Borough of Greenville Council Minutes 05.11.10 MINUTES OF A REGULAR MEETING OF THE BOROUGH OF GREENVILLE COUNCIL HELD IN COUNCIL CHAMBERS Tuesday, May 11, 2010 at 6:30pm 1. Call to Order Council President Shipley called the meeting to order at 6:31pm. 2. Invocation: Jeremy Mink, Bethel Life Worship Center Pledge of Allegiance 3. Roll Call: Brian W. Public Comments/Public Participation John Kokoski, 361 South Main Street, and a member of the Erie Extension Canal Museum board stated the volunteer board manages their facility and gives tours, all free of charge. Mr. Kokoski met with the borough manager and the director of the YMCA regarding the meaning in regards to the museum of adopting Ordinance 1491 dissolving GALSA’s authority to represent the borough. The meetings were an attempt to identify what the Canal Museum existence will be when the YMCA assumes management duties. Mr. Kokoski stated the borough insurance carrier, Roger Janes of First National Insurance, informed the Canal Museum board there is no “director” insurance and because of this three board members have resigned. He added council should have begun the process of removing the GALSA board last year, complaining no plan has been formulated. Council President Shipley responded it is not fair to say there is no plan and insurance is in place for the Canal Museum. He reiterated Ordinance 1491, which only removes GALSA’s authority and does not cancel any insurance policies. Council President Shipley added the YMCA is still in the first stages of taking over recreation management and it is an ongoing process. Mr. Kokoski stated the insurance policy ends tonight. Council President Shipley replied the policy cannot be rescinded. Mr. Andrejchak commented he could not characterize the meetings with Mr. Kokoski and John Moore, also from the Canal Museum board, in the same way. He felt the meetings were positive and the borough should continue to preserve this asset going forward. Mr. Andrejchak also spoke at length with Mr. Janes and the Canal Museum is fully insured for liability. Mr. Andrejchak asked Mr. Kokoski specifically what it is he is not hearing. Mr. Kokoski replied a copy of the D & O coverage in writing. Mr. Andrejchak will look into the matter and meet with Mr. Kokoski in the near future. Kate Yasgur, 193 Clinton Street, thanked Mr. Shipley and Mr. Andrejchak for speaking louder and using the microphone. She also registered a complaint with residents walking their dogs on Main Street and not cleaning up after them. 1 Borough of Greenville Council Minutes 05.11.10 5. Approval of Minutes Motion by Councilor May, seconded by Councilor Auchter, that the minutes of the April 13 regular and April 27, 2010 special meetings be approved as written. Motion carried. 6. Budget Report Mr. Andrejchak gave an overview of borough finances. He credited Treasurer Tracey Vale for her expertise in preparing the many reports produced monthly for council. Motion by Councilor Peden, seconded by Councilor Auchter, to approve the budget report. Motion carried. 7. Motion carried. 8. Mayor’s items Mayor Candela attended the local VFW meeting and invited all council members to participate in the Greenville Memorial Day Parade on May 31st. 9. Council reports A. Treasurer’s report for April 2010 B. Police report for April 2010 C. Fire report for April 2010 D. Public Works report for April 2010 E. Code /Zoning report for April 2010 F. Borough Secretary report for April 2010 Motion by Councilor Auchter, seconded by Councilor May, to accept the monthly reports as presented. Motion carried. 10. Reports from Council Committees Councilor Jones, representative to the Library, attended their April meeting. Strayhaven did not meet in April. Councilor Jones and Anthony D’Alfonso attended the Canal Museum April meeting. The councilor has invited resident Tim May to the June Work Session to discuss Trinity’s north site. 2 Borough of Greenville Council Minutes 05.11.10 Councilor May, representative to the Chamber of Commerce, reported he attended their monthly meeting this morning. Their Silent Auction was well attended and the board has named Fred Kiser as interim director. Councilor Auchter reported a Code Committee meeting will be scheduled before the next council work session. Councilor D’Alfonso reported the next meeting of the Greenville Water Authority Board is tomorrow at 5:30p and the public always welcome. The Greenville Railroad Park has 250 members and is preparing for Heritage Day in July. 11. Unfinished Business A. Council President Shipley reported all open seats have been advertised with a response date of May 15th, due to Horizon Hospital System Authority seats expiring on May 17th. The Zoning Hearing Board continues to have two openings to serve for a three (3) year term. B. Motion by Councilor May, seconded by Councilor Auchter, for a first and final reading of Ordinance 1491 repealing Ordinance 1145 and amending the Borough book of ordinances, specifically, Part 9, Chapter 1 section 9-1002 to reflect that GALSA shall no longer be authorized to operate, supervise or provide recreational services for or on behalf of the Borough and that GALSA shall no longer be authorized to supervise, operate or control any Borough property that is owned or leased by the Borough as GALSA shall no longer be designated as the Borough recreation board established by the Borough. Motion carried. C. Motion by Councilor D’Alfonso, seconded by Councilor Peden, to enact Ordinance 1491. The motion carried. D. Motion by Councilor Jones, seconded by Councilor Peden, to accept the recommendation from the Street Committee to forward Ordinance 1395 to the solicitor for amendment on overtime parking fines: up to 30 minutes overtime- $5 fine; 30 to 60 minutes overtime-$15 fine; parking 60+ minutes overtime- $25 fine. Motion carried. 12. New Business A. Motion by Councilor Auchter, seconded by Councilor Peden, to reject all bids received for mowing of borough properties. Motion carried. B. Motion by Councilor Peden, seconded by Councilor May, to hire two part time summer workers to mow all borough properties except small parks and the fire station. Workers will be paid $7.25/hour. Council President Shipley called on Mr. Graubard for comment. Mr. Graubard stated he anticipated the bids would be too high and he calculated mowing in house before bid packets were mailed. Motion carried. C. Motion by Councilor Auchter, seconded by Councilor Peden, to accept the retirement of GALSA secretary Debbie Clark effective July 17, 2010. Councilor Auchter praised Ms. Clark for an excellent job and said she will be greatly missed. Motion carried. D. Motion by Councilor Jones, seconded by Councilor Auchter, to accept the resignations of Becky McFadden, Joe Ribley, Mark Gaus and Jennifer Groleau from the GALSA board. Motion by Councilor Auchter, seconded by Councilor Peden, authorizing the Borough Manager to submit a grant application for improvements to the Riverside Park Nature Trail. Motion carried. F. Motion by Councilor Auchter, seconded by Councilor Jones, authorizing the Borough Manager and Fire Chief to prepare and submit a grant application to FEMA’s Assistance to Firefighters Grant Program for the Borough of Greenville. Motion carried. G. Motion by Councilor May, seconded by Councilor Auchter, to accept recommendation from the solicitor and choose Option 2 regarding correspondence from Flynn Environmental and the Brownies Gas Station remediation. Council President read Option 2, which states “place an Environmental Covenant prohibiting groundwater use on the impacted Borough parcel”. Motion carried. H. Motion by Councilor Auchter, seconded by Councilor Peden, to appoint Borough Manager Scott J. Andrejchak to a three year term on Shenango Valley Enterprise Zone expiring June 30, 2013. Councilor D’Alfonso asked Mr. Andrejchak if he had time in his schedule for these meetings. Mr. Andrejchak replied in the affirmative and stated he has found Enterprise Zone boards to be informative about the local area. Motion carried. I. Motion by Councilor Auchter, seconded by Councilor May, to re-appoint Sharp Collections for delinquent Per Capita tax collection for fiscal year July 1, 2010 through June 30, 2011. Councilor D’Alfonso called on Mrs. Little for the results of a survey to other local municipalities on Sharp Collections. Mrs. Little reported four municipalities were contacted, all four have contracted with Sharp Collections for collection of delinquent per capita taxes and all are satisfied with their services. Motion carried. J. Motion by Councilor Jones, seconded by Councilor May, to grant request from Linda Henry for use of Central Park for a memorial service on Tuesday, May 25, 2010 at 6:00p.m. Motion carried. K. Motion by Councilor D’Alfonso, seconded by Councilor Jones, to grant request from Salvation Army for use of Central Park for their annual “Concerts in the Park” series on Sunday, July 18 & 25 and August 1 & 8, 2010 beginning at 6:00p.m. Motion carried. L. Motion by Councilor Jones, seconded by Councilor Auchter, to grant request from Family Video for use of Central Park for their 2nd Anniversary Celebration on Saturday, June 5 to benefit the Greenville & Hempfield Volunteer Fire Departments. Councilor Jones reminded council the Farmer’s Market will be open that day as well and suggested most activities take place on the east side of Central Park. Motion carried. M. Motion by Councilor Auchter, seconded by Councilor Peden, to approve real estate tax refunds in the amount of $1,620.68 to Sheetz Inc. and $888.32 to Joseph T. Morelli III. Motion carried. N. Motion by Councilor Auchter, seconded by Councilor May, to accept the Tax Collector’s report of 16 exonerations to the Per Capita roll in the amount of $80.00 from the Greenville Tax office. Motion carried. O. Motion by Councilor Jones, seconded by Councilor Auchter, to advertise for roofing bids on the Canal Museum. Motion carried. 13. Council comments Councilor Jones announced the Farmer’s Market is open on Saturday from 7-2 and new hours on Wednesday 11-6. He requested the media present print a free informational advertisement stating the new Wednesday hours. 4 Borough of Greenville Council Minutes 05.11.10 Councilor Auchter commented on GALSA. The change is to make something better and she requested the public have patience and have faith. Recreation will remain at status quo for now and is not going away. Councilor Peden stated Riverside Park is a good thing for Greenville. He suggested a calendar of events at Central Park to be certain there are no double bookings. 14.
