Borough of Greenville Council Minutes 01-08-17 BOROUGH OF GREENVILLE www.greenvilleborough.com MINUTES OF A REGULAR MEETING OF THE BOROUGH OF GREENVILLE COUNCIL HELD IN COUNCIL CHAMBERS Monday, January 08, 2017 at 7:00 p.m. 1. Call to Order Benjamin Beck, Council President 2. Invocation: Rev. June Boutwell, Zion’s Reformed United Church of Christ Flag Salute led by Councilor Paul Hamill 3. Roll Call: Benjamin Beck, Council President Paul Hamill, Council Vice President Linda Zuschlag, Council President Pro Tempore Jonathan Bailey Dane Mincer Thomas Walsh Evian Zukas-Oguz Evan Hereford, Mayor Grace Mariacher, Junior Councilor Jasson W. Urey, Borough Manager James E. Public Comments Resident – Mrs. Tracy Beil, 6 Ferguson Way, spoke regarding her concerns with the creation of the Home Rule Charter Study Commission. Mrs. Beil expressed that Council should take a step back and slow down until the community is educated enough to make these decisions. Non-Resident – Mr. Richard Moss, owner of 77 S. Race Street and 11 S. Race Street, spoke regarding his disapproval of the Storm Water Utility Fee. Mr. Moss expressed his desire to have 1 Borough of Greenville Council Minutes 01-08-17 a court of law decide if the Utility is a fee versus a tax. Council, Mr. Urey, the Borough Manager, and Mr. Douglas, the Solicitor, all engaged in discussion with Mr. Moss. 5. Approval of Minutes Motion by Councilor Bailey, seconded by Councilor Zuschlag that the December 11, 2017 regular session, December 18, 2017 special session and the January 2, 2018 re-organization session minutes be approved as written. Motion carried 6-0. 6. Approval of Budget Report Motion by Councilor Mincer, seconded by Councilor Bailey to approve the monthly budget report. Motion carried 6-0. 7. Bills for Approval Payroll $127,528.64 Administration $4,883.36 Police $14,636.77 Fire $9,792.48 Code $272.65 Public Works $11,567.77 Airport $401.76 Parks $2,468.44 Storm Water $3.650.06 Sewer $79,038.20 Total $254,240.13 Motion by Councilor Bailey, seconded by Councilor Zuschlag to pay the bills as presented. Motion carried 6-0. 8. Approval of Department and Staff Reports A. Financials – December 2017 B. Code – December 2017 C. Police – December 2017 & 2017 Annual Report D. Fire – December 2017 & 2017 Annual Report Motion by Councilor Bailey, seconded by Councilor Hamill to accept the monthly reports as presented. Motion carried 6-0. 9. Mayor Report Mayor Hereford had nothing to report at that the time. 10. Council Committee Reports Councilor Zuschlag reported that since she was no longer a member of the Streets/Public Services Committee she did have some open items that would need to be turned over to the new members. Mr. Hamill had reported to the previous Committee that a Semi was parking along Rooney Street and that a Tri-axel dump truck was parking along North Second Street and has asked the 2 Borough of Greenville Council Minutes 01-08-17 Committee to look into those items. Councilor Zuschlag stated that she had not had a chance to review those issues and wanted the new members to be informed that they will now need to address Councilor Hamill’s concerns. 11. Unfinished Business A. Motion by Councilor Bailey, seconded by Councilor Mincer to set the 2018 meeting schedule as the second Monday of each month for the regular session and the Wednesday prior as the work session meetings to begin at 7pm. Motion carried 6-0. B. Motion by Councilor Bailey, seconded by Councilor Zuschlag to advertise for a public hearing for the creation of a Storm Water Authority to be held on Thursday, February 15, 2018 at 7:30pm at the Greenville High School Lecture Hall. Motion carried 6-0. C. Motion by Councilor Mincer, seconded by Councilor Bailey for the first and final reading of Ordinance 1578, Home Rule Charter. Motion carried 6-0. Mr. Urey read ordinance 1578 aloud. D. Motion by Councilor Zukas-Oguz, seconded by Councilor Bailey to adopt Ordinance 1578, Home Rule Charter. Motion carried 6-0. 12. New Business A. Motion by Councilor Bailey, seconded by Councilor Mincer to accept the Tax Collector’s report of Nine (9) additions to the Per Capita roll and three (3) permanent exonerations in the amount of $15.00 from the Greenville Tax Office. Motion carried 6-0. B. Motion by Councilor Bailey, seconded by Councilor Hamill to appoint the following members to the Airport Commission (6 seats) – 1 year term: 1. Fred Murrin 2. George Long 3. Dow Lindholm 4. Gordon Richardon 5. Robert Murrin Motion carried 6-0. C. Motion by Councilor Bailey, seconded by Councilor Zuschlag to appoint Amy Hollowell to the Civil Service Commission (1 seat) – 6 year term. Motion was not carried by a roll call vote as follows: Councilor Zuschlag – Yes; Councilor Mincer – No; Councilor Bailey – Yes; Council President Beck – No; Councilor Hamill – No; Councilor Zukas-Oguz – No. Motion by Councilor Mincer, seconded by Councilor Hamill to appoint Anthony D’Alfonso to the Civil Service Commission (1 seat) – 6 year term. Motion was carried by a roll call vote as follows: Councilor Zuschlag – No; Councilor Mincer – Yes; Councilor Bailey – No; Council President Beck – Yes; Councilor Hamill – Yes; Councilor Zukas- Oguz – Yes. D. Motion by Councilor Mincer, seconded by Councilor Bailey to appoint Earl Palmiter Jr. to the Horizon Hospital System Authority (1 seat with a term expiring June 30, 2020). Motion carried 6-0. 3 Borough of Greenville Council Minutes 01-08-17 E. Motion by Councilor Bailey, seconded by Councilor Zuschlag to appoint John Hauser to the Planning Commission (1 seat) – 4 year term. Motion carried 6-0. F. Motion by Councilor Bailey, seconded by Councilor Zukas-Oguz to appoint Frank Vanderslice to the Vacancy Board (1 seat) – 1 year term. Motion carried 6-0. G. Motion by Councilor Bailey, seconded by Councilor Hamill to appoint J. Henry Barton to the Water Authority Board (1 seat) – 5 year term. Motion carried 6-0. H. Motion by Councilor Bailey, seconded by Councilor Hamill to adopt Resolution 2018-01 to assign new Tax Collection Committee (TCC) delegates. Motion carried 6-0. I. Motion by Councilor Hamill, seconded by Councilor Bailey to adopt Resolution 2018-02 on Police Pension Plan contributions. Motion carried 6-0. J. Motion by Councilor Bailey, seconded by Councilor Hamill to approve a one (1) year extension of the Tri-County garbage contract. Motion carried 6-0. K. Motion by Councilor Hamill, seconded by Councilor Bailey to authorize the Borough Manager to apply for the FEMA 2017 Assistance to Firefighters Grant (AFG) for the replacement of a fire truck, which has a 5% local match. Motion carried 6-0. L. Motion by Councilor Bailey, seconded by Councilor Hamill to adopt Resolution 2018-03, authorizing the Council President and Borough Manager to sign the loan documents for a Tax Anticipation Note (TAN) with First National Bank in the amount of $200,000 with a 1.98% interest only rate and a 6 month term. Motion carried 6-0. M. Motion by Councilor Bailey, seconded by Councilor Zuschlag to enter into an employment agreement with the Borough Manager for a two (2) year term. Motion carried by a roll call vote as follows: Councilor Zuschlag – Yes; Councilor Mincer – No; Councilor Bailey – Yes; Council President Beck – Yes; Councilor Hamill – No; Councilor Zukas-Oguz – Yes. N. Motion by Councilor Bailey, seconded by Councilor Zuschlag to authorize the council President to sign the memorandum of understanding with the Greenville Fire Department to pay the Interim Supervisor, Michael Cadman, the Captain’s wage from January 1, 2018 until such time the Captain’s position is filled through the Civil Service process. Motion carried 6-0. O. Motion by Councilor Bailey, seconded by Councilor Zuschlag to authorize the Council President to sign the memorandum of understanding with the Greenville Police Department to pay the Interim Supervisor, Paul Molton, the Lieutenant’s wage from January 1, 2018 until such time the Lieutenant’s position is filled through the Civil Service process. Motion carried 6-0. 13. Council Comments Councilor Hamill congratulated Council President Beck on his presidency and looks forward to working together in moving forward. 4 Borough of Greenville Council Minutes 01-08-17 14. Mayor Comments Mayor Hereford stated he is looking to working together. 15. Council President Comments President Beck stated he is looking forward to working with all and working together to do great things. 16. Borough Manager Comments Mr. Urey reminded all of the Greenville Area Brownfields Assessment Program public meeting being held on Thursday, January 18th from 6pm – 7pm at the Greenville Area School District High School Lecture Hall. 18.
