMINISTRATION – PURCHASING POLICY OF THE CODE OF ORDINANCES OF THE CITY OF GREENVILLE. Councilmember Thigpen moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of Ordinance 2021-05 at this meeting, be suspended for the purpose of permitting the said ordinance be finally passed and adopted at this meeting . Councilmember Brown seconded the motion. Mayor McLendon stated that the purchasing policy for the city needs to be updated. Council approval of expenditures will be increased from $1000.00 to $3000.00, the Mayor can approve expenditures from $1001.00 to $2999.99, and the City Clerk will approve expenditures $1000.00 and below. ORDINANCE 2021-06. AN ORDINANCE TO AMEND CHAPTER 17 – SOLID WASTE OF THE CODE OF ORDINANCES OF THE CITY OF GREENVILLE. Councilmember Brown moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of Ordinance 2021-06 at this meeting, be suspended for the purpose of permitting the said ordinance be finally passed and adopted at this meeting . Mayor McLendon explained that landfill fees have not been increased in many years. The cities cost for ADEM monitoring fees and other items have increased greatly in the last few years. ORDINANCE 2021-07. AN ORDINANCE TO ADD SECTION 2-99 TO CHAPTER 2 – ADMINISTRATION - ARTICLE IV - DIVISION 2 OF THE CODE OF ORDINANCES OF THE CITY OF GREENVILLE. Councilmember West moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of Ordinance 2021-07 at this meeting, be suspended for the purpose of permitting the said ordinance be finally passed and adopted at this meeting . Councilmember Brown seconded the motion. RESOLUTION 2021-38. A RESOLUTION APPROVING AN ABC LICENSE FOR THE CORNER STORE. Dilip M Chaudhari 1994 LLC d/b/a The Corner Store located at 80 B Halso Mill Road has applied for a Lounge Retail Liquor - Class II (011). Councilmember West moved to adopt Resolution 2021-38, approving an ABC License for the Corner Store. Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. RESOLUTION 2021-39. TO AWARD BIDS FOR POLICE DEPARTMENT FLEET, ROUTINE MAINTENANCE, REPAIR AND WRECKER SERVICE. The low bid meeting specifications for Vehicle and Impound Towing was submitted by Lowery Towing and Recovery in the amount of zero dollars ($0.00) per tow day or night, a mileage rate of $1.50 one way, 24-hour storage $20.00, in/out of town towing of impounds $45.00, and a mileage rate for impounds of $1.75 one way and 24-hour storage $20.00, the low bid meeting specifications for Vehicle Fleet Repair Service was submitted by Greenville Auto Clinic, in the amount of $60.00 per hour labor rate, and the low bid meeting specifications for Vehicle Routine Service and Maintenance was submitted by Tommy Thompson Enterprises LLC DBA 65 South, in the amount of $65.00 per hour labor rate, and Councilmember Sims moved to adopt Resolution 2021-39, award bids for Police Department fleet, routine maintenance, repair and wrecker service. Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. RESOLUTION 2021-40. TO AUTHORIZE RENEWAL CLAUSE FOR THE AUTOMATED FUELING SYSTEM PURCHASES OF UNLEADED GASOLINE AND DIESEL FUEL FOR 2022-2023. Councilmember Brown moved to adopt Resolution 2021-40, authorizing renewal clause for the automated fueling system purchase of unleaded gasoline and diesel fuel for 2022- 2023. Councilmember West seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. RESOLUTION 2021-41. APPROVE BUDGET AMENDMENT FOR THE 2020-2021 BUDGET. Councilmember Sims moved to adopt Resolution 2021-41, authorizing a year-end budget amendment for FY 2020-21 general fund budget, as adopted on September 28, 2020, by adjusting $709,443.00 from other expense accounts to balance various budgetary accounts, as outlined in “Exhibit A”. Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. RESOLUTION 2021-42. ADOPT THE GENERAL FUND BUDGET FOR THE CITY OF GREENVILLE, ALABAMA, FOR FISCAL YEAR BEGINNING OCTOBER 1, 2021 AND ENDING SEPTEMBER 30, 2022. Mayor McLendon introduced Resolution 2021-42 and the General Fund Budget for FY 2021- 22. The total budget for the fiscal year 21-22 is $16, 893,342.00. He called for the pleasure of the council in its adoption. Councilmember Brown moved to adopt Resolution 2021-42 accepting the General Fund Budget for FY 2021-22 balanced with revenue and expenditures at $16,893,342 .00. Councilmember Sims seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-43. A RESOLUTION AUTHORIZING AN AMENDMENT TO THE CITY RANGE AND STEPS. Mayor McLendon stated the city would like to amend the current Salary Range and Step Plan to reflect the addition and deletion of job categories as well as increase the beginning pay rate and to adopt a separate Range and Step Plan for the Fire and Police Departments. Councilmember West moved to adopt Resolution 2021-43, authorizing an amendment to the city range and steps. Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. RESOLUTION 2021-44. A RESOLUTION TO INCLUDE AMENDMENT THREE TO THE 2013 PERSONNEL POLICIES AND PROCEDURES MANUAL FOR CITY EMPLOYEES. Amendment three to the Policy and Procedure Manual will add the Juneteenth holiday as well as authorize the City Clerk – Treasurer to approve travel requests and travel reimbursements. Councilmember Brown moved to adopt Resolution 2021-44, to include amendment three to the 2013 personnel policies and procedures manual for city employees. Councilmember Sims seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. RESOLUTION 2021-45. A RESOLUTION AUTHORIZING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF GREENVILLE, BUTLER COUNTY SCHOOL SYSTEM AND PATRICK PEAGLER. This memorandum of understanding will help provide a mentoring program for students to build a safe and trust worthy environment that improves accountability and respect amongst peers and administrators. It is designed to serve adolescents who may be struggling in school, lack family support, exhibit disciplinary and/or truancy issues or individuals seeking a positive role model’s guidance. Through a grant, the Butler County School System agrees to pay $35/hour and the City of Greenville agrees to pay $15/hour for a total of $50/hour for up to 15 hours a week for this mentoring service provided by Patrick Peagler. Councilmember Thigpen moved to adopt Resolution 2021-45, authorizing a memorandum of understanding between the city of Greenville, Butler County School System and Patrick Peagler. Councilmember Reynolds seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. RESOLUTION 2021-46. A RESOLUTION AUTHORIZING AIRPORT PRE-APPLICATION GRANT. Councilmember West moved to adopt Resolution 2021-46, authorizing airport Pre- Application grant. Councilmember Reynolds seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. RESOLUTION 2021-47. AUTHORIZE CITY TO ENTER INTO CONTRACT WITH QUALITY CORRECTIONAL HEALTH CARE TO PROVIDE MEDICAL TREATMENT FOR CITY PRISONERS FOR FY 2021-22 AT A COST OF $2,950.74 PER MONTH. Councilmember Sims moved to adopt Resolution 2021-47 authorizing the City to enter into contract with Quality Correctional Health Care to provide medical treatment for City prisoners for FY 2021-22 at a cost of $2,950.74 per month. Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-48. AUTHORIZE SERVICE AGREEMENT WITH BUTLER COUNTY EMERGENCY COMMUNICATIONS DISTRICT (E-911) FOR FY 2021-22 IN THE AMOUNT OF $100,000.00. A one-time increase of $30,000.00 has been added to the Butler County Emergency Communications District (E-911) to purchase state required equipment. Councilmember West moved to adopt Resolution 2021-48 authorizing service agreement with Butler County Emergency Communications District (E-911) for FY 2021-22 in the amount of $100,000.00. Councilmember Reynolds seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-49. AUTHORIZE RENEWAL OF CITY'S AIRPORT MANAGER'S CONTRACT WITH BRUCE EDWARDS FOR FY 2021-22 IN THE AMOUNT OF $36,500.00 OR $3,041.67 PER MONTH. Councilmember Brown moved to adopt Resolution 2021-49 authorizing renewal of FY 2021-22 City's Airport Manager's Contract with Bruce Edwards in the amount of $36,500.00 or $3,041.67 per month. Councilmember Reynolds seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-50. AUTHORIZE CITY TO ENTER INTO SERVICE CONTRACT WITH BUTLER COUNTY COMMISSION FOR ECONOMIC DEVELOPMENT FOR FY 2021-22 IN THE AMOUNT OF $80,000.00. Councilmember Reynolds moved to adopt Resolution 2021-50 authorizing City to enter into service contract with Butler County Commission for Economic Development for FY 2021-22 in the amount of $80,000.00. Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-51. AUTHORIZE CITY TO ENTER INTO SERVICE AGREEMENT WITH THE BUTLER COUNTY CHILDREN'S ADVOCACY CENTER FOR FY 2021-22 IN THE AMOUNT OF $30,000.00. An additional one-time allocation of $20,000.00 is needed to replace outdoor building signage, new security cameras for front of the building and interview room as well as paint the interior of the building and operating expenses. Councilmember West moved to adopt Resolution 2021-51 authorizing the City to enter into service agreement with the Butler County Children's Advocacy Center for FY 2021-22 in the amount of $30,000.00. Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-52. AUTHORIZE CITY TO ENTER INTO A SERVICE AGREEMENT WITH THE SOUTH ALABAMA CHAPTER OF THE AMERICAN RED CROSS FOR FY 2021-22 IN THE AMOUNT OF $1,000.00. Councilmember Sims moved to adopt Resolution 2021-52 authorizing the City to enter into a service agreement with the South Alabama Chapter of the American Red Cross for FY 2021-22 in the amount of $1,000.00. Councilmember Reynolds seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-53. AUTHORIZE CITY TO ENTER INTO A SERVICE AGREEMENT WITH THE FAMILY SUNSHINE CENTER FOR FY 2021-22 IN THE AMOUNT OF $2,500.00. Councilmember Reynolds moved to adopt Resolution 2021-53 authorizing the City to enter into a service agreement with the Family Sunshine Center for FY 2021-22 in the amount of $2,500.00. Councilmember West seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-54. AUTHORIZE CITY TO ENTER AGREEMENT FOR COMPUTER/TECHNOLOGY SUPPORT AND MAINTENANCE WITH MASTER TECHNOLOGY SOLUTIONS, LLC FOR FY 2021-22. Councilmember Brown moved to adopt Resolution 2021-54 authorizing the City to enter into a service agreement for computer/ technology support and maintenance with Master Technology Solutions, LLC for FY 2021-22. Councilmember Sims seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-55. AUTHORIZE CITY TO ENTER INTO MANAGEMENT AGREEMENT WITH SHERLING LAKE MANAGEMENT, LLC FOR FY 2021-22. Councilmember Reynolds moved to adopt Resolution 2021-55 authorizing the City to enter into a management agreement with Sherling Lake Management, LLC for FY 2021- 22. Councilmember Sims seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-56. AUTHORIZE CITY TO ENTER INTO AN AGREEMENT WITH THE ALABAMA CRIMINAL JUSTICE INFORMATION CENTER FOR THE POLICE DEPARTMENTS ACCESS TO THE CRIMINAL JUSTICE NETWORKS FOR FY 2021-22. Councilmember West moved to adopt Resolution 2021-56 authorizing the City to enter into an agreement with the Alabama Criminal Justice Information Center for the police departments ’ access to the criminal justice networks for FY 2021-22 at a cost of $4,800.00. Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-57. TO AUTHORIZE THE CITY TO ENTER INTO AN AGREEMENT WITH GREENVILLE HOUSING AUTHORITY ’S PROVISION OF FUNDING IN THE AMOUNT OF $67,000.00 FOR DRUG ENFORCEMENT OFFICER FOR FY 2021-22. Councilmember Brown moved to adopt Resolution 2021-57 authorizing the City to enter into an agreement with Greenville Housing Authority ’s provision of funding in the amount of $67,000.00 for drug enforcement officer for FY 2021-22. Councilmember Sims seconded the motion. Mayor McLendon announced the motion carried with unanimous vote of the Council. RESOLUTION 2021-58. AUTHORIZE CITY TO ENTER INTO AN AGREEMENT WITH THE STATE OF ALABAMA THROUGH THE ALABAMA DEPARTMENT OF TRANSPORTATION. In order to receive a new senior center van at no charge to the city, the City Council must authorize the Mayor and/or City Clerk to complete and submit an application requesting the new van. Councilmember Brown moved to adopt Resolution 2021-58, authorizing The City to enter into an agreement with the State of Alabama through ALDOT to receive a new van for the senior center. Councilmember West seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council.
