Bruce Hoover - Groveport Madison Local Schools Superintendent Groveport Madison Local Schools Superintendent Bruce Hoover addressed Council with a challenge to work together to better City of Groveport Page 1 City Council Meeting Minutes May 27, 2014 our community and improve our schools. Mr. Hoover commented the passing of the school levy on May 7, 2014 has everyone in the community very excited and thanked the Mayor and Council for their work toward getting the levy passed. Mr. Hoover invited the Mayor and Council to the Ohio Facilities Commission meeting to start the process of planning and using the savings from the bonds. 2. Swearing In of New Police Officer Chief Portier introduced Samuel Yockey of St. Clairsville, Ohio as the Groveport Police Department's newest officer. Officer Yockey comes from Valley View and Ohio Health with three years of experience. He was one of the top three finalists, he is looking for a long term career and looks forward to serving the citizens of Groveport. Law Director Kevin Shannon executed the oath of office to Samuel Yockey as a Groveport Patrol Officer. Officer Yockey replaces Christopher Gyke and will start work on June 5, 2014. VII. Executive Session Law Director Kevin Shannon requested Council to consider making a motion to go into executive session pursuant to Ohio Revised Code Section 121.22(G) 3 Conferences with an attorney for the public body concerning disputes involving the public body that are the subject of pending or imminent court action; to include all members of Council, the Mayor, the Administrator, the Finance Director, himself and Special Counsel Matthew Stout. Mr. Shannon has a statement of the proposed amendments and Mr. Green can provide Council with some enlightenment on the emergency nature of the Ordinance. The statement of amendments is as follows; in the Title add "and the declaration of an emergency" and in Section 2. strikeout anything after "that" and add the following language " this Ordinance be deemed an emergency measure immediately necessary for the preservation of the health, safety and general welfare of the community as this legislation must be enacted in a timely manner so economic development at the site in question can take place as soon as practicable; WHEREFORE, this Ordinance shall take effect and be in full force upon passage by Council and signature of the Mayor. Mayor - Lance Westcamp Mayor Westcamp commented on the wonderful day for the Memorial Day Ceremony, he personally thanked Warren Motts for serving as Master of Ceremonies and Ms. Hall for the excellent shape of the cemetery. Council Member Hilbert stated she was very impressed that we have a graduate going to Annapolis. The Mayor remarked the Guest Speaker, Carl Price did an excellent job. The City needs to look into getting an upgraded speaker system. Mayor Westcamp congratulated Clerk of Council Ruthanne Ross on her wedding anniversary today. B. Administrator - Marsha Hall Administrator Marsha Hall reported there is an amendment to be included in the state budget that will take more of the City's tax revenue. Ms. Hall will keep Council updated as the state moves forward with the matter. Council Member Dildine inquired of Administrator Hall where is the state going with the bill, are they wanting to completely overhaul how municipal income taxes are handled? Ms. Hall responded the bill addresses resident versus City of Groveport Page 6 City Council Meeting Minutes May 27, 2014 non-resident income tax revenue. The Senator who introduced the bill reasons a large portion of the revenue is paid by people who do not get to vote on tax issues for the municipality to whom their income tax is paid. The City providing the state with lists of resident versus non-resident tax payers, will not solve the issue. The state looks to go with a resident only income tax. Finance Director Jeff Green commented a resident only income tax will decimate the City. #115-2014 Adm Report to Council - May 27 Attachments: Adm Report to Council - May 27.pdf C. Chief of Police - Ralph Portier Chief of Police Ralph Portier thanked the Mayor, Council and Administration for their continued support. The department is running smoothly with everyone coming together. They will be finishing the Sergeants' contract very soon. D. Director of Finance - Jeff Green Nothing further to report. E. Director of Law - Kevin Shannon Nothing further to report. F. Council Members - Ed Rarey, Jean Ann Hilbert, Donna Drury, Ed Dildine, Shawn Cleary & Becky Hutson Council Member Rarey apologized to everyone for being late to the meeting. Mr. Rarey commented he has met with a group of people regarding the grass issues on Cherry Street. He addressed two areas where varmints have taken up residence. Another issue deals with the truck traffic giving the City streets a beating; it is hard on our streets with trash collection trucks overloading. Another issue Mr. Rarey commented on dealt with Palm's Pond and its poor condition. Administrator Hall responded after the grass issue was discussed at the last Committee of the Whole meeting, notifications were sent out to the residents with high grass. On some of the vacant properties they are posting the notification on the door to speed up the process set forth by our law. They will start the City's routine of having the high grass cut. She knows a number of locations on City of Groveport Page 7 City Council Meeting Minutes May 27, 2014 Cherry Street have been sent notification. As to the Palm's Pond issues, Administration is looking into all of the City's ponds and signs will be ordered early next week for all the sites. Steve Farst and Tom Byrne are working with AEP to supply electric service to install a pump to keep the pond at a constant level. The pump will keep the level of the pond stable which will alleviate the marshy area around the pond. Steve Farst and Tom Byrne are working towards a permanent solution for the water level, the process takes time when you count in all the factors. Council Member Hilbert asked if the City has a nuisance officer for the varmints causing problems. Mr. Green commented if wild animals become a real problem, the City can contact the Ohio Department of Natural Resources. Mayor Westcamp agreed with Mr. Rarey on getting the high grass issues attracting the varmint resolved and inquired as to how long after notification does the resident have to cut their grass. Law Director Shannon responded he believes they have 10 days to respond to the notification. If there is no response, the City goes in and mows the area and bills the resident. If the bill is not paid within 30 days, the City starts the process of placing a lien on the property. Ms. Hall confirmed the Mayor's inquiry to the City contracting out the mowing service. Council Member Dildine asked Mr. Rarey for clarification of the truck traffic going through the City alleys; was it just trash trucks or are other trucks using the alley ways. Mr. Rarey stated just truck traffic was relayed to him. Mr. Dildine wanted to know if the situation called for the police to be patrolling the alleys. Council Member Hilbert asked Mr. Shannon how long the City keeps membership fees in escrow for members of Silver Sneakers. Council Member Dildine stated it was until they quit the program or the program stops. Mr. Shannon stated he believes it is three years. Council Member Dildine believes it stays in escrow per the contract with Silver Sneakers until the member quits the program or the program is no longer available at the recreation center. Mrs. Hilbert asked if the City was doing Shred-It with the Touch-a-Truck event. Council Member Hutson raised the matter of any updates on the Orchard sign. Ms. Hall responded the topic is to be discussed under other business. Council Member Cleary asked for any updates on the Fourth of July festivities. Ms. Hall advised a Fourth of July committee member should be in attendance at the next meeting to update Council. There will be a lot of kids' events in the afternoon. Mr. Cleary emphasized the need to get electric service back to Palm's Pond. G. Clerk of Council - Ruthanne Sargus Ross Nothing to report. H. Standing Committees Council Member Cleary reported the Cemetery Committee addressed the possibility of adding an old fashioned well pump on the other side of the cemetery to provide water to the new part of the cemetery. XI. Other Business Law Director Kevin Shannon addressed Council on the Orchard Subdivision sign at the entryway on Cherry Blossom Drive at Hendron Road. Currently where the sign is located, it is on another property owner's tract. It is not on City property nor on a tract owned by any association with the Orchard. The sign needs to be maintained and with no community organization in the Orchard subdivision the matter needs addressed. The City maintains most, if not all, of the entryways in our subdivisions. Ms. Hall clarified not all, some are the property of the homeowners' associations. One solution to the matter would be if Council would consider making a motion to allow the installation of the sign into the City's right-of-way at the intersection of Cherry Blossom Drive and Hendron Road, provided that it does not cause any traffic safety issues on either Hendron Road or Cherry Blossom Drive. Once the sign is on City property, the City can maintain the entryway. Council Member Hilbert queried where Administration looks to place the sign. Ms. Hall stated it will be on the same side of the street City of Groveport Page 9 City Council Meeting Minutes May 27, 2014 towards the tree line. Mr. Shannon advised Council can act by way of a motion, ordinance or resolution pursuant to the City of Groveport Charter. If a motion is made to permit the installation of the Orchard Subdivision sign into the City's right-of-way at or near the corner of Hendron Road and Cherry Blossom Drive; provided traffic safety on either Hendron Road or Cherry Blossom Drive is not compromised, Council can act on the matter tonight. Council Member Hutson inquired if the same sign will be used or will a new one be installed. Ms. Hall commented the same sign will be installed. Council Member Cleary asked if there was a contingency plan in place if it is found to impede traffic. Ms. Hall advised it will be moved back along Cherry Blossom Drive. A motion was made by Council Member Hutson, seconded by Council Member Drury, to permit the installation of the Orchard Subdivision sign into the City's right-of-way at or near the corner of Hendron Road and Cherry Blossom Drive; provided traffic safety on either Hendron Road or Cherry Blossom Drive is not compromised.
