3. Mr. Urey, Vacation a portion of Cherry Way – Mr. Urey opened the Public Hearing to take
comments regarding the request submitted by Phil Godfrey to vacate a portion of Cherry Way.
There were no public comments received. Representatives from Phil Godfrey had nothing to add
to their request. Council President Hamill clarified the ramifications of this vacation request.
This portion will become private property and public access will no longer be available. Mayor
Hereford asked if the other side of Cherry Way would become a dead end. Phil Godfrey’s
representatives responded in that they were going to turn that portion into a small portion of the
new building and parking lot. They are planning on tearing down the current building and
rebuilding a new structure. To comply with the zoning setbacks, the new building would have to
be built over onto Cherry Way. Councilor Hall asked if there would still be access as a
thoroughfare once vacated. The Phil Godfrey representatives provided details of the position of
the proposed new building and that it will be blocked off because of the access necessary to their
garage area. Councilor Hall then asked what the benefit to the public will be for having that
portion vacated. The Phil Godfrey representative responded with being able to serve customers
better with a new facility. They also provided that they discussed the proposal with the neighbor,
Burns Insurance, and they will be paving a new parking lot and will be providing improved
parking to Burns Insurance. Councilor Beil asked for more clarification regarding public access.
The Phil Godfrey representatives responded to her question.
