COUNCIL 12-02-24 – 105 MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF GROSSE POINTE WOODS HELD ON MONDAY, DECEMBER 2, 2024, IN THE COUNCIL- COURTROOM OF THE ROBERT E. NOVITKE MUNICIPAL CENTER, 20025 MACK PLAZA DR., GROSSE POINTE WOODS, MICHIGAN. The meeting was called to order at 7:30 p.m. by Mayor Bryant. PRESENT: Mayor Bryant Council Members: Brown, Gafa, Granger, McConaghy, Motschall ABSENT: Koester Also Present: City Administrator Schulte Assistant City Administrator Como City Attorney Walling City Treasurer/Comptroller Schmidt City Clerk Antolin City Planner Wolf Director of Public Services Kowalski City Engineer Wilberding Motion by Motschall, seconded by Granger, that Councilmember Koester be excused from tonight’s meeting. Motion carried by the following vote: Yes: Brown, Bryant, Gafa, Granger, McConaghy, Motschall No: None Absent: Koester Council, Administration, and the audience Pledged Allegiance to the U.S. Flag. The following Commission members were in attendance:  Chris Fenton, Planning Commission Motion by McConaghy, seconded by Gafa, that all items on tonight's agenda be received, placed on file, and taken in order of appearance including a document regarding Permit PF240037 – 1206 Hawthorne Rd. 1 COUNCIL 12-02-24 – 106 Motion carried by the following vote: Yes: Brown, Bryant, Gafa, Granger, McConaghy, Motschall No: None Absent: Koester Motion by Granger, seconded by Brown, that all items (6A-6F) on the Consent Agenda be approved as presented. FOR A PUBLIC HEARING TO HEAR THE APPLICATION OF RACHEL AND TIMOTHY SHOCK, 1206 HAWTHORNE RD., GROSSE POINTE WOODS, WHO IS REQUESTING TO INSTALL A 6’ PRIVACY FENCE ALONG THE ADJACENT PROPERTY LOT LINE OF 1218 HAWTHORNE WITHOUT THE OWNERS’ SIGNATURE OF APPROVAL. THE FENCE APPLICATION WILL REQUIRE A PUBLIC HEARING IN ACCORDANCE WITH SECTION 8-284A(2) CONSENT FROM THE ADJACENT PROPERTY OWNERS MUST BE SUBMITTED TO THE BUILDING DEPARTMENT IN WRITING WITH THE PERMIT APPLICATION. Motion by Motschall, seconded by Granger, that for purposes of the public hearing, the following items be received and placed on file: 1. Letter 10/24/24 – Building Official 2. Letter of Intent – Rachel and Tim Shock 3. Site Plan Sketch 4. Section 8-284 of City Ordinance 5. Application of Public Hearing 6. Affidavit of Property Owners Notified with list 7. Parcel Map 4 COUNCIL 12-02-24 – 109 Motion carried by the following vote: Yes: Brown, Bryant, Gafa, Granger, McConaghy, Motschall No: None Absent: Koester City Planner Wolf provided an overview of the petitioners’ request to install a 6’ privacy fence at 1206 Hawthorne Rd. without the written consent of their adjacent neighbor to the west at 1218 Hawthorne Rd., which is required. All the other adjacent neighbors provided their written consent. Ms. Wolf stated that Section 8-284(a)(3) of the City Ordinance allows City Council, with a public hearing, to consider granting approval under the following four (4) conditions: a. Balancing the relative hardships between the property owner and adjacent property owners; b. Whether special circumstances or conditions exists; c. Whether pedestrian or vehicular vision will be affected; d. The general health, safety and welfare of the neighborhood. Based on the information provided, the Building Official recommended approval of the fence application. The Chair asked if anyone from the audience wished to speak in favor of the proposed request. The following individuals were heard: 1. Rachel and Tim Shock, 1206 Hawthorne Rd. 2. Monique Vasquez, 1215 Hollywood Ave. 3. Greg and Jacqueline Gruber, 1197 Hollywood Ave. 4. Ellisse Thompson, Friend and neighbor of petitioners The Chair asked if anyone from the audience wished to speak in opposition to the proposed request. No one wished to be heard. Motion by Gafa, seconded by McConaghy, that the public hearing be closed at 7:42 p.m. PASSED UNANIMOUSLY. Motion by Gafa, seconded by Brown, that the City Council concur with the Building Official’s recommendation and approve the fence installation for 1206 Hawthorne with the following stipulation that the project is started in six months and completed within one year, effective immediately. 5 COUNCIL 12-02-24 – 110 Motion carried by the following vote: Yes: Brown, Bryant, Gafa, Granger, McConaghy, Motschall No: None Absent: Koester Under New Business, no one wished to be heard. Under Public Comment, the following individual was heard:  Prudence Cole, 43 Fairford, Grosse Pointe Shores – Addressed the passing of the Senior Millage and thanked the Mayor, City Council and the Grosse Pointe Woods residents that supported the millage. Motion by Granger, seconded by Motschall, that the City Council recess the Regular City Council Meeting at 7:48 p.m. and convene in Closed Session, pursuant to MCL 15.268 (h) to consider material exempt from discussion or disclosure by state or federal statute.
